North Annel Site 09L2020 EXECUTIVE SUMMARY At the request of Shenandoah Mobile Company (Shentel), ("Client" or "User"), BL Companies has completed a Phase i Environmental Site Assessment (ESA) of the proposed North Armel telecommunications tower Site located at 2835 Front Royal Pike in Winchester, Frederick County, Virginia ("Site" or "Subject Property"). The assessment was performed for the Client in anticipation of the lease of the Subject Property for the proposed construction of a telecommunications compound. This ESA was conducted in accordance with the requirements of the American Society of Testing and Materials (ASTM) E-1527-05, "Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process." The proposed telecommunications compound is located at 2835 Front Royal Pike, Winchester, Frederick County, Virginia. According to the lease exhibits provided by the Client, dated September 22, 2009, the proposed Site will consist of a 50 -foot by 50 -foot lease area containing a 30 -foot by 30 -foot fenced compound and a 12 -foot wide by approximately 200 -foot long access driveway. The fenced compound is to include a 100 -foot tall (104 -foot tall with all appurtenances), a 10- by 16 -foot concrete equipment pad, and associated electrical equipment. In addition, a proposed utility routing will be along the north exterior of the proposed fenced compound. The Site currently consists of maintained grass. This assessment has encountered the following data failures and/or data gaps during the preparation of this ESA: ® The lack of available City Street Directories for the Site or surrounding area; The lack of available historic SanbomT1,1 Fire Insurance Maps for the Site or surrounding area; and The inability to interview current or past owners and/or occupants of the Subject Property. Based on the information presented in this report, it is the opinion of BL Companies that none of the data failures and/or data gaps listed above impacted the ability of the environmental professional(s) to identify recognized environmental conditions (RECs); thus, no significant data gaps were identified during the preparation of this Phase I ESA. This assessment did not reveal any historical recognized environmental conditions (HRECs), RECs, or business environmental risks (BERs) in connection with the Site that would warrant additional environmental investigation based on the information that was readily available at this time. Phase I Environmental Site Assessment October 20, 2009 North Armel Site 09L2020 Based on the information presented in this report, BL Companies recommends no further environmental investigation of the Site at this time. Phase l Environmental Site Assessment October 20, 2009 North Atmel Site 09L2020 1.0 INTRODUCTION 1.1 Purpose At the request of Shenandoah Mobile Company (Shentel), ("Client" or "User"), BL Companies has completed a Phase I ESA of the proposed North Armel telecommunications tower Site located at 2835 Front Royal Pike in Winchester, Frederick County, Virginia ("Site" or "Subject Property"). 1.2 Scope of Work This ESA was conducted in accordance with the requirements of ASTM E-1527-05, "Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process." The assessment was conducted to evaluate and identify conditions indicative of releases or threatened releases of hazardous substances and petroleum products on, at, in, or to the Site. Although not required by ASTM E-1527-05, a visual determination of the likelihood of the presence of suspect asbestos -containing materials (ACMs), lead- based paint (LBP), and wetlands was conducted as non -ASTM considerations. BL Companies' Phase I ESA sought to gather information regarding: (1) current and past property uses and occupancies; (2) current and past uses of hazardous substances and petroleum products; (3) waste management and disposal activities; (4) current and past corrective actions and response activities at the Site; (5) engineering controls at the Site; (6) institutional controls at the Site; and (7) properties adjoining or located nearby the Site. BL Companies obtained this information through: Interviews with present owners, operators, and occupants, © Review of historical sources of information; Review of Federal, State, tribal, and local government records; and O Visual inspections of the facility and portions of the adjoining properties. This Phase I ESA was conducted under the supervision/responsible charge of an environmental professional, as defined by ASTM E-1527-05. The interviews and Site reconnaissance portions of this assessment were performed by a person possessing sufficient training and experience necessary to conduct the interviews and Site reconnaissance, and having the ability to identify issues relevant to RECs in connection with the Subject Property. Phase l Environmental Site Assessment -1- October 20, 2009 North Armel Site 09L2020 1.3 User Reliance This Phase I ESA has been prepared