Catholic Diocese of Arlington
The Catholic Diocese of Arlington proposes to use the former Franciscan
Monastery in White Post, Virginia as the Diocese's new Spirituality Center — a facility
for reflection, worship, retreats, and diocesan meetings. The Spirituality Center will be
used by priests, parishioners, diaconate aspirants, youth ministry, and other ministries.
These uses will be for small retreats, some that may be for several nights; and for larger
groups for daytime use. There will be no use by corporate or business groups. The use
will be restricted to religious individuals and groups. Except for resident staff (not to
exceed 5) there will be no occupancy exceeding 30 days, with the typical occupancy not
exceeding one week and in most cases only a few days. A possible schedule of such use
is attached as Exhibit A.
The existing facilities are located on a 150 acre site located at 125 Old Kitchen
Road and include a chapel with approximately 100 seats, a cafeteria, meeting rooms,
library, sleeping rooms, administrative spaces, and supporting areas. The monastery
opened in 1960 as a training facility for young priests with the Province of the Sacred
Heart of Jesus, T.O.R. In 1972 it became home to the Franciscan Center for Spiritual
Renewal, a part time retreat center, and in 1991 a residence and care center for elderly
friars.
The proposed use will be limited by the availability of water and sewer. The
water plant and the sewage treatment facility is operating under a VPDES Permit that
requires monitoring the water plant backwash discharge and sets a zero limit discharge
for the sewage lagoon. The Permit estimated discharge to the sewage lagoon at an
average rate of 1,600 GPD and effectively sets the limit on use of the Property. The
operation of the water plant and the sewage facility will be strictly monitored by the
facility manager to ensure the discharge limits are not exceeded. Scheduled events may
be cancelled if the discharge limits are in danger of being exceeded.
The CDA Spirituality Center will operate year round (subject to the above
discussed limits). The existing kitchen will be refurbished to provide for "lite" meals and
for small groups with many events and large groups served by caterers. Some groups will
be provided with "box" lunches.
The proposed schedule of available facilities is attached as Exhibit A. While we
project as many as 160 people in the facility at any one time, these events are not
expected to last longer than about 7 hours, with most being of shorter duration. Note that
weather permitting, we expect some individuals and small groups to experience the
outdoors. The outdoor activities will be allowed to develop at a natural pace as the
interest is such activities develops. We propose to start with broadly defined trails that we
have called a Nature Trail and a Reflection Trail. We do not propose any structures on or
along these trails. Some individuals may carry a portable stool or chair if they wish to
stop along the way for reflection. The trails will be pervious materials with small (and
low) markers. As these trails are become more used, low benches may be added.
We propose to make limited renovations to some areas of the existing facility. We
propose to provide fire sprinklers in all sleeping rooms and meeting rooms along with a
smoke detector and alarm system through out. Maintenance and repairs will be
accomplished where needed.
In the future, say 5 —15 years we anticipate a more complete renovation and
possible expansion of the facility. The availability of public water and sanitary sewer
would accelerate the possible expansion. The "experienced" use of the Spirituality Center
will also have a large input to any plans for expansion.

DEQ does not generally become involved in local zoning, use, and permitting issues, but can gladly
comment on VPDES Permit No. VA0089010 reissued to the Franciscan Friars, T.O.R. on April 14,
2005, and subsequently transferred to the Catholic Diocese of Arlington, VA on January 10, 2007.
VPDES Permit No. VA0089010 requires the wastewater lagoon be operated and managed such that
surface and groundwater water quality and uses are protected. The CDA Spirituality Center wastewater
lagoon operates under a "no discharge" condition and is limited to an average influent flow of 1600
GPD, which corresponds to a lagoon liner permeability of 1X10-6 cm/sec as required by 9 VAC 25-790-
720.
The most recent request for reissuance of this permit was received by DEQ on August 16, 2004. The
owner also forwarded a copy of their request the Virginia Department of Health (VDH). The VDH
replied to DEQ by memorandum dated August 19, 2004, noting no objection to the request. On
February 8, 2005, DEQ developed a draft permit in response to the reissuance request. The draft permit
was public noticed on February 22 and March 1, 2005 in the Winchester Star. Local government
officials (County Administrator, County Board of Supervisors Chairman, and Planning District #7
Executive Director) were copied with the public notice on February 25, 2005, and invited to comment.
DEQ did not receive any comments from local government or the public in response to the public
notice. The draft permit was authorized by DEQ on March 29, 2005, and became effective on April 14,
2005. The permit includes all applicable limitations and requirements, and it is the responsibility of the
owner to demonstrate compliance with the permit. DEQ currently has no reason to believe the Diocese
is or will be unable to demonstrate compliance with this VPDES permit.
The most recent DEQ inspection of the lagoon was completed on July 20, 2004. The inspection report
notes the lagoon was in fair condition, and included several required actions (update lagoon observation
log, maintain path to the lagoon outfall, clear lagoon berm of any brush, inspect lower level discharge
valve) necessary to ensure the lagoon does not discharge and is properly maintained. On August 16,
2004, DEQ received notice from the permittee (Franciscan Friars, T.O.R.) that the required actions had
been completed. DEQ's next inspection of the lagoon will take place prior to January 2010.

Antibacksiiding: This permit reissuance complies with the Antibacksliding provisions of the
VPDES Permit Regulation (9 VAC 25-31-220.L).
Antidegradation Review & Comments:
Tier: 1
The State Water Control Board's Water Quality Standards includes an antidegradation policy (9
VAC 25-260-30). All state surface waters are provided one of three levels of antidegradation
protection. For Tier 1 or existing use protection, existing uses of the water body and the water
quality to protect these uses must be maintained. Tier 2 water bodies have water quality that is
better than the water quality standards. Significant lowering of the water quality of Tier 2 waters
is not allowed without an evaluation of the economic and social impacts. Tier 3 water bodies are
exceptional waters and are so designated by regulatory amendment. The antidegradation policy
prohibits new or expanded discharges into exceptional waters.
The antidegradation review begins with a Tier determination. The Franciscan Friars, T.O.R.
discharges to an intermittent unnamed tributary (U.T.) of Opequon Creek via Outfall 002. The
receiving stream is classified as Tier 1 because there is no stream flow at the discharge point
during drought conditions. The U.T. flows into a segment of Opequon Creek, which is also
classified as Tier 1. Opequon Creek is listed as impaired for fecal coliform and the General
Standard (Benthic) in the currently approved 303(d) TMDL Priority List. Waste load allocations
were calculated and permit limits set such that WQS's are maintained at all points downstream
of the discharge.

21. Sewage Slndge Use or Disposal: A Sludge Management Plan (SMP) was submitted and
approved as part of the previous permit application. The facility septic tank is periodically
pumped and solids received by the lagoon are very low due to the low influent flow. As such,
No sludge has needed to be removed and can be adequately stored in the lagoon. The SMP will
be revised and submitted for approval once the most cost effective way to remove the sludge is
determined and the facility actually needs to remove the sludge. There are no proposed changes
to the approved SMP at this reissuance.
22. NPDES Permit Ratiniz Worksheet: See ATTACHMENT F
Total Score: 70 Classification: Minor
In accordance with Department guidance, the NPDES Permit Rating Worksheet was completed
for the water softener and iron removal backwash water discharge (Outfall 002), and this
discharge is classified as "Industrial Minor".
NOTE: The facility is classified as "Municipal Minor" because the primary source of
wastewater generated at the site is sanitary wastewater (Outfall 001).
23. Material Storage: On-site storage of material shall be addressed in the Operations and
Maintenance Manual and maintained onsite by the permittee. These documents describe
procedures and practices that provide adequate measures taken to prevent stored material from
reaching state waters. Per the permit requirements of the permit, a revised Operations and
Maintenance Manual addressing this requirement shall be submitted for approval by the
Department.
24. 303(4) List Considerations: This facility will discharge to a stream segment listed in the
currently approved 303(d) list. The receiving section of Opequon Creek is listed for non -
attainment of bacteria and TSS in the currently approved 303(d) TMDL Priority List. The
facility is currently assigned a TMDL wasteload allocation of 10 kg/yr for TSS. This is based on
a flow of 241 GPD and TSS concentration of 30 mg/L for Outfall 002.
25. Variances/Alternate Limits or Conditions: None
26. Application Testing Waiver:
The applicant requested waivers from "the sampling and testing requirements in the application
forms." Their justification for the waiver "is the very minor nature of the Franciscan Friar
operation [and] it is impractical and uneconomical for [them] to conduct effluent sampling and
testing." Because Outfall 001 does not result in a discharge to waters of the US there are no
sampling requirements included in the application Form 2A. Form 2C contains sampling
requirements for Outfall 002. Parameters to be sampled include: BOD, COD, TOC, TSS, NH3,
Flow, Temperature (Winter and Summer), and pH. The applicant did provide data for TSS,
Flow, and pH. The applicant was previously granted a waiver from sampling for BOD, COD,
TOC, NH3, and Temperature for Outfall 002 and is also not required by the existing permit to
monitor for these parameters. Therefore, the waiver request is deemed acceptable for BOD,
COD, TOC, NH3, and Temperature. The applicant must also include data for any items listed in
Part V.B. that are believed present in the discharge. Because the discharge results from the
operation of a water treatment system, which utilizes manganese green sand filters, the applicant
must provide sample data for manganese, iron, and color. These items were previously sampled

and the data submitted to the Department. Because there has been no change to the system, this
data will be carried forward at this reissuance. Per the VPDES Permit Manual, page IN -175
(Water Treatment Plants) the applicant must also submit data for Cadmium, Chromium, Copper,
Lead, Mercury, and Zinc. These parameters have not previously been sampled and the applicant
did not provide sample data for these parameters at this reissuance. As a result, the applicant
will be required to sample for these parameters as a requirement of the reissued permit.
27. Regulation of Users required by 9 VAC 25-31-280.B.9: There are no industrial users
contributing to the treatment works.
28. Storm Water Management: VPDES Permit Regulation, 9 VAC 25-31-10 defines discharges of
storm water from municipal treatment plants with design flow of 1.0 MGD or more, or plants with
approved pretreatment programs, as discharges of storm water associated with industrial activity.
9 VAC 25-31-120 requires a permit for these discharges. Stormwater from the Franciscan Friars
T.O.R. WTP does not require monitoring or limitation based on the SIC Code and narrative portion
of the stormwater regulation. Therefore, this facility is not required to have a storm water
discharge permit or No Exposure Certification. If conditions change at the facility, and any
industrial materials or activities become exposed to storm water, coverage under a VPDES
permit may be required prior to any point source discharge of storm water from the facility.

thwallace@deq.virginia.gov. Persons may comment in writing or by e-mail to DEQ on the
proposed permit action and may request a public hearing within 30 days from the date of the first
notice. Only those comments received within this period will be considered. Address comments
to the contact person listed above. Comments shall include the name, address, and telephone
number of the writer, the facility name and VPDES permit number, and a complete, concise
statement of the factual basis for the comments. Requests for a public hearing shall state the
reason why a hearing is requested, the nature of the issues proposed to be raised in the public
hearing, and a brief explanation of how the requester's interests would be directly and adversely
affected by the proposed permit action. DEQ may decide to hold a public hearing if public
response is significant.
Following the comment period, the Board will make a determination regarding the proposed
permit action. This determination will become effective unless DEQ grants a public hearing.
Due notice of any public hearing will be given.

