The action area, which includes all areas of proposed disturbance, is located at 2835 Front Royal Pike in Winchester, Virginia. The proposed action area will consist of a 50 -foot by 50 -foot lease area containing a 30 -foot by 30 -foot fenced compound, a 12 -foot wide by approximately 200 -foot long access driveway, an overhead utility easement, a 100 -foot tall (104 -foot with all appurtenances) monopole telecommunications tower, a 10 -foot by 16 -foot concrete equipment pad, and associated electrical equipment_ The action area currently consists of maintained grass. According to the National Park Service GIS Database', the National Wild and Scenic Rivers Systeme, the United States Forest Service3, the US Department of the Interior Bureau of Land Management4, the Virginia Department of Game and Inland Fisheries 5, the Virginia Department of Forestryb, and the Virginia Department of Conservation and Recreation no officially designated forests, parks, grasslands, wild and scenic rivers, scenic trails, or other wilderness areas are located at or in the immediate vicinity of the action area. 2. Is the antenna structure located in an officially designated wildlife preserve? According to the US Fish and Wildlife Service (USFWS)' and the Virginia Department of Game and Inland Fisheriese, no officially designated wildlife preserves are located at or in the immediate vicinity of the action area. 3. Will the antenna structure likely affect threatened or endangered species or designated critical habitats? (Ref. 50 CFR Part 402) To ensure that the activities proposed at the action area do not adversely effect threatened and endangered species, an Environmental Review request was submitted to the Virginia Department of Conservation and Recreation (VDCR) on October 20, 2009. In a letter dated November 17, 2009, the VDCR stated the current activity would not affect any documented state -listed plants or insects. The VDCR files also do not indicate the presence of any State Natural Area Preserves under VDCR's jurisdiction in the project vicinity. Under a Memorandum of Agreement established between the Virginia Department of Agriculture and Consumer Services (VDACS) and the VDCR, the VDCR represents VDACS in comments regarding potential impacts on state - listed threatened and endangered plant and insect species. Based on data reviewed, action area reconnaissance, and correspondence with VDCR (attached), this project will not significantly affect listed or proposed species. Will the antenna structure affect districts, sites, buildings, structures, or objects significant in American history, architecture, archeology, engineering, or culture that are listed, or potentially eligible for listing in the National Register of Historic Places (NRNP)? (Ref. 36 CFR Part 800 regulations implementing Section 106 of the National Historic Preservation Act) As part of the environmental review process for this project, a literature and records review was conducted to determine whether National Register listed or eligible historic structures or archaeological sites were located within the presumed area of potential effect (APE) for Visual effects—in this case, within a 1/2 -mile of the undertaking. Files researched in the literature and records review included the NRHP database, the National Historic Landmarks Database, the architectural and archaeological eligibility files for Winchester, USGS quadrangle maps maintained by the Commonwealth of Virginia Department of Historic Resources. This review revealed that there are no NRHP listed or eligible archaeological resources or historic structures located within a half -mile of the undertaking. Shentel 09L2020 FCC NEPA Summary Report January 15, 2010 (North Armel Site) However, located within the 1/2 -mile radius of the proposed site are five previously surveyed resources; the Faulkner House (034-0436), the Route 522 House (near Armel) (034-0439), Route 522 House (034-0440. the Spicer House (034-0441), and the Armel-Ferrenz House (034-1204). The Faulkner House was constructed circa 1900 and is associated with a garage and a barn. The single family house was found to have exposed rafter ends and was missing one chimney. The board and batten barn and associated stables was rebuilt in 1982. The garage consisted of a small tractor shed. The Route 522 House (near Armel) (034-0439), the Route 522 House (034-0440), and the Spicer House (034-0441) have all been razed and are no longer present. The Armel-Ferrenz House (034-1204) is associated with a pump house. The single dwelling (the Armel-Ferrenz House) was constructed circa 1870 and has been highly altered. This house has a gable roof with wood frame windows and a one-story porch. It also possesses a 19th century vernacular hall and parlor. The pump house is constructed of concrete block. Based on the field assessment, none