Box 2400 Winchester, Virginia 22604 (540) 869-1111 Shenandoah Gas is requesting authorization to modify its existing 120' monopole tower. ID We need to raise the tower to 180' for the following reasons. Over the years we have expanded our natural gas service area and we are forecasting continued growth in this region. With this expanding service area we must be able to control and monitor the flow of natural gas through the vast pipeline system. We must be able to effectively and efficiently dispatch personnel to service the pipeline. To continue providing a safe and reliable product to its customers, Washington Gas/Shenandoah Gas is installing a digital voice and data system that will provide communication coverage of its current and projected service area for the next 15+ years. In the system design, we need to add a link to our current communication network. In order to complete this link, we must add a microwave dish at 120' to the tower at our Blue Mountain site. This site also connects to our Winchester site. The new Blue Mountain dish must be at 120' to clear obstructions to the Columbia Gas tower. This additional dish will result in three dishes at the top of the Blue Mountain tower. This tower can not support this additional loading and it is at its maximum height. To overcome this issue, we must raise the Winchester tower to 18O' which will allow us to lower the dish linking Winchester and Blue Mountain to 80'. This will enable the project to move forward and expand our private voice and data communications over our complete Shenandoah service area. Thank you for your cooperation on this request. However, if marking and/or lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in accordance with FAA Advisory circular 70/7460-1 K Change 2. Any height exceeding 195 feet above ground level (941 feet above mean sea level), will result in a substantial adverse effect and would warrant a Determination of Hazard to Air Navigation. This determination expires on 02/06/2010 unless: (a) extended, revised or terminated by the issuing office. (b) the construction is subject to the licensing authority of the Federal Communications Commission. (FCC) and an application for a construction permit has been filed, as required by the FCC, within 6 months of the date of this determination. In such case, the determination expires on the date prescribed by the FCC for completion of construction, or the date the FCC denies the application. NOTE: REQUEST FOR EXTENSION OF THE EFFECTIVE PERIOD OF THIS DETERMINATION MUST BE POSTMARKED OR DELIVERED TO THIS OFFICE AT LEAST 15 DAYS PRIOR TO THE EXPIRATION DATE. The subject property is located in a rural, residential and commercial area of Winchester, Virginia. The subject property is occupied by an existing 120 -foot monopole tower and equipment shed. The site is provided access from the asphalt paved parking lot and drive affiliated with the adjacent Washington Gas facility. The existing tower is proposed to be increased to a height of 180 -feet. A Cell Tower Review Form and Collocation ("CO") Submission Packet, FCC Form 62I has been submitted to the Virginia Department of Historic Resources (VDHR). Copies of the forms are included as attachments. ECS has received the final response from the VDHR indicating that the proposed tower extension will have no adverse effect on historic properties in the vicinity of the site. ECS also received final responses from the Catawba Indian Nation, the Cherokee Nation and the Shawnee Tribe indicating that no known historic properties, cultural or sacred sites will be affected. ECS did not receive a response from the Winchester -Frederick County Historical Society. They were given more than 30 -days to provide comment, therefore, it is understood that they do not wish to provide a comment on this proposed tower extension. The Shawnee Tribe's archives do not reveal any issues of concern at this tower location, In the event that archaeological materials are encountered later during construction, use, or maintenance of this tower location, please re -notify us at that time as we would like to resume consultation under such a circumstance, The Shawnee Tribe's Environmental and Natural Resources Dep trent takes this opportunity to express its concerns that telecommunication towers can have a potentially destructive impact an bats and migratory birds, particularly those that migrate at night, including species listed as threatened and endangered by both states and the federal government, as well as other species. The Shawnee Tribe suggests that this tower be constructed in accordance with the guidelines available from the US Fish and Wildlife Service to reduce the adverse effects of telecommunications towers on migratory birds; these guidelines may be found at: www.fws.gov/rnigratorybirds/issues/towers/comtow.ntmi. The Shawnee Tribe's Environmental and Natural Resources Department is further concerned that the proliferation of cell towers may play a role in honey bee Colony Collapse Disorder, We acknowledge that cell phone technology may not be to blame, as other potential causative factors for the decline have been noted, such as insecticides, tracheal and varron mites [an immunosuppressant), other parasites, pesticides used on hives to eliminate parasites, genetically modified plants, Nosema fungus, Israeli Acute Paralysis Viris (IAPV) perhaps introduced from Australia in 2004, Kashmir Bee Virus [K5V], climate change, and drought. While one or a constellation of these factors may be causative, it is undeniable that the evidence suggests as much of a behavioral as a pathogenic origin for Colony Collapse Disorder. On March 29", 2007, Diana Cox -Foster, Pennsylvania State University, testified about Colony Collapse Disorder before the House Subcommittee on Horticulture and Organic Agriculture. According to May Berenbaum, a member of Cox -Foster's working team and an insect ecologist at the University of Illinois (Urbana-Champaign),"The main hypotheses are based on the interpretation that the disappearances represent disruptions in orientation behavior and navigation". One study at the Koblenz - Landau University, Germany, may suggest that electromagnetic emissions from cell phones could possibly cause such a disruption in the navigation systems of bees, preventing them from being able to return to their hives. This study is by no means conclusive. However, Departmental staff will continue to assess the potential role in Colony Collapse; Disorder of such electromagnetic emissions and would strongly urge the cell tower industry to do the same. Finally, the Shawnee Tribe's Environmental and Natural Resources Department requests that cell tower sites, whenever remotely feasible, be restored to native vegetation, In all cases, habitat restoration can protect a variety of species, even in small project areas. The large number of cell tower sites provides an as yet unrealized opportunity for region -wide habitat restoration, The Tribe urges the cell phone industry to provide a model For native habitat restoration for other industries.