This facility was constructed in 1959 and put into operation in 1961. The facility was originally
operated under the Virginia Health Department's outdated "LHS -120" permit program. The
facility was transferred to the DEQ in 1992 and was issued a VPDES permit in April 1995. No
CTO's were found on file at the DEQ.

32. Financial Assurance and Closure Plan Requirements: This facility does not meet the criteria
specified in q VAC 25-650-50. The regulation requires the submission of a closure plan and
financial assurance mechanism by certain privately owned treatment works. The closure plan
and accompanying funds provide for the continued provision of essential sewer service and/or
the operation of a privately owned wastewater facility in accordance with the terms and
conditions of a VPDES permit, without the expenditure of public funds, in the event a small
privately owned treatment facility is abandoned by its owner or operator or otherwise ceases to
operate. The owner of this facility is responsible for caring for elderly persons, who cannot
otherwise completely care for themselves. Abandonment of this facility by the owner will
effectively cease all wastewater flows, as the residents will require immediate relocation.

DESCRIPTION OF WASTEWATER TREATMENT SYSTEM
Franciscan Friars, T.O.R. maintains a no -discharge lagoon, which receives all of the facilities sanitary
wastewater via Outfall 001. Backwash wastewater from the facility's water treatment system is
discharged via Outfall 002 to an unnamed intermittent tributary of Opequon Creek. The water treatment
system includes ionic softening and iron removal. The sanitary wastewater system and the water
treatment system are shown below.

RECEIVING WATERS INFORMA'T'ION
Receiving Stream: The Opequon Creek, U.T. is an intermittent stream at the location of the
Franciscan Friars, T.O.R. discharge (River Mile 0.23). The U.T. is considered
intermittent until it reaches its confluence with Opequon Creek. The receiving
stream is further described in the TMDL Information Figure and the Water
Quality Assessments TMDL Review table included in this attachment.
Flow: Stream flow estimates for Opequon Creek above its confluence with the Opequon
Creek, U.T. were provided by memo from Eric Aschenbach on November 15,
2004. The Opequon Creek, U.T. was determined to be intermittent. As a result,
all of the critical flow values for this portion of the receiving stream were reported
as 0.0 cfs. Critical dry and wet season flow values for Opequon Creek are as
reported in the attached Flow Frequency Determination Memo.
pH: pH values were obtained from observations performed by DEQ WQMP on
Opequon Creek (Station ID IAOPE036.13) at river mile 36.13. The 90th
percentile annual pH was determined to be 8.5 S.U., while the 10th percentile
annual pH was 7.8 S.U.
Temperature: Ambient stream temperatures were obtained from observations performed by
DEQ WQMP on Opequon Creek (Station ID IAOPE036.13) at river mile 36.13.
The 90th percentile annual temperature was determined to be 21.9 'C and the 90th
percentile wet season (December through May) temperature was 15.7 °C.
Hardness: The average hardness value was obtained from observations performed by DEQ
WQMP on Opequon Creek (Station ID 1AOPE036.13) at river mile 36.13. The
average hardness was found to be 234 mg/L CaCO3.
Ammonia -N: Not evaluated since ammonia -N is not a parameter of concern for this discharge.
Mixing Zone
Analyses: The effluent generates the only available stream flow, resulting in a 100% mixing
condition at all critical flows.
Additional Notes: The WTP backwash effluent is considered to generate the receiving stream flow
in the Opequon Creek, U.T. As a result, the effluent characteristics will be used
for evaluating the receiving stream in this section.

This memo supersedes Paul Herman's flow frequency determination dated November 22, 1999.
The Franciscan Friars outfall 002 discharges to an unnamed tributary to Opequon Creek. At the discharge point,
the unnamed tributary is depicted as a dry ditch on the USGS Stephens City topographic quadrangle map. The
flow frequencies for dry ditches are 0.0 cfs. Stream flow frequencies for the perennial point are required for use
by the permit writer in developing effluent limitations for the VPDES permit reissuance. The perennial point is
located on Opequon Creek.
The VDEQ operated a continuous record gage on Opequon Creek near Berryville, Virginia (#01615000) from
1943-1997. The gage is located downstream of the perennial point at the Route 7 bridge in Frederick County,
Virginia. In July 1988, approximately 1000 feet upstream of the gage, the 6.0 MGD Opequon Wastewater
Reclamation Facility began discharging to Opequon Creek. Therefore, the flow frequencies for the reference
gage are based only on the period of record from 1943 to 1988. Since the Parkins Mill STP did not begin
discharging to Opequon Creek until about September 1989, its flow did not impact the gage during the selected
period of record. In addition, the flow from Parkins Mill STP (located upstream) was not added to these flow
frequencies. The flow frequencies for the gage and the perennial point are presented below. The values at the
perennial point were determined by drainage area proportions and do not address any other discharges,
withdrawals, or springs located between the gage and the perennial point.

