Conditional Use Permit #07-06 was approved enabling a country general store that does not exceed 8,000 square feet. Further conditions associated with the approval of the Conditional Use Permit include the following: 1. All review agency comments and requirements shall be complied with at all times. 2. An engineered site plan shall be submitted to and approved by Frederick County, and the site improved accordingly, prior to operating store activities on site. The project site will adhere to commercial parking and landscaping standards. 3. One monument sign shall be allowed on the property; the sign shall be limited to 50 square feet in area. The sign shall not exceed ten feet in height. 4. No on-site vehicle storage or sales allowed. 5. There shall be no on-site food preparations without Health Department approval. 6. Store hours of operation shall be between 5:00 am to 10:00 pm. 7. No outdoor display of goods after business hours will be permitted, other than seasonal display items. The outdoor display area shall be limited to 500 square feet. 8. There shall be no more than one vehicular entrance for the site. 9. Any expansion or change of use will require a new conditional use permit. 11. Approval of CUP #07-06 will null and void the existing CUP #10-03. It was also noted that during the site plan process a number of items should be addressed to protect the natural environment: the storm water management facility should be designed to accommodate 150 percent of projected run-off, a dike system shall be constructed around the septic tanks to capture system failure; and that a septic system alarm should be established to trigger no later than when the holding tanks reach 80 percent capacity. Your Conditional Use Permit #10-03 for a country store with outdoor display areas, was approved with the same conditions as recommended by the staff, as follows: 1. All review agency comments shall be complied with at all times. 2. An engineered site plan shall be submitted to and approved by Frederick County prior to establishment of the outdoor display areas and expansion of the country store. All improvements identified on this site shall,be completed prior to operating the business.. Any new signage will be limited to one (1) illuminated freestanding business sign; not to exceed fifty (50) square feet in area and no higher than ten (10) feet in height along the frontage of Millwood Pike (Route 50). 4. Outdoor display area shall not exceed 1,000 square feet in area. No on site vehicle fuel sales allowed. 6. Any expansion or change of use will require a new Conditional Use Permit.