of the above surveyed resources appear to be eligible for the National Register, therefore it is our opinion that the proposed undertaking will have no visual effects on historical properties. The physical attributes of the landform, namely its location relative to water and the lack of previously recorded proximal archaeological sites at similar landforms, suggest that the site has a low probability as a potential location for prehistoric occupation or utilization. A shovel test pit was excavated within the limits of the proposed telecommunications facility to allow for an analysis of soil stratigraphy. This stratigraphy appeared to be intact but previously subjected to erosion resulting in a very shallow A horizon. Based on the results of the soil analysis, the shallow soil deposits, the aforementioned lack of proximal archaeological sites and the limited nature of the undertaking, disturbance of any intact subsurface archaeological deposits in the APE for Direct Effects is also unlikely. Additional archaeological survey is not recommended. A request for a Section 106 Review of this project was sent to the Virginia Department of Historic Resources on October 20, 2009 requesting their concurrence with the "no effect" recommendation (attached). In correspondence dated November 18, 2009, the SHPO concurred with the finding that no historic properties would be affected (attached). In addition, the City of Winchester and the Winchester -Frederick Historical Society were identified as consulting parties under Section 106 and a letter was sent to initiate consultation and invite comment (attached). To date, no comments have been received. In addition, a legal notice was published in the Winchester Star describing the proposed undertaking and allowing a 30 -day comment period open to the public (attached). The comment period ended on November 15, 2009. 5. Will the antenna structure affect Indian religious site(s)? Tribal consultation was initiated through the FCC's electronic Tower Construction Notification System (TCNS)' on September 29, 2009 and was assigned TCNS number 56400. In keeping with the Voluntary Best Practices Agreement of 2004, the Shawnee Tribe, the Tuscarora Nation, the Catawba Cultural Preservation Project, Eastern Shanwee Tribe of Oklahoma, and the Cherokee Nation of Oklahoma were notified in writing and invited to enter into consultation on October 30, 2009 (attached). In correspondence dated November 17, 2009, the Eastern Shawnee Tribe of Oklahoma stated that they are aware of a historic Shawnee Village within Frederick County, VA. Additionally, this organization acknowledges that the Virginia Department of Historic Resources determined that no previous recorded archaeological sites are within %4 -mile of the proposed undertaking. However, Shentel 09L2020 FCC NEPA Sununary Report January 15, 2010 (North Armel Site) the Eastern Shawnee Tribe of Oklahoma stated that they wish to be contacted if any archaeological resources are uncovered during the construction phase of this project. In an email dated November 24, 2009, the Cherokee Nation of Oklahoma stated that they have no knowledge of any sacred, historical, or cultural sites within the affected area. In correspondence dated October 2, 2009, the Tuscarora Nation stated that if no response is received from the Tuscarora Nation within 30 days, the Tuscarora Nation has no interest in participating in pre -construction review for the action area. As of January 8, 2010, no response has been received. In correspondence dated November 13, 2009, the Catawaba Cultural Preservation Project responded that they have no immediate concerns with the proposed project. However, they wish to be notified if any Native American artifacts or funerary objects are located during the ground disturbance. In a letter dated November 5, 2009, the Shawnee Tribe stated their archives do not reveal any issues with the proposed undertaking. With these responses, the Tribal Consultation process is deemed complete. A Tribal Consultation Summary Chart is included in Part IV. 6. Will the antenna structure be located in a floodplain? (Ref. Executive Order 11988 and 40 CFR Part 6, Appendix A) According to the Federal Emergency Management Agency , the proposed action area is not located within the 100 -year floodplain. A Federal Insurance Rate Map has been attached to serve as supporting documentation. 