EVALUATION OF EFFLUENT TOXIC POLLUTANTS
Toxic pollutants were evaluated in accordance with OWP Guidance Memo No. 00-2011 (8/24/00).
According to this guidance, STPs with a design flow < 0.040 MGD are treated as if there are no toxic
pollutants in their discharge unless there is actual evidence to indicate otherwise. This applies to all
toxic pollutants with the exception of Ammonia and Total Residual Chlorine, which are evaluated in
every STP discharge. Also, these smaller STPs are not required to monitor for any toxic pollutants
unless there is reason to believe that such pollutants may be present.
Acute and Chronic Waste Load Allocations (WLA., and WLA,) were analyzed according to the protocol
below using a statistical approach (STAT.exe) to determine the necessity and magnitude of limits.
Duman Health Waste Load Allocations (WLAhh) were analyzed according to the same protocol through
a simple comparison with the effluent data. If the WLAhh exceeded the effluent datum or data mean, no
limits were required. If the effluent datum or data mean exceeded the WLAhh, the WLAhh was imposed
as the limit.
• Since the discharge is to a dry ditch, all upstream (background) pollutant concentrations are assumed
to be "0".
The steps used in evaluating available effluent data from STPs with design flows < 0.040 MGD are as
follows:
A. If all data are reported as "below detection" or < the required Quantification Level (QL) (or, for
metals, in a form other than "dissolved"), then the data are not suitable for analysis and no further
monitoring is required.
B. If any data value is reported as detectable at or above the required QL, then the data are adequate to
determine whether effluent limits are needed.
B.I. If the evaluation indicates that no limits are needed, then no further monitoring is required.
B.2. If the evaluation indicates that limits are needed, then the limits and associated requirements
are specified in the draft permit.

ATTACHMENT E
EVALUATION OF POLLUTANTS
1.Outfall 001 to Facultative Lagoon
All wastewater generated at the Franciscan Friars, T.O.R., with the exception of the WTP
backwash wastewater, is conveyed to a facultative lagoon. There is no discharge from the
lagoon. The following information is carried forward from the previous two fact sheets and was
originally taken from the lagoon construction plan sheet:
1) The lagoon is round with a bottom diameter of 126 FT (12,500 FT2).
2) The lagoon berm is 7 FT above the lagoon bottom.
3) Normal design operating depth is 4 FT (diameter =150 FT; surface area = 17,500 FT 2;
volume = 60,000 FT3). At the proposed design flow (1600 GPD) the hydraulic retention
time is 280 days.
4) No liner was installed at the time of construction_
5) The lagoon is fed via a terra cotta sewer.
6) Assuming the lagoon permeability is 10-6 cm/sec, the allowable leakage rate at 4 FT
depth is 1600 GPD (See attached calculation).
In order to protect groundwater quality and prevent inadequately treated surface discharges, the
previous VPDES permit for this facility was drafted with the following conditions:
1) There will be no discharge from the lagoon except for allowable permeability through the
lagoon bottom at a rate not to exceed 10-6 cm/sec.
2) Thresholds above which an application must be submitted for permit modification to add
final discharge limits include:
a. Lagoon water depth greater than 5 FT or,
b. Monthly average influent flow is greater than 95% of 1600 GPD for three consecutive
months
3) The permittee shall maintain monthly logs on the lagoon influent flow, rainfall, and
lagoon conditions (depth, animal damage, surface condition). A copy of the monthly logs
shall be submitted by January 10th of each year with the DMR for Outfall 002.
These conditions will be carried forward in the permit at this reissuance. Final discharge limits
will be developed when the facility crosses a threshold. Until that time, the final permit limits
will be "No Discharge".

2. Outfall 002 to Opeguon Creek, U.T.
Franciscan Friars, T.O.R. Outfall 002 is considered a minor industrial resulting from the
operation of a water treatment system. As such, the applicable standard limits for water
treatment plants are required for this discharge. It should be noted that the raw water source is
from two wells and no chlorine is added during the treatment process.
I) The TSS limits (30 mg/L, 0.027 kg/D monthly average and 60 mg/L, 0.054 kg/D daily
maximum) are carried forward from the previous permit. These limits are consistent with
the standard limits for water treatment plants and the facilities TMDL wasteload
allocation for TSS.
2) The pH limits (6.5 SU minimum and 9.5 maximum) reflect the current Water Quality
Standard for pH in the receiving stream, and have been carried forward from the previous
permit.
Toxic Pollutants:
There is no new available toxics data for evaluation at this reissuance. However, specific
metals data is required for submission within one year of the permit reissuance. Water Quality
Standards (WQSs) and Waste Load Allocations (WLAs) were calculated for these parameters.
The WQSs and WLAs are presented in Attachment D. The metals data will be screened for
applicable permit limits using STAT.EXE and the calculated WLAs upon submission.

bottom at a rate not to exceed 10-6 cm/sec.
2) Thresholds above which an application must be submitted for permit modification to add final
discharge limits include:
a. Lagoon water depth greater than 5 FT or,
b. Monthly average influent flow is greater than 95% of 1600 GPD for three consecutive
months
3) The permittee shall maintain monthly logs on the lagoon influent flow, rainfall, and lagoon
conditions (depth, animal damage, surface condition). A copy of the monthly logs shall be
submitted by January 10 th of each year with the DMR for Outfall 002.

Part I.A.1. Effluent Limitations and Monitoring Requirements:

Part I.C.4. Operations and Maintenance Manual Requirement
Revises and updated Part I.B.2. of the previous permit. Added requirement to describe
procedures for handling, storage and disposal of any and all materials that will prevent
these materials from reaching state waters. Required by Code of Virginia at 62.1-
44.16; VPDES Permit Regulation, 9 VAC 25-31-190 E, and 40 CFR 122.41(e). These
require proper operation and maintenance of the permitted facility. Compliance with an
approved O&M manual ensures this.
Part I.C.S. CTO/CTC Requirement:
Revises and updates Part I.B.2. of the previous permit. Required by Code of Virginia
62.1-44.19, SCAT Regulations 9 VAC 25-790, and VPDES Permit Regulation 9 VAC
25-31-190 E for all STPs.
Part I.C.6. Sludge Reopener:
New requirement. Required by the VPDES Permit Regulation, 9 VAC 25-31-220 C 4
for all permits issued to sewage treatment plants.
Part I.C.7. SMP Requirement:
Revises and updates Part I.B5. of the previous permit. VPDES Permit Regulation 9
VAC 25-31-100 J, 220 B 2, and 420 through 720, and 40 CFR Part 503 require all
sewage treatment plants to submit information on their sludge use and disposal
practices and to meet specified standards for sludge use and disposal. Technical
requirements are derived from the Department of Health's Biosolids Use Regulations,
12 VAC 5-585-10 et seq.
Part I.C.S. Water Quality Criteria Monitoring:
New requirement. State Water Control Law at 62.1-44.21 authorizes the Board to
request information needed to determine the discharge's impact on State waters. States
are required to review data on discharges to identify actual or potential toxicity
problems, or the attainment of water quality goals, according to 40 CFR Part 131,
Water Quality Standards, subpart 131.11. To ensure that water quality criteria are
maintained, the permittee is required to analyze the facility's effluent for the substances
noted in Attachment A of this VPDES permit.
Part I. C.9. Treatment Works Closure Plan:
New requirement. Requirement for all sewage treatment facilities, per State Water
Control Law at 62.1-44.19. This condition is used to notify the owner of the need for a
closure plan where a treatment works is being replaced or is expected to close.
Part I.C.10. Notification Levels:
Revises and updates Part LB.3 of the previous permit. Required by the VPDES Permit
Regulation 9 VAC 25-31-200 A for all manufacturing, commercial, mining, and
silvicultural dischargers.
Part 11 Replaces Part II of the previous permit with several revisions. VPDES Permit
Regulation, 9 VAC 25-31-190 requires all VPDES permits to contain or specifically
cite the conditions listed.

Dear Ken,
I am forwarding this email as a summary of our resent discussion on the subject of a
water system to serve the future CDA Spirituality Center proposed on your organizations
property in Fredrick County.
If the system serves "at least 25 persons per day for at least 60 days out of the year" it
becomes a public waterworks and must have an Operations Permit issued by our Office.
You stated that the CDA Spirituality Center will not meet these minimum criteria.
Assuming you do not serve "at least 25 persons per day for at least 60 days out of the
year" you would not have to summit plans to our office for the construction and you
would not be required to have a waterworks permit. In the eyes of the regulations you
would be a private system regulated similar to a private home and your well site would be
approved by the Local Health Department.
I would make the following suggestions.
I would be glad to meet with you and approve any well sites which you may be
planning to develop. Then I suggest you develop the sites to the standards
required for pubic water systems so that if the system ever expands to fit the
public definition the wells will already be in the system.
I can give you a list of water quality development samples required of public
systems. For safety and liability purposes I would suggest you run these samples
although they are not required.
After the system is in operation I suggest you take quarterly bacterlogical samples
again for safety and liability purposes, although they are not required.
If you have any food services in the future a permit for that operation will have to
be obtained from Local Health Department. If a food permit is required they will
work with you to set up a bacterlogical sampling program.

SPIRITUALITY CENTER
Catholic Diocese of Arlington
The Catholic Diocese of Arlington proposes to use the former Franciscan
Monastery in White Post, Virginia as the Diocese's new Spirituality Center — a facility
for reflection, worship, retreats, and diocesan meetings. The Spirituality Center will be
used by priests, parishioners, diaconate aspirants, youth ministry, and other ministries.
These uses will be for small retreats, some that may be for several nights; and for larger
groups for daytime use. There will be no use by corporate or business groups — use will
be restricted to use by religious individuals and groups. Except for resident staff (not to
exceed 5) there will be no occupancy exceeding 30 days, with the typical occupancy not
exceeding one week and in most cases only a few days. A possible schedule of such use
is attached as Exhibit A.
The existing facilities are sited on a 150 acre site located at 125 Old Kitchen Road
and includes a chapel with approximately 90 seats, a cafeteria, meeting rooms, library,
sleeping rooms, administrative spaces, and supporting areas. The monastery opened in
1960 as a training facility for young priests with the Province of the Sacred Heart of
Jesus, T.O.R. In 1972 it became home to the Franciscan Center for Spiritual Renewal, a
part time retreat center, and in 1991 a residence and care center for elderly friars.
The proposed use will be limited by the availability of water and sewer. The
water plant and the sewage treatment facility is operating under a VPDES Permit that
requires monitoring the water plant backwash discharge and sets a zero limit discharge
for the sewage lagoon. The Permit estimated discharge to the sewage lagoon at an
average rate of 1,600 GPD and effectively sets the limit on use of the Property. The
operation of the water plant and the sewage facility will be strictly monitored by the
facility manager to ensure the discharge limits are not exceeded. Scheduled events may
be cancelled if the discharge limits are in danger of being exceeded.
The CDA Spirituality Center will operate year round (subject to the above
discussed limits). The existing kitchen will be refurbished to provide for "lite" meals and
for small groups with many events and large groups served by caterers. Some daytime
groups may be provided with "box" lunches.
The proposed schedule of available facilities is attached as Exhibit A. While we
project as many as 160 people in the facility at any one time, these events are not
expected to last longer than about 7 hours, with most being of shorter duration. Note that
weather permitting, we expect some individuals and small groups to experience the
outdoors. The outdoor activities will be allowed to develop at a natural pace as the
interest is such activities develops. We propose to start with broadly defined trails that we
have called a Nature Trail and a Reflection Trail. We do not propose any structures on or
along these trails. Some individuals may carry a portable stool or chair if they wish to
stop along the way for reflection. The trails will be pervious materials with small (and
low) markers. As these trails are become more used, low benches may be added.
We propose to make limited renovations to some areas of the existing facilities.
We propose to provide fire sprinklers in all sleeping rooms and meeting rooms along with
a smoke detector and alarm system through out. Maintenance and repairs will be
accomplished where needed.
In the future. say 10 —15 years we anticipate a more complete renovation and
possible expansion of the facilities. The availability of public water and sanitary sewer
would accelerate the possible expansion. The "experienced" use of the Spirituality Center
will also have a large input to any plans for expansion.

