On a similar situation to that of the Fellowship Bible Church, Horton's Nursery is seeking a Conditional USe Permit
(CUP) to construct a nursery at a site on Route 277, outside the SWSA and UDA. Therefore, Horton's would need the
Board's approval of the extension of service outside the SWSA and UDA prior to tapping into your water line. On the
CUP's application, they have provided comments from the FCSA that water service would be available. My research of
Board actions did not locate any policy provisions to enable water service to this property.
Do you have additional background that would support Horton's rights to tap your water line on Rt 277? My staff is
compiling the staff report for the CUP and we need to confirm if the Board has already granted an extension of water
service to this property.

The church was allowed to install a private sewer line so they could expand. Did the planning commission or
supervisors have to agree to this extension of sewer out of the sewer and water service area?
