Request for Variances to Virginia Erosion and Sediment Control Handbook (VESCH)

Dear Mr. Kepler:
Upon review of the revised site plan dated March 31, 2017, all of our previous comments have
been addressed. Therefore, we recommend approval of the revised site plan.
Also, you have requested a variance to the VESCH standards to use the following alternative
erosion and sediment control measures:
a. Filtrexx Compost Filer Sock, ACF Environmental Smart Fence and CRAFS. These
products will be used in lieu of the silt fence and super silt fence.
We approve the variance request for the use of these products. However, if these products do not
achieve or protect downstream areas, traditional silt fence and super silt fence shall be used. We request
additional on-site inspections be performed to ensure these products are achieving their intended use.

Dear Mr. Kepler:
Upon review of the subject site plan, we offer the following comments:

We recommend providing erosion and sediment control measures downstream of the area
where the existing stormwater pond will be removed. It is extremely important that the
downstream properties are protected against sediment laden runoff from this project
during the duration of the project scope.
2. Fully encapsulate the project area with super silt fence as dual protection during site
work.
Provide a copy of the geotechnical engineering report if available for our review.
4. Due to the complexity of the stormwater plan, we will require documentation from ACF
Environmental that the proposed R -Tanks will work in this application, prior to plan
approval. With the size and height of the proposed structures along with the proposed fill
placed on top of the structures, we need to ensure the structures will be stable.
As required by the ordinance, we will need documentation from the engineer of record
that all stormwater facilities and BMP's are constructed in accordance with the approved
plans and DEQ standards.
6. We will need a variance request for using the proposed Filtrexx Filter Soxx and Smart
Fence HD since they are not in the latest edition of the Virginia Erosion and Sediment
Control Handbook (VESCH). Frederick County will approve there use, but we need to
have a written variance request.
7. For the proposed Plunge Pool in Pond A, provide rip rap sizing, depth, and details of the
facility.
8. Provide an additional narrative as to the timing of the installation of the proposed
retaining wall. In order to complete site grading and installation of the parking garage,
the wall shall be permitted and completed.

Proposed five story parking garage shall meet the height and area limitations of T503. Buildings
;lave sprinkler systems identified.
Accessible parking and unloading shall not exceed 2% slope (1:48). Accessible Route shall
extend from parking and unloading area to accessible route to main entrance. Van spaces require
minimum unloading area 8' with 8' of parking or a minimum of 11' wide parking with 5' of
unloading space is required. Accessible route with max 5% slopes shall be provided from
parking/unloading to main entrance.
All structural plans submitted for permit application shall be sealed by a VA Design Professional
Special inspection requirements of Chapter 17 of IBC shall apply to this type of structure. (soils,
compaction, concrete, steel etc.) Geotech report is required per Uniform Statewide Building
Code, Section 1803

Hey Randy,
First, apologies for the late reply, I was out of the office at the end of last week. I just tried to give you a call, but
the phone got cut off before I ever reached your voicemail. I've discussed with my supervisor and we're going to
assign an address to the parking garage as well. I just have one more question for you first: There's an area
marked on the exhibit you sent that I don't quite understand. It's at the top of Building 3 right by the existing
cul-de-sac. It appears to me that Security Drive extends straight through to the parking garage, but the building
footprint for Building 3 is overlapping this area as well. Is this some sort of building bridge/tunnel scenario? Or
does the road stop before Building 3 forcing a left or right turn into the other parking areas to get through?
I've marked my question area on the attached. Please feel free to give me a call to discuss if that's easier for you.

Good Morning Robin. There will be no permanent office space or staff stationed at this structure.
I was thinking about the habitable comment. Although there won't be any staff stationed here there will be
people in and out of this structure on a daily basis. There also will be an elevator that likely will have an
emergency call box. I would think E911 would want an address so they would know where to go?

I've just discussed the planned buildings with my supervisor. Building 3 will be no problem, but we'd like
a bit more information on the parking garage if you have it available. Typically, we don't address
structures that aren't "habitable" so to speak. To my knowledge this is the first parking garage in the
County that we've ever had an address request for and it doesn't really fit the protocol for a habitable
structure, but we'd like to get all the facts before we make a decision one way or another. Do you know
if the garage is going to have any sort of permanent office space or staff members that will be stationed
there for most of the day?

WINCHESTER REGIONAL AIRPORT AUTHORITY NOTES:
1. IN ACCORDANCE WITH THE CODE OF VIRGINIA, SECTION 15.2-2294, AND THE FAA.,
THE CONTRACTOR MUST FILE A NOTICE OF PROPOSED CONSTRUCTION, FAA FORM
7460-1 WITH THE FAA FOR ANY TEMPORARY CONSTRUCTION EQUIPMENT TO INCLUDE
CRANES, DERRICKS, ETC. IF THEY INTEND TO PERATE AT A HEIGHT GREATER THAN
THE EXISTING STRUCTURE OR 20' 6" ABOVE THE GROUND FOR A MAXIMUM HEIGTH
OF 701.4 AGI.. THE FAA WILL CONDUCT AN AIRSPACE OBSTRUCTION ANALYSIS AND
NOTIFY THE CONTRACTOR IN WRITING OF THEIR DETERMINATION. THE REVIEW
PROCESS CAN TAKE SEVERAL WEEKS AND UNTIL THE FAA COMPLETES THEIR STUDY,
CONSTRUCTION EQUIPMENT CANNOT BE USED AT THE SITE IF IT EXCEEDS THAT
MAXIMUM AS STATED.
2. ALL CRANES WILL BE REQUIRED TO HAVE AN AVIATION OBSTRUCTION FLAG AND/OR