Water Control Law aggrieved by any action of the State Water Control Board taken without a
formal hearing, or by inaction of the Board, may demand in writing a formal hearing of such

demonstrate compliance with the financial assurance requirements within six months of the date
of the change of ownership of the facility. Upon demonstration to the Board by the new owner of
compliance with the financial assurance requirements, the Board shall notify the old owner that he
or she no longer needs to comply with the financial assurance requirements as of the date of
demonstration.

We are in the process of bringing facilities which were
previously under the preview of the Health Department into
compliance with current standards. Facilities such as yours were
previously authorized to operate under the Health Department's old
"LHS -120" permit program. That program became obsolete in the
1970s with the inception of EPA's NPDES permit program, which is
managed by this Department. The Sacred Heart Monastery was
recently referred to us by the County Health Department for not
having approved sewage treatment facilities.
In August 1.992, you notified us that you have a sewage
treatment lagoon which does not discharge. in this area of the
state, yearly rainfall is approximately equal to total yearly
evaporation. Consequently, if your lagoon does not discharge, it
must be leaking at approximately the same rate as wastewater is
generated. Although some water loss through percolation is
expected and acceptable, excessive leakage can contaminate the
groundwater.
If you wish to continue operating a sewage treatment facility,
you will need to apply for a VPDES permit, which carries the
following requirements:
1. A permit fee of $1,400 - $2,000 every five years
(depending on the size of your facility),

associated expense and opportunity for public comment,

3. Monthly reporting requirements, and
4. Sewage treatment system upgrades as necessary.
Other options which may be available to you include:
1. Conveying your wastewaters to a county sewer for regional
treatment. This would also entail proper closure of your
lagoon. Contact the Frederick County Sanitation
Authority (phone: 665-5690) for additional information on
this option.
2. Re-evaluating the soils on your property (or neighboring
properties if easements are possible) to determine
whether a drainfield may be installed. Contact the
County Health Department (phone: 722-3480) for additional
information on this option.
Please advise me of your plans for obtaining approvable sewage
treatment/disposal facilities.

2. Monitoring results shall be reported on a Discharge Monitoring Report (DMR) or on forms
provided, approved or specified by the Department.
3. If the permittee monitors any pollutant specitically addressed by this permit more frequently than
required by this permit using test procedures approved under Title 40 of the Code of Federal
-_ _Regulations Part_ 136 or using -other test procedures approved by the U.S. Environmental

Protection Agency or using procedures specified in this permit, the results of this monitoring
shall be included in the calculation and reporting of the data submitted in the DMR or reporting
form specified by the Department.
4. Calculations for all limitations which require averaging of measurements shall utilize an
arithmetic mean unless otherwise specified in this permit.
D. Duty to Provide Information
The permittee shall furnish to the Department, within a reasonable time, any information which the
Board may request to determine whether cause exists for modifying, revoking and reissuing, or
terminating this permit or to determine compliance with this permit. The Board may require the
permittee to furnish, upon request, such plans, specifications, and other pertinent information as may
be necessary to determine the effect of the wastes from his discharge on the quality of State waters,
or such other information as may be necessary to accomplish the purposes of the State Water Control
Law. The permittee shall also famish to the Department upon request, copies of records required to
be kept by this permit.
E. Compliance Schedule Reports
Reports of compliance or noncompliance with, or any progress reports on, interim and final
requirements contained in any compliance schedule of this permit shall be submitted no later than 14
days following each schedule date.
F. Unauthorized Discharges
Except in compliance with this permit, or another permit issued by the Board, it shall be unlawful for
any person to:
Discharge into State waters sewage, industrial wastes, other wastes, or any noxious or deleterious
substances; or
2. Otherwise alter the physical, chemical or biological properties of such State waters and make
them detrimental to the public health, or to animal or aquatic life, or to the use of such waters for
domestic or industrial consumption, or for recreation, or for other uses.
G. Reports of Unauthorized Discharges
Any permittee who discharges or causes or allows a discharge of sewage, industrial waste, other
wastes or any noxious or deleterious substance into or upon State waters in violation of Part II.F.; or
who discharges or causes or allows a discharge that may reasonably be expected to enter State waters

B. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS - ADDITIONAL
INSTRUCTIONS
Quantification Levels (QLs) shall be less than or equal to the following concentrations:

2. Compliance Reporting Under Part I.A.
a. Monthly Average -- Compliance with the monthly average limitations and/or
reporting requirements for the parameters listed in Part I.B.1. above shall be
determined as follows: All data below the test method quantification level (QL)
shall be treated as zeros. All data equal to or above the method QL shall be
treated as reported. Arithmetic concentration and/or loading averages (as
applicable) shall be calculated using all reported data for the month, including the
defined zeros. These averages shall be reported on the Discharge Monitoring
Report (DMR). If all data are less than the method QL, then "<Q -L" shall be
reported on the DMR for the concentration and/or loading values. Otherwise the
average values shall be reported as calculated.
b. Daily Maximum -- Compliance with the daily maximum limitations and/or
reporting requirements for the parameters listed in Part I.B.1. above shall be
determined as follows: The highest single value of data that is equal to or above
the test method QL shall be reported on the DMR and used to calculate the
loading value reported on the DMR (if applicable). If all data are less than the
method QL, then "<QL" shall be reported on the DMR for the concentration
and/or loading values.
C. Any single datum required shall be reported as "<QL" if it is less than the test
method QL. Otherwise, the numerical value shall be reported.
d. Monitoring results reported on the Discharge Monitoring Report (DMR) shall be
reported to the accuracy of the test, which must be capable of at least the same
number of significant digits as the permit limit for the given parameter. Rounding
the results to the number of significant digits in the permit, where the test method
is sensitive enough to report more, is not acceptable. If there is not a method
allowed by the permit that is accurate enough to measure two significant digits
below the value of 1.0, it shall be the permittee's responsibility to provide
documentation for DEQ approval demonstrating that only one significant figure
can accurately be reported.

2. A written report shall be submitted within 5 days and shall contain:
a. A description of the noncompliance and its cause;
b. The period of noncompliance, including exact dates and times, and if the noncompliance has
n been corrected, -the -anticipated time -it is -expected -to continue; --and__
c. Steps taken or planned to reduce, eliminate, and prevent reoccurrence of the noncompliance.
The Board may waive the written report on a case-by-case basis for reports of noncompliance
under Part H.I. if the oral report has been received within 24 hours and no adverse impact on
State waters has been reported.
3. The permittee shall report all instances of noncompliance not reported under Parts H.I.l . or 2., in
writing, at the time the next monitoring reports are submitted. The reports shall contain the
information listed in Part II.I.2.
NOTE: The immediate (within 24 hours) reports required in Parts II.G, H, and I may be made to
the Department's Valley Regional Office at (540) 574-7800 (voice) or (540) 574-7878 (fax). For
reports outside normal working hours, leave a message and this shall fulfill the immediate reporting
requirement. For emergencies, the Virginia Department of Emergency Services maintains a 24-
hour telephone service at 1-800-468-8892.
Notice of Planned Changes
1. The permittee shall give notice to the Department as soon as possible of any planned physical
alterations or additions to the permitted facility. Notice is required only when:
a. The permittee plans alteration or addition to any building, structure, facility, or installation
from which there is or may be a discharge of pollutants, the construction of which
commenced:
(1) After promulgation of standards of performance under Section 306 of the Clean Water
Act which are applicable to such source; or
(2) After proposal of standards of performance in accordance with Section 306 of the Clean
Water Act which are applicable to such source, but only if the standards are promulgated
in accordance with Section 306 within 120 days of their proposal;
b. The alteration or addition could significantly change the nature or increase the quantity of
pollutants discharged. This notification applies to pollutants which are subject neither to
effluent limitations nor to notification requirements specified elsewhere in this permit; or
c. The alteration or addition results in a significant change in the permittee's sludge use or
disposal practices, and such alteration, addition, or change may justify the application of
permit conditions that are different from or absent in the existing permit, including

4. Operations and Maintenance (O&M) Manual Requirement -- The permittee shall
maintain a current and approved O&M Manual for the treatment works. This manual
shall detail the practices and procedures which will be followed to ensure compliance
with the requirements of this permit. This manual shall include, but not necessarily be
limited to, the following items:
a. Treatment works design, treatment works operation, routine preventative
maintenance of units within the treatment system, critical spare parts inventory and
record keeping;
b. Techniques to be employed in the collection, preservation and analysis of effluent
samples;
C. Procedures for handling, storing, and disposing of all wastes, fluids, and pollutants
characterized in Part I.C.3 that will prevent these materials from reaching state
waters.
The permittee shall operate the treatment works in accordance with the approved O&M
Manual. Any changes in the practices and procedures followed by the permittee shall be
documented and submitted for staff approval within 90 days of the effective date of the
changes. Upon approval of the submitted manual changes, the revised manual becomes
an enforceable part of the permit.
5. CTC / CTO Requirement -- The permittee shall, in accordance with the DEQ Sewage
Collection and Treatment Regulation (9 VAC 25-790), obtain a Certificate to Construct
(CTC) and a Certificate to Operate (CTO) prior to constructing and operating the
wastewater treatment works. Noncompliance with the CTC or CTO shall be deemed a
violation of the permit.
6. Sludge Reopener -- This permit may be modified or, alternatively, revoked and reissued
if any applicable standard for sewage sludge use or disposal promulgated under Section
405(d) of the Clean Water Act is more stringent than any requirements for sludge use or
disposal in this permit, or controls a pollutant or practice not limited in this permit.
7. SMP Requirement -- The permittee shall conduct all sewage sludge use or disposal
activities in accordance with the Sludge Management Plan (SMP) approved with the
issuance of this permit. Any proposed changes in the sewage sludge use or disposal
practices or procedures followed by the permittee shall be documented and submitted for
DEQ approval 90 days prior to the effective date of the changes. Upon approval, the
SMP becomes an enforceable part of the permit. This permit may be modified or,
alternatively, revoked and reissued to incorporate limitations/conditions necessitated by
substantive changes in sewage sludge use or disposal practices.