7. Will construction of the antenna structure involve significant change in surface features (e.g. wetlands, deforestation, or water diversion)? (Ref. Executive Order 11990 and 40 CFR Part 6, Appendix A) According to the USFWS's National Wetlands Inventory (NWI)' mapping (attached), no inventoried wetlands are shown within the xtion area. State level wetland mapping was not available for Frederick County, Virginia. The Natural Resource Conservation Service's Web Soil Survey' indicates that mapped hydric soils do not exist at or in the immediate vicinity of the proposed project location. Additionally, on-site assessment of the action area confirmed that hydric soils, hydrophytic vegetation and hydrologic characteristics conducive to the formation of wetlands were not present within the action area. Topographically, the action area is gently sloping to the west and is situated at an approximate elevation of 700 feet above mean sea level. Locally, ground water in the action area vicinity is expected to mimic the surrounding topography and flow to the northeast towards an unnamed tributary of Opequon Creek, which is approximately 1,800 feet away. The action area is located in the Blue Ridge Physiographic Province of Virginia, which is characterized by rugged regions with steep slopes, narrow ridges, broad mountains, and high relief. Within this province, elevations have been documented to range between 1500-4200 feet above mean sea level. According to the United States Department of Agriculture (USDA) Natural Resources Conservation Service's (NRCS) Web Soil Survey, soils mantling the action area have been classified as Berks channery silt loam (113) with 2 to 7 percent slopes. The Berks series is documented as deep, well -drained soil formed of Residuum derived from acid shale and found on hillsides. The surface layer of these soils is documented to be channery silt loam to approximately 8 inches, followed by very channery silt loam to approximately 22 inches, and extremely channery silt loam to 39 inches. Based upon the nature of the undertaking, it is also believed that the a;tion area will be subject only to the effects of the direct impacts necessary to construct and maintain the proposed project. Indirect impacts such as runoff, noise, aesthetics, and fugitive dust are temporary in nature, and should only be realized during and shortly after construction. A review of the National Register of Historic Places (NRNP) database and the Virginia State Historic Preservation Office (SHPO) survey files revealed that there are no historic properties within the Area of Potential Effect (APE). Therefore, it is our opinion that the proposed undertaking will have no effect upon historic properties. A Section 106 Report detailing this finding is attached. The proposed site will consist of a 50 -foot by 50 -foot lease area containing a 30 -foot by 30 -foot fenced compound and a 12 -foot wide by approximately 200 -foot long access driveway. The fenced compound is to include a 100 -foot tall (104 -foot tall with all appurtenances), a 10 - by 16 -foot concrete equipment pad, and associated electrical equipment. In addition, a proposed utility routing will be along the north exterior of the proposed fenced compound. The site currently consists of maintained grass. The vicinity of the site primarily includes wooded, vacant, and/or residential land uses. The site is bordered to the north by wooded land, followed by a farmstead. The site is bordered to the south by a radio station, followed by U.S. Route 522 and wooded land. The site is bordered to the east by vacant and wooded land. AREAS OF POTENTIAL EFFECTS APE for Direct Effects — The Area of Potential Effect (APE) for Direct Effects, as described in the Nationwide Programmatic Agreement, effective March 7, 2005, is limited to the area of potential ground disturbance and property, or portion thereof, that will be destroyed or altered during the construction of the proposed undertaking. For this undertaking, the APE for direct effects is the area of the proposed compound and proposed access drive. APE for Visual Effects — The APE for Visual Effects, as described in the Nationwide Programmatic Agreement, effective March 7, 2005, is the geographic area in which the proposed project has the potential to introduce visual elements that diminish or alter the setting, including the landscape, where the setting is a character -defining feature of a historic property that makes it eligible for the National Register. The Nationwide Programmatic Agreement describes the following APEs: For new towers 200 feet or less in overall height —'/2 mile APE For new towers greater than 200 feet to 400 feet in overall height— 3/a mile APE For new towers greater than 400 feet in overall height -1 '/2 mita APE For this undertaking, a proposed 100 -foot tall (104 -foot tall with all appurtenances) monopole telecommunications tower, the APE for visual effects is a half -mile from the proposed tower site ATTACHMENT A,CliMENT 8. HISTORIC PROPERTIES IDENTIFIED IN THE APE FOR VISUAL EFFECTS In accordance with the Nationwide Programmatic Agreement, effective March 7, 2005, historic properties reviewed were limited to the following criteria: (a) Properties listed on the National Register; (b) Properties formally determined eligible for listing by the Keeper of the National Register; (c) Properties that the SHPO/THPO certifies are in the process of being nominated to the National Register; (d) Properties previously determined eligible as part of a consensus determination of eligibility between the SHPO/THPO and a Federal Agency or local agency representing HUD; and (e) Properties listed in the SHPO/THPO inventory that the SHPO/THPO has previously evaluated, found to meet the National Register criteria, and are identified accordingly in the SHPO/THPO inventory. A historic properties search was conducted for all sites within the APE that satisfy the above criteria. Files researched in the literature and records review included the National Register of Historic Places (NRNP) database and the National Register eligibility files maintained by the Virginia State Historic Preservation Office (VA SHPO)3. This review revealed that there are no properties that satisfy the above criteria located within a half -mile of the proposed undertaking. However, located within the 1/2 -mile radius of the proposed site are five previously surveyed resources; the Faulkner House (034-0436), the Route 522 House (near Armel) (034-0439), Route 522 House (034-0440. the Spicer House (034-0441), and the Armel-Ferrenz House (034-1204). The Faulkner House was constructed circa 1900 and is associated with a garage and a barn. The single family house was found to have exposed rafter ends and was missing one chimney. The board and batten barn and associated stables was rebuilt in 1982. The garage consisted of a small tractor shed. The Route 522 House (near Armel) (034-0439), the Route 522 House (034- 0440), and the Spicer House (034-0441) have all been razed and are no longer present. The Armel-Ferrenz House (034-1204) is associated with a pump house. This house has a gable roof with wood frame windows and a one-story porch. It also possesses a 19th century vernacular hall and parlor. The pump house is constructed of concrete block. In addition, no other historical resources were identified through any comments received by Indian Tribes, NHO's, local governments, or members of the public. ATTACHMENT 9. HISTORIC PROPERTIES IDENTIFIED IN THE APE FOR DIRECT EFFECTS The archaeological sensitivity study was completed to assess potential direct effects of this facility. No historical properties have been identified within the APE for direct effects. The APE for the review of direct effects included all areas of ground disturbance. It is unlikely that the proposed telecommunications facility will have a direct effect on historical properties. Archival research was conducted to collect information regarding known archaeological resources within the study area. A literature and records review was conducted to determine whether known archaeological sites were located within a quarter -mile of the proposed undertaking. Files researched included the NRHP database, and the archaeological files maintained by the Commonwealth of Virginia Department of Historic Resources. This review revealed that there were no previously recorded archaeological sites located within a quarter -mile of the undertaking. A review of historic resources confirms the site as being undeveloped land since at least 1937. A historic topographic map dated 1942 illustrates that the site had been undeveloped land at this time. Aerial photographs dated 1950, 1964, and 1990 also confirm that the proposed tower location appears to have been an undeveloped portion of a larger property utilized by a local radio station. The site remained relatively unchanged through 1997 and as of the site reconnaissance date of October 8, 2009 it was utilized a maintained grass area. Land use within the immediate vicinity of the site to the included wooded and agricultural lands in all directions from at least 1937 to at least 1950, with the exception of Front Royal Pike being situated to the west. The larger property appears to have been developed by a structure immediately adjacent to Front Royal Pike. By 1964, residential and commercial land uses increased to the north and south along Front Royal Pike with areas to the west and east remaining relatively unchanged. The surrounding vicinity of the site maintained these uses through 1990 and by this time, the larger property had been developed to its existing layout. As of the site reconnaissance date, the site vicinity remained relatively unchanged. Geologically, the site is located in the Blue Ridge Physiographic Province of Virginia, which is characterized by rugged regions with steep slopes, narrow ridges, broad mountains, and high relief. Within this province, elevations have been documented to range between 1500-4200 feet above mean sea level. Topographically, the site is gently sloping to the west and is situated at an approximate elevation of 700 feet above