Re: Conditional Use Permit 01-08 of David Plank
Dear Dr. and Mrs. Lloyd:
This letter is in response to your letter dated April 23, 2008 to Supervisor Gary Lofton.
The above referenced Conditional Use Permit has been withdrawn by Mr. Plank;
therefore, this application will not be heard at the May 14, 2008 Board of Supervisors
meeting.
I hope this information will ease your concerns.

Mr. Cheran.
First please allow me to thank you for putting our case to the Planning Commission.
Second, it is clear from the vote of the commission that my neighbors were able to vilify my dogs and highlight their
concerns, real or perceived, to the point that Commission felt unable as a group to allow my application to go
forward to the Supervisors with a recommendation to accept. I feel I let my dogs down as they are not dangerous at
all and have no interest in going over the fence. Regardless it is clear that Duck Run Lane can no longer be regarded
as a suitable place for us to raise our dogs.
Accordingly I would ask you to withdraw our application for a CUP and be assured that we will not engage in a
business on the property. We will begin immediately to find a different venue and will place 244 Duck Run Lane
for sale as early as Wednesday of this week.
While I expected a certain amount of theatre and exaggeration from my neighbors about this situation I am disturbed
by the implicit and explicit comparisons to Michael Vick. It would seem that as these comparisons occurred at a
public hearing they might well be considered slanderous and actionable. For that reason l would ask that I be
provided with a transcript of that portion of the meeting pertinent to my concern.
One last question, do I inform my neighbors of the decision to withdraw and relocate or would your office do that?
In closing it is my hope that no Planning Commission members, or indeed my neighbors, ever find themselves lost
in any part of Virginia requiring a search to be conducted. If so the Virginia Search and Rescue Dog Association is
the group that would likely be called to conduct the search. Our kennel has supplied four of the dogs in that
organization. What an irony if one of my dogs found the missing person!
Thank you again for the work you put into considering my application. I will return the sign on Wednesday when I
return to Virginia from South Carolina where I have been visiting with my daughter who recently delivered,
prematurely, two beautiful baby boys. Puts everything into perspective does it not!
