Jeremy, thank you for the opportunity to review the resubmission. It appears all of the Planning & Development staff comments have
been addressed. In regards to the request for Health Department comments, this is a result of the proposed restaurant us, which we
typically request a comment from VDH . The request for GIS comments was tied to the subdivision comment from our first comment
letter; given this is to remain a single lot and not going to be subdivided, there is no need for GIS comments/assigning separate
addresses.
As requested, provide final comments/approval from VDOT and an agency comment from the Health Department with the final
submission. For the final submission, please provide at least five (5) hard copies, with a signed seal, for signature by the Zoning
Administrator. Please also provide a PDF copy on a disk for the project file.

Dear Mr. Tweedie:
Planning Staff has reviewed the above -referenced site plan resubmission, dated March 20, 2017,
in response to Staff's comments dated February 10, 2017 to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan will not
be approved until the issues in this letter, as well as all issues of the other review agencies, have
been adequately addressed. Please review Staff's comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments:
1) Signed Seal. A signed seal of the certified Virginia land surveyor, architect, or engineer
who prepared the site plan is required on final copies for signature by the Zoning
Administrator.
2) Conformance with Rezoning #05-16. Per previous correspondence, Staff will not
approve building permits until documentation demonstrating conformance with Proffer D
have been provided. Actions required under Proffer D should be undertaken within 30 -
days of site plan approval.
3) Interstate Area (IA) Overlay. Please provide the details (size, height, location) of any
proposed interstate overlay sign, as applicable, and as consistent with Section 165-704.05
of the Zoning Ordinance. If no IA sign is to be provided, please add a note to this effect.
4) Dumpster Areas. Include details regarding screening/fencing of the outdoor dumpsters.
These should be completely screened from view via a six-foot tall board -on -board fence,
wall, berm, or evergreen screen.
5) Outdoor Lighting. Add a note that all lighting will conform to Section 165-201.07,
Outdoor Lighting Standards, of the Frederick County Zoning Ordinance, and will be full
cutoff on Sheet 25.
6) Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County Fire

Marshal, the Frederick County Sanitation Authority (FCSA), the Virginia Department of

After you have revised the site plan, please resubmit one (1) copy so that Staff may verify the
information contained on the plan addresses the above comments. Staff will also need all
approved review agency comment sheets and at least five (5) copies of the final plan for approval

Comment Response Letter
Dear Mr. Klein:
We are in receipt of Planning comments dated February 10, 2017 and offer the following responses:
Comments from Frederick County Planning
Comment 1: Site Plan Reference Number. Add the Site Plan (SP) #07-17, to the cover sheet.
Response: Revised as noted.
Comment 2: Subdivision. If land bays (Units 1, 2, & 3) are planned to be on a separate lots, the plats
for the lot needs to be approved and recorded prior to final site plan approval. The site plan should
show the new lot layout, and copies of the recorded plats should be submitted for the project file. A note
should be added to this effect. Response: See attached recorded documents.
Comment 3: Previous Approvals. Note all previous approvals relating to the subject property including
Rezoning #05-16. A separate plan sheet should be provided which includes the approved Proffer
Statement from the Rezoning Application.
Response: Revised as noted.
Comment 4: Conformance with Rezoning #05-16. Ensure conformance throughout the site plan with
the approved Proffer Statement including:
Label all improvements outlined the approved Proffer Statement,
• Amoco Lane pavement upgrades should be shown on the applicable plan pages (Proffer B-1);
• On Sheet 11, note the inter -parcel ingress/egress easement with the adjoining property, and that
it will be recorded prior to issuance of the Certificate of Occupancy Permit associated with this
site plan. If the easement is already in place, provide the legal reference (Proffer B-2); and
• Provide for review a draft letter to adjacent property owners regarding the "Off -Site Residential
Buffer" (Proffer D). This draft letter should also be included on the plan sheet with the approved
Proffer Statement. Owners who request the "Off -Site Residential Buffer" must be confirmed, and
the buffer will need to be show on the plan set prior to final site plan approval.

Comment 5: Interstate Area Overlay. Per the approved Rezoning this property also has an existing IA
(Interstate Area Overlay) District designation which permits one (1) interstate overlay sign. IA
Overlay signs are permitted for hotels, restaurants and gasoline stations. Please provide the details
(size, height, location) of any proposed interstate overlay sign, as applicable, and as consistent with
Section 165-704.05 of the Zoning Ordinance.

Comment 6: Proiect Information. Under "Project Information " on Sheet 2 the following items should
be revised:
• Revise the "Project Site Area" and "Disturbed Area, " as the total project site is 1.87 acres as
listed in the County's GIS;
• Add under "Current Zoning" that the property is also within the "Interstate Area Overlay
(IA)" District,
• Revise "Current Use" to "Vacant/Unoccupied; "
• Revise "Proposed Use" to "Hotel/Restaurant with Drive-Thru and Retail/Commercial; "
• Revised "Required Setbacks — Side" to "N/A; "
• Revise the "Maximum Building Height" to 35 feet (FT) as permitted in the B2 (General
Business) Dimensional and intensity requirements. Add a note under "Maximum Building
Height" specifying the hotels in the B2 District may be up to 60 FT (Section 165-201.03(6),
Height limitations: exemptions);
• Under "Signs, " add a note that any proposed building mounted signage will be reviewed and
approved at time of building permit, and
• Provide the required number of loading spaces (1) and those proposed. Label the proposed
loading space(s) on the applicable sheets.

Comment 7: Outdoor Lighting. Please provide a Photometric (Lighting) Plan and Lighting Plan
Details sheets for review by Staff. Please ensure it fulfills requirements outlined in the Zoning
Ordinance. Add a note that all lighting will conform to Section 165-201.07, Outdoor Lighting
Standards, of the Frederick County Zoning Ordinance, and will be full cutoff. A table showing
minimum, maximum, and average illumination should also be provided for review. Specify the height
of all light fixtures (pole and building -mounted).

Comment 8: Open Space. On Sheet 14 distinguish the proposed open space using shading or hatching.
Response: 25% Landscape area calculation and delineated is provided, refer to sheet 2 and 15.
Comment 9: Agency Approvals. Comment sheets (approvals) are required from the following
agencies: the Frederick County Inspections Department, the Frederick County Fire Marshal, the
Frederick County Sanitation Authority (FCSA), the Virginia Department of Transportation (VDOT),
the Virginia Department of Health, the Frederick County Geographic Information Systems (GIS)
Department, and the Frederick County Engineer.

Comment 10: Additional Landscaping. Staff recommends additional landscape screening (evergreen
trees) around the proposed outdoor trash receptacles. This will further enhance the landscaping on-

and/or building elevations for the project file, as applicable.