for the sole and exclusive benefit and use of the Client. Notwithstanding delivery of this report by BL Companies or the Client to any third party, any copy of this report provided to a third party is provided for informational purposes only without the right to rely. Reliance on this report by any other person(s) or entity(les) is strictly at their own risk, and BL Companies makes no warranties to person(s) or entity(ies) who use the information provided in this report. No disclosure of this report may be made without the prior written consent of BL Companies. Phase I Environmental Site Assessment Nor-th Armel Site -2- October 20, 2009 09L2020 2.0 USER PROVIDED INFORMATION 2.1 Additional Inquiries BL Companies provided the Client with a User Questionnaire to obtain information regarding: © Whether the User has searched for any environmental liens against the Subject Property or is aware of any activity and use limitations (AULs) that have been filed or recorded in reference to the Site; Whether the User has any specialized knowledge of the Subject Property and/or the adjoining properties or any relevant experience that would enable the User to identify conditions indicative of releases or threatened releases at the Subject Property; Whether the User believes that the purchase price may reflect the presence of contamination at the Subject Property, © Whether the User has taken into account any commonly known or reasonably ascertainable information about the Subject Property; Whether the User has encountered any obvious signs or evidence of contamination at the Subject Property while gathering information for the ESA; and O The reason the User is requesting the completion of a Phase I ESA for the Site. ASTM E-1527-05 defines these additional inquires as "Users responsibilities." To the extent that the Client chose not to provide information requested by the Questionnaire to BL Companies, the absence of such information has been identified as a data gap in this report. To the extent the Client has performed the additional inquiry(ies) itself and has provided that information on the Questionnaire, BL Companies has relied on the thoroughness and reliability of the Client's information. A copy of the User Questionnaire is included as Appendix A. The following subsections summarize the results of the additional inquiries: 2.1.9 Environmental Liens and AULs No information regarding environmental liens or AULs pertaining to the Subject Property was provided by the Client. Furthermore, the Client did not request that BL Companies perform an environmental lien search as part of this ESA. Phase / Environmental Site Assessment -3- October 20, 2009 North Anne/ Site 09L2020 2.1.2 Specialized Knowledge No specialized knowledge or experience with regard to RECs was provided to BL Companies by the User. 2.1.3 Purchase Price The User provided no indication that the purchase price may reflect contamination at the Subject Property. 2.1.4 Commonly Known Reasonably Ascertainable Information No commonly known or reasonably ascertainable information within the local community that is material to RECs in connection with the Subject Property was provided by the User. 2.1.5 Obvious Signs of Contamination No information regarding obvious signs or evidence of contamination was provided by the User. 2.1.6 Reason For Performing Phase I ESA The assessment was performed for the Client in anticipation of the leasing of the Site for the construction of a telecommunications compound. 2.2 Previous Investigations There were no previous environmental investigative reports relative to the Site provided to, or obtained by, BL Companies in the preparation cf this report. Phase I Environmental Site Assessment -4- October 20, 2009 North Aanel Site 091-2020 3.1 General Site ®escriptien and Operations The proposed telecommunications compound Site is located at 2835 Front Royal Pike in Winchester, Frederick County, Virginia (see Appendix B, Site Location Map). According to the lease exhibits provided by the Client, dated September 22, 2009, the proposed Site will consist of a 50 -foot by 50 -foot lease area containing a 30 -foot by 30 - foot fenced compound and a 12 -foot wide by approximately 200 -foot long access driveway. The fenced compound is to include a 100 -foot tall (104 -foot tall with all appurtenances), a 10- by 16 -foot concrete equipment pad, and associated electrical equipment. In addition, a proposed utility routing will be along the north exterior of the proposed fenced compound. The Site currently consists of maintained grass (see Appendix B, Site Plan). 3.2 Structures and Utilities As previously stated, the Site currently consists of a maintained grass area situated on a larger property utilized by a local radio station. There are no fixtures requiring water, wastewater, or electric service at the Site. 3.3 Adjoining and Neighboring Properties The vicinity of the Site primarily includes wooded, