Dear T1s. King:
This department has investigated complaints regarding barking dogs and violations of the approved
CUP for the above -referenced. property. After a site inspection, this department has concluded that
alt the present time, this property is not in violation of the Frederick County Zoning Ordinance or the
approved Conditional Use Permit for the property. The approved C UP for a kennel has not yet been
utilized as there are no puppies being raised or bred on the property at this time. Therefore,
Condition #3 on the approved CUP regarding barking dogs is not yet applicable.

Continuation or Revocation of Conditional Use Permit #02-03 for Timothy E. Felty

The Frederick County Board of Supervisors approved Conditional Use Permit (CUP) #02-03 for Timothy E.
Felty on March 10, 2003, to allow for a dog kennel (breeding only), on property identified with P.I.N. 426 -A -
39G in the Gainesboro District. This CUP was approved with the following conditions:
1) All review agency comments and requirements shall be complied with at all times.
2) This permit is for a breeding kennel only; animals not associated with the breeding operation shall
not be boarded at any time.
3) All dogs kept at the kennel must be controlled so as not to be anuisance to any adjoiriing property
by barking or roaming free. All dogs must be kept with a fenced -in area.
4) All requirements of the Frederick County Code and the Code of Virginia pertaining to dog kennels
shall be complied with at all times.
5) Any expansion or change of use shall require a new conditional use permit.
6) No more than thirty (30) dogs shall be allowed on the property at any given time.
7) Any proposed business sign shall conform to Cottage Occupation sign requirements and should
not exceed four (4) square feet in size.

Staff conducted site inspections in response to the formal complaints on

being held on Wednesday, June 16, 2004 at 7:00 p.m. in the Board Room of the Frederick County
Administration Building at 107 N. Kent Street, Winchester, Virginia to consider the following:
The Revocation of Conditional Use Permit #02-03 of Timothy E. Felty for a Dog Kennel
(Breeding Only). The property is located at 536 Fletcher Road and is identified with Property
Identification Number 26 -A -39G in the Gainesboro Magisterial District.
Any interested parties having questions or wishing to speak may attend this public hearing. A copy
of the application will be available for review at the Handley Library and the Bowman Library the
week of the meeting, or at the Department of Planning and Development located at 107 North Kent
Street in Winchester, Virginia. Information regarding this application will also be available via the
Planning Department's website at www.co.frederick.va.us.
