Section 46.2-1510 of the Code of Virga states in part, "No license shall be
issued to any motor vehicle dealer unless he has an established place of business, owned
or leased by him, where a substantial portion of the sales activity of the business is
routinely conducted and which: (1) Satisfies all local zoning regulations. "
The section below is to be completed by the Zoning Administration verifying that
the applicant has complied with all requirements from the Town, City or County in which
the dealership is located.

of new or used motor vehicles. Applicant has complied with all zoning
requirements and permits.
As the zoning official for the locality in which this business is located, I verify by
my signature below that the above named business is in compliance with the zoning
ordinance of this locality for the use for which the applicant is applying. It is understood
that the Motor Vehicle Dealer Board will license the dealer for business once zoning
verification is received and all Dealer Board requirements are met.

It is staffs understanding that Keplinger Repair Service has expressed interest in expanding their
operations. Keplinger currently operates an emergency services vehicle and apparatus repair service
from 218 Woodchuck Lane (PIN 52 -A -280A). They are interested in utilizing an existing structure
on the McFarland's property, eastside of Woodchuck Lane, for expansion of their repair services.
The McFarland property is zoned RA. The Zoning Ordinance does enable automotive repair (Public
Garages) with an approved Conditional Use Permit (CUP). Therefore, it would be necessary to
obtain a CUP for the McFarland site prior to operating the repair service.
The County's CUP application must be authorized by the property owner; but, the property owner
does not necessarily need to be the CUP applicant. To clarify - McFarland would need to sign the
CUP application and a Power of Attorney (POA) form. The Keplingers could represent the CUP
application through the review and approval process. The POA form simply acknowledges that the
property owner has granted permission to the Keplingers to process the CUP.
I have attached a CUP application package and POA form. The CUP application package contains
detailed explanations and directions. Should additional guidance be necessary, please let me know.
