Dear Mr. and Mrs. Arnette:
Staff conducted a follow-up inspection of the above referenced property on October 11,
2006, and determined that the previously discussed illegal landscape business zoning
violation has been removed. Therefore, the property is in compliance with the zoning
ordinance at this time. I have attached to this letter photos taken of the property, which
illustrate the property being in conformance with the zoning ordinance.
As you are aware, the Zoning Ordinance prohibits the use of this property for any aspect
of a landscape business, which includes storage of materials, equipment, and vehicles. In
recognition of your efforts to secure and, in the future, renovate the existing residential
dwelling, we recognize that you may utilize your landscape business employees to
conduct the renovation improvements. As such, while working on this home renovation,
it is foreseeable that workers may utilize a company vehicle to transport the home's
renovation materials to the site, as well as remove construction debris. Therefore, we are
agreeable that during the hours that your employees are working on the house, a company
vehicle may be utilized for transportation and be parked at the property. As previously
discussed, these company vehicles and equipment are not to be stored on the property.

Dear Mr. & Mrs. Arnette:
Per our conversation on your property September 21, 2006, the Frederick County
Planning Department has granted you a 15 day extension for the zoning violation on the
above- mentioned parcel. This extension has been granted on the premise that a
Conditional Use Permit (CUP) was withdrawn recently and will allow for the remaining
items (business vehicles, heavy equipment, and employees) to be removed. After the 15
day extension, the property will no longer contain uses not suitable for a residential use.
The 15 day extension expires October 6, 2006. Failure to remove the remaining items
deemed illegal will result in a criminal complaint being filed against you.
By granting this extension the right to appeal this zoning violation through the Board of
Zoning Appeals (BZA) under Section 15.2-2311 of the Code of Virginia, is waived.
Please find attached to this letter, photos of the site on September 21, 2006 displaying
items that were identified as being legal (building materials), permitted that these
materials are being strictly used for the structure on the property. Also attached are
photos of the business vehicles with business related equipment that need to be removed
within the 15 day time period.

Dear Sir or Madam:
Your application for a construction permit filed with the Frederick -Winchester
Environmental Health Department has been evaluated in accordance with the
requirements contained in the Code of Virginia, Section 32.1-163, the Sewage
Handling And Disposal Regulations and current agency policy and procedures for
processing for on-site disposal systems.
Based on the information filed with your application, and the site and soil
evaluations conducted by the Department's representatives, your application for a
Sewage Disposal System Construction Permit for the above referenced location is
denied. The Department's findings and reasons for denial are set forth below:

In accordance with the Virginia Administrative Process Act, Title 9, Chapter
1.1;1 and Section 32.1-164.1 of the Code of Virginia, this letter is to further
inform you of your right of appeal from the decision of the Department, which is
specified in this letter.
If you desire to pursue your right of appeal, you may at your discretion be
represented by counsel. The first step in the appeal process is to submit a
written request, detailing and outlining all the facts and other such data or
information which will. form the basis for your appeal, to Mr. Steve Lee, 107 N.
Kent Street, Suite 201, Winchester, VA 22601.
In accordance with current policy, your right to appeal the Departments decision
concerning the previously noted Application for a Sewage Disposal Construction
Permit, will expire thirty (30) days from receipt of this notice. If you desire
to pursue your right of an appeal after this allotted time period has expired,
you will be required to submit a new Application along with the appropriate
filing fee.
Enclosed is your partially completed application for a permanent pump and haul
system for sewage disposal. Permanent pumping and hauling is prohibited unless
done under the auspices and supervision of a government entity, in this case,
Frederick County. Therefore, Frederick County is to determine if a site can be
approved for a pump and haul system based on the owner's statements as to
proposed use.