3. OUTDOOR LIGHTING SHOULD BE SHIELDED AND AMBER IN COLOR IN ORDER TO
MINIMIZE LIGHT POLLUTION TO PILOTS APPROACHING THE WINCHESTER AIRPORT.
4, ANY TREES PLANTED AS PART OF THE LANDSCAPING SHOULD BE OF THE TYPE
THAT ARE SLOW GROWING WITH A MAXIMUM MATURE HIEGHT NOT TO EXCEED THE
ELEVATION OF THE PROPOSED BUILDING TO AVOID FUTURE AIRSPACE OBSTRUCTIONS.
5. CONTROLLED BURINGING SHOULD BE PROHIBITED DUE TO THE CLOSE PROXIMITY TO
THE RUNWAY AND SINCE THE PROPERTY IS WITHIN THE FLIGHT PATTERN OF THE

On behalf of the Winchester Regional Airport Authority I offer the following comment(s) as requested conditions for
approval regarding the referenced site plan proposal:
1. The proposed business use is compatible with airport operations.
2. In accordance with In accordance with the Code of Virginia, Section 15.2-2294 and FAA CFR Title 14 Part 77.9,
the proposed site and structure is in close proximity to the Winchester- Regional Airport and meets FAA federal
criteria requiring you to file for an Obstruction Evaluation / Airport Airspace Analysis with the FAA using form
7460-1. Filing with the FAA will automatically go the Virginia Department of Aviation for their review. This is the
link to the FAA website where you can get additional information and file the request electronically:
https://oeaaa.faa.aov/oeaaa/external.=oortal. isp.
The max height submitted for proposed structures must include any appurtenances. The FAA Suggests filing
at a minimum of 45 days prior to the expected star date of construction for a study to be completed and
a determination to be issued. However the actual process can take up to 60 days for completion.
3. Cranc and/or any temporary construction equipment exceeding the max height of the proposed structure must
file a separate 7460-1 for an airspace ana�sis. The FAA suggests filing at a minimum of 45 days prior to
the expected start date of construction for a study to be completed and a determination to be issued.
However the actual process can take up to 60 days for completion.
4. The FAA regulation should be included in the site plans in the general notes and contractors briefed on the
requirement and the length of time for a determination to be completed so as to not hold up the construction
project.
5. For aviation safety the W RAA is requesting obstruction lighting be installed on the top comer(s) closest to the
airport. Lighting must be installed and maintained in accordance with FAA Advisory circular 7017460 -IL Change
1, Obstruction Marking and Lighting.
6. Burning of any brush or debris on site should be prohibited due to the proximity of the site to the airport.
The Winchester Regional Airport Authority has received the final determination of the FAA Airspace Analysis and finds the
proposed structure will not impact airport operations.
As a condition for approval of the site plan by the County of Frederick, the Winchester Regional Airport is requesting
inclusion and compliance with the above comments.

Obstruction Evaluation / Airport Airspace Analysis (0E/AAA)
The requirements for filing with the Federal Aviation Administration for proposed structures vary based on a number
of factors: height, proximity to an airport, location, and frequencies emitted from the structure, etc. For more details,
please reference CFR Title 14 Part 77.9.
You must file with the FAA at least 45 days prior to construction if:
• your structure will exceed 20011 above ground level
,your structure will be in proximity to an airport and will exceed the slope ratio
your structure involves construction of a traverseway (i.e. highway, railroad, waterway etc...) and once
adjusted upward with the appropriate vertical distance would exceed a standard of 77.9(a) or (b)
a your structure will emit frequencies, and does not meet the conditions of the FAA Co -location Policy
* your structure will be in an instrument approach area and might exceed part 77 Subpart C
6 your proposed structure will be in proximity to a navigation facility and may impact the assurance of
navigation signal reception

The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:

This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be a -filed any time the
project is abandoned or:
At least 10 days prior to start of construction (7460-2, Part 1)
X, Within 5 days after the construction reaches its greatest height (7460-2, Part 2)
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking/
lighting are accomplished on a voluntary basis, we recommend it be installed in accordance with FAA Advisory
circular 7017460-1 L Change 1.
The structure considered under this study lies in proximity to an airport and occupants may be subjected to
noise from aircraft operating to and from the airport.
This determination expires on 11/04/2018 unless:
(a) the construction is started (not necessarily completed) and FAA Form 7460-2, Notice of Actual
Construction or Alteration, is received by this office.
(b) extended, revised, or terminated by the issuing office.
(c) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction permit has been filed, as required by the FCC, within

6 months of the da_ _ of this determination. In such case, the dt.., r-mination expires on the date
prescribed by the FCC for completion of construction, or the date the FCC denies the application.

by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