mean sea level. Locally, ground water in the site vicinity is expected to mimic the surrounding topography and flow to the northeast towards an unnamed tributary of Opequon Creek, which is approximately 1,800 feet away. According to the United States Department of Agriculture (USDA) Natural Resources Conservation Service's (NRCS) Web Soil Survey, soils mantling the site have been classified as Berks channery silt loam (1B) with 2 to 7 percent slopes. The Myersville series is documented as deep, well -drained soil formed of Residuum derived from acid shale and found on hillsides. The surface layer of these soils is documented to be channery silt loam to approximately 8 inches, followed by very channery silt loam to approximately 22 inches, and extremely channery silt loam to 39 inches. The physical attributes of the landform, namely its location relative to water and the lack of previously recorded proximal archaeological sites at similar landforms, suggest that the site has a low probability as a potential location for prehistoric occupation or utilization. A shovel test pit was excavated within the limits of the proposed telecommunications facility to allow for an analysis of soil stratigraphy. This stratigraphy appeared to be intact but previously subjected to erosion resulting in a very shallow A horizon. Based on the results of the soil analysis, the shallow soil deposits, the aforementioned lack of proximal archaeological sites and the limited nature of the undertaking, disturbance of any intact subsurface archaeological deposits in the APE for Direct Effects is also unlikely. Additional archaeological survey is not recommended. ATTACHIMENT 10. EFFECTS ON IDENTIFIED PROPERTIES No historical properties within the APE for direct effects have been identified during this review. Based on the results of the soil analysis, the shallow soil deposits, the aforementioned lack of proximal archaeological sites and the limited nature of the undertaking, disturbance of any intact subsurface archaeological deposits in the APE for Direct Effects is also unlikely. Additional archaeological survey is not recommended. Therefore, it is our opinion that the proposed undertaking will have no direct effects on historical properties. No National Register listed historical properties, or properties that have been formally determined eligible for the National Register, were identified during the file review as being located within the NPA -prescribed APE for visual effects; therefore, it is our opinion that per the NPA, the proposed undertaking will have no visual effects on historical properties. However, located within the 1/2 -mile radius of the proposed site are five previously surveyed resources; the Faulkner House (034-0436), the Route 522 House (near Armel) (034-0439), Route 522 House (034-0440. the Spicer House (034-0441), and the Armel-Ferrenz House (034-1204). The house has a gable roof and a one-story porch. The property contains a pump house that is constructed of concrete block. Although photograph 12 illustrate that the tower would be visible from this resource, the Armel-Ferrenz House does not appear to be individually eligible for the National Register. Features indicative of wetland communities, including hydric soils, hydrophytic vegetation, and wetland hydrology, were not observed within the action area. Maroon Director November 17, 2009 The Department of Conservation and Recreation's Division of Natural Heritage (DCR) has searched its Biotics Data System for occurrences of natural heritage resources from the area outlined on the submitted map. Natural heritage resources are defined as the habitat of rare, threatened, or endangered plant and animal species, unique or exemplary natural communities, and significant geologic formations. According to the information currently in our files, natural heritage resources have not been documented in the project area. The absence of data may indicate that the project area has not been surveyed, rather than confirm that the area lacks natural heritage resources. In addition, according to the United States Fish and Wildlife Service Guidance dated September 14, 2000 "new construction of communication towers creates a potentially significant impact on migratory birds, especially some 350 species ofnight-migrating birds". "Communications towers are estimated to kill 4-5 million birds per year and some of these species affected are also protected under the Endangered Species Act and Bald and Golden Eagle Act" (USFWS, 2000). Therefore, DCR recommends voluntary implementation of USFWS interim guidelines for Communication Tower Siting, Construction, Operation, and Decommissioning 01-t!p://Www.fws.gov/northeast/virgitdafieldl ). Our files do not indicate the presence of any State Natural Area Preserves under DCR's jurisdiction in the project vicinity.
