The following comment(s) are requested to be included as conditions for approval by Frederick County: 1. The proposed business use is compatible with airport operations. 2. The FAA determination referenced above was based on coordinates and elevations submitted for the proposed structure as follows: Latitude: 39-08-11.07N NAD 83 Longitude: 78-07-43.11W Site Elevation: 671' (SE) 69' (AGL) 740' (AMSL) 3. Compliance of all conditions in the referenced FAA determination on pages one and two. 4. In accordance with the Code of Virginia, Section 15.2-2294 and FAA CFR Title 14 Part 77.9, the proposed site and structure is in close proximity to the Winchester Regional Airport and meets FAA criteria requiring any companies operating crane(s) and/or any temporary construction equipment exceeding the max height of the proposed structure of 740' AiY+ISL, are required to file a separate 7460-1 for Obstruction Evaluation / Airport Airspace Analysis with the FAA using form 7460-1. Filing with the FAA will automatically go the Virginia Department of Aviation for their review. It is required that FAA Form (7460-2, Part 2) Notice of Actual Construction or Alteration, be a -filed any time the project is abandoned or within 5 days after the construction reaches Its greatest height The FAA suggests filing at a minimum of 45 days prior to the expected (start date of construction for a study to be completed and a determination to be issued. However the actual process can take up to 60 days for completion. The FAA determination concerns the effect of the operation on the safe and efficient use of navigable airspace and will include any conditions required by the FAA for operating cranes)/temporary construction equipment at heights greater than the proposed structure. Failure to comply with any conditions in the determination could is a a Federal violation subject to fine(s) and could delay the progress of the project until compliance is met. 5. This determination expires on 01/25/2019 unless: (a) the construction is started (not necessarily completed) and FAA Form 7460-2, Notice of Actual Construction or Alteration, is received by this office. (b) extended, revised, or terminated by the issuing office. (c) the construction is subject to the licensing authority of the Federal Communications Commission (FCC) and an application for a construction permit has been filed, as required by the FCC, within 6 months of the date of this determination. In such case, the determination expires on the date prescribed by the FCC for completion of construction, or the date the FCC denies the application.
