Building shall comply with The Virginia Uniform Statewide Building Code and Section 304, Business
Use Group, of the International Building Code/2012. Other codes that apply are The Virginia Fire Code
2012, ICC/ ANSI A117.1-2009 Accessible and Usable Buildings and Facilities and International Energy
Code.
Building shall maintain height and area as required under T503. Building has full NFPA 13 system and
Fire Depart Connection located.
Four story building shall meet Virginia Building Code, Chap 10, for exiting requirements. Exits shall be
continuous from point of entry into the exit to exit discharge. Question on exterior door location at
interior rated stairway. All required egress shall be accessible. Landings shall maintain a maximum 2%
slope and walkways shall be a maximum 5% slope
Question on above grade Walkway if open or enclosed. Question of building required wall and
opening protections as required in IBC Section 705.3 & Section 506 for wal",ay and generators.
Fire pump room shall be accessible from exterior or be provided with a rated enclosure as required
per NFPA 20; 4.13.2
60% of all entrances shall be accessible
Building overhangs roadway on first floor. The horizontal rating shall be address as required in IBC
Section 506.5, 510.7, and T503.
Handicap Van Parking is required. Minimum width for parking and unloading is 8' w/8' unloading or 11'
w/5' unloading. Accessible parking signage for van shall include $500 fine. See USBC Section 1106.8
for Van accessible signage.
Max slope for walkways, is 5%. Maximum slope for landings at door and top/bottom of ramps is 2%.
All required egress/exits shall be Accessible per ANSI A117.1-09. Walking surface shall meet ANSI
At 17.1-09 for surface.
Retaining walls shown require building permits and, due to height of unbalanced fill, will require a design
by a Virginia Registered Design Professional.
PIease note the requirements in Chapter 17 of BOCA for special inspection requirements on the type of
structure ( Soils, concrete etc.) Compaction/soil bearing/soil testing shall be required for placement of
new store.

Walkway shall be separated from new structure as required by the Virginia Building Code. Generators
shall comply with T602/Chap 7 as required. Rated stair enclosure and exits shall meet Chap 10 Virginia

Dear Mr. Kepler:
On behalf of the Winchester Regional Airport Authority review 01 the FAA Aeronautical Study No. 2017 -AEA -7081 -OE for
the referenced site plan for NFCU Building 3 has been completed. The following comment(s) are requested to be
included as conditions for approval by Frederick County:
1. The proposed business use is compatible with airport operations.
2. The FAA determination referenced above was based on coordinates and elevations submitted for the proposed
structure as follows:
Latitude: 39-08-11.07N NAD 83 Longitude: 78-07-43.11W
Site Elevation: 671' (SE) 69' (AGL) 740' (AMSL)
3. Compliance of all conditions in the referenced FAA determination on pages one and two.
4. In accordance with the Code of Virginia, Section 15.2-2294 and FAA CFR Title 14 Part 77.9, the proposed site
and structure is in close proximity to the Winchester Regional Airport and meets FAA criteria requiring any
companies operating crane(s) and/or any temporary construction equipment exceeding the max height
of the proposed structure of 740' AiY+ISL, are required to file a separate 7460-1 for Obstruction Evaluation
/ Airport Airspace Analysis with the FAA using form 7460-1.
Filing with the FAA will automatically go the Virginia Department of Aviation for their review. This is the link to
the FAA website for additional information to file the request electronically:

It is required that FAA Form (7460-2, Part 2) Notice of Actual Construction or Alteration, be a -filed any
time the project is abandoned or within 5 days after the construction reaches Its greatest height
The FAA suggests filing at a minimum of 45 days prior to the expected (start date of construction for a
study to be completed and a determination to be issued. However the actual process can take up to 60
days for completion.
The FAA determination concerns the effect of the operation on the safe and efficient use of navigable airspace
and will include any conditions required by the FAA for operating cranes)/temporary construction equipment at
heights greater than the proposed structure. Failure to comply with any conditions in the determination could is a
a Federal violation subject to fine(s) and could delay the progress of the project until compliance is met.
5. Burning of any brush or debris on site should be prohibited due to the proximity of the site to the airport.

Obstruction Evaluation) / Airport Airspace A allysis (OE/AAA)
The requirements for filing with the Federal Aviation Administration for proposed structures vary based on a number
of factors: height, proximity to an airport, location, and frequencies emitted from the structure, etc. For more details,
please reference CFR Title 14 Part 77.9.
You must file with the FAA at least 45 days prior to construction if:
your structure will exceed 200ft above ground level
your structure will be in proximity to an airport and will exceed the slope ratio
• your structure involves construction of a traverseway (i.e. highway, railroad, waterway etc...) and once
adjusted upward with the appropriate vertical distance would exceed a standard of 77.9(a) or (b)
• your structure will emit frequencies, and does not meet the conditions of the FAA Co -location Policy
• your structure will be in an instrument approach area and might exceed part 77 Subpart C
your proposed structure will be in proximity to a navigation facility and may impact the assurance of
navigation signal reception
your structure will be on an airport or heliport
filing has been requested by the FAA

** DETERMINATION OF NO HAZARD TO AIR NAVIGATION **
The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 t1.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:
Structure: Building NFCU - Building 3
Location: Winchester, VA
Latitude: 39-08-11.07N NAD 83
Longitude: 78-07-43.11 W
Heights: 671 feet site elevation (SE)
69 feet above ground level (AGL)
740 feet above mean sea level (AMSL)
This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be e -filed any time the
project is abandoned or:
At least 10 days prior to start of construction (7460-2, Part 1)
X_ Within 5 days after the construction reaches its greatest height (7460-2, Part 2)
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking/
lighting are accomplished on a voluntary basis, we recommend it be installed in accordance with FAA Advisory
circular 70/7460-1 L Change 1.
This determination expires on 01/25/2019 unless:
(a) the construction is started (not necessarily completed) and FAA Form 7460-2, Notice of Actual
Construction or Alteration, is received by this office.
(b) extended, revised, or terminated by the issuing office.
(c) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction permit has been filed, as required by the FCC, within
6 months of the date of this determination. In such case, the determination expires on the date
prescribed by the FCC for completion of construction, or the date the FCC denies the application.

OF CURRENT OPERATIONS IN THE AREA OF THE STRUCTURE TO DETERMINE THAT NO
SIGNIFICANT AERONAUTICAL CHANGES HAVE OCCURRED, YOUR DETERMINATION MAY BE
ELIGIBLE FOR ONE EXTENSION OF THE EFFECTIVE PERIOD.
This determination is based, in part, on the foregoing description which includes specific coordinates, heights,
frequency(ies) and power. Any changes in coordinates , heights, and frequencies or use of greater power will
void this determination. Any future construction or alteration, including increase to heights, power, or the
addition of other transmitters, requires separate notice to the FAA.
This determination does include temporary construction equipment such as cranes, derricks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.
This determination concerns the effect of this structure on the safe and efficient use of navigable airspace
by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
regulation of any Federal, State, or local government body.