3. Changes to authorization. If an authorization under Part II.K.2. is no longer accurate because a
different individual or position has responsibility for the overall operation of the facility, a new
authorization satisfying the requirements of Part ILK.2. shall be submitted to the Department
prior to or together with any reports, or information to be signed by an authorized representative.
4. Certification. - Any -person signing a -document -under Parts-11.K.1--ar 2. shall make the following__
certification: "I certify under penalty of law that this document and all attachments were
prepared under my direction or supervision in accordance with a system designed to assure that
qualified personnel properly gather and evaluate the information submitted. Based on my inquiry
of the person or persons who manage the system, or those persons directly responsible for
gathering the information, the information submitted is, to the best of my knowledge and belief,
true, accurate, and complete. I am aware that there are significant penalties for submitting false
information, including the possibility of fine and imprisonment for knowing violations."
L. Duty to Comply
The permittee shall comply with all conditions of this permit. Any permit noncompliance constitutes
a violation of the State Water Control Law and the Clean Water Act, except that noncompliance with
certain provisions of this permit may constitute a violation of the State Water Control Law but not
the Clean Water Act. Permit noncompliance is grounds for enforcement action; for permit
termination, revocation and reissuance, or modification; or denial of a permit renewal application.
The permittee shall comply with effluent standards or prohibitions established under Section 307(a)
of the Clean Water Act for toxic pollutants and with standards for sewage sludge use or disposal
established under Section 405(d) of the Clean Water Act within the time provided in the regulations
that establish these standards or prohibitions or standards for sewage sludge use or disposal, even if
this permit has not yet been modified to incorporate the requirement.
M. Duty to Reapply
If the permittee wishes to continue an activity regulated by this permit after the expiration date of this
permit, the permittee shall apply for and obtain a new permit. All permittees with a currently
effective permit shall submit a new application at least 180 days before the expiration date of the
existing permit, unless permission for a later date has been granted by the Board. The Board shall
not grant permission for applications to be submitted later than the expiration date cf the existing
permit.
N. Effect of a Permit
This permit does not convey any property rights in either real or personal property or any exclusive
privileges, nor does it authorize any injury to private property or invasion of personal rights, or any
infringement of Federal, State or local law or regulations.
O. State Law
Nothing in this permit shall be construed to preclude the institution of any legal action under, or
relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any
other State law or regulation or under authority preserved by Section 510 of the Clean Water Act.

b. That any activity has occurred or will occur which would result in any discharge,
on a non -routine or infrequent basis, of a toxic pollutant which is not limited in
this permit, if that discharge will exceed the highest of the following notification
levels:
(1) 500 µg/L;
(2) 1 mg/L for antimony;
(3) Ten times the maximum concentration value reported for that pollutant in
the permit application; or
(4) The level established by the Board.

2. Notice
a. Anticipated bypass. If the permittee knows in advance of the need for a bypass, prior notice
shall be submitted, if possible at least ten days before the date of the bypass.
—Unanticipated -bypass. The -permittee -shall submit notice -of an unanticipated bypass_as _
required in Part II.I.
3. Prohibition of bypass
a. Bypass is prohibited, and the Board may take enforcement action against a permittee for
bypass, unless:
(1) Bypass was unavoidable to prevent loss of life, personal injury, or severe property
damage;
(2) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment
facilities, retention of untreated wastes, or maintenance during normal periods of
equipment downtime. This condition is not satisfied if adequate back-up equipment
should have been installed in the exercise of reasonable engineering judgment to prevent
a bypass which occurred during normal periods of equipment downtime or preventive
maintenance; and
(3) The permittee submitted notices as required under Part II.U.2.
b. The Board may approve an anticipated bypass, after considering its adverse effects, if the
Board determines that it will meet the three conditions listed above in Part II.U.3.a.
V. Upset
An upset constitutes an affirmative defense to an action brought for noncompliance with
technology based permit effluent limitations if the requirements of Part II.V.2. are met. A
determination made during administrative review of claims that noncompliance was caused by
upset, and before an action for noncompliance, is not a final administrative action subject to
judicial review.
2. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through
properly signed, contemporaneous operating logs, or other relevant evidence that:
a. An upset occurred and that the permittee can identify the cause(s) of the upset;
b. The permitted facility was at the time being properly operated;
c. The permittee submitted notice of the upset as required in Part II.I.; and
d. The permittee complied with any remedial measures required under Part U.S.

(1)' Quantification level (QL) is defined as the lowest concentration used for the calibration of a measurement system when the
calibration is in accordance with the procedures published for the required method.
Units for the quantification level are micrograms/liter unless otherwise specified.
Quality control and quality assurance information shall be submitted to document that the required quantification level has
been attained.
(2) Sample Type
G = Grab = An individual sample collected in less than 15 minutes. Substances specified with "grab" sample type shall only
be collected -as -grabs. The -permittee -nay -analyze multiple grabs and -report -the -average results provided thatthe individual
grab results are also reported. For grab metals samples, the individual samples shall be filtered and preserved immediately
upon collection.
(3) Frequency: 1/5 YR = once within one year from the permit's effective date.
(4) A specific analytical method is not specified. An appropriate method shall be selected from the following list of EPA methods
(or any approved method presented in 40 CFR Part 136). If the test result is less than the method QL, a "<[QL]" shall be
reported where the actual analytical test QL is substituted for [QL].

c. The Board does not notify the existing permittee and the proposed new permittee of its intent
to modify or revoke and reissue the permit. If this notice is not received, the transfer is
effective on the date specified in the agreement mentioned in Part II.Y.2.b.
Z. Severability
The provisions of this permit are severable, and if any provision of this permit or the application of
any provision of this permit to any circumstance, is held invalid, the application of such provision to
other circumstances, and the remainder of this permit, shall not be affected thereby.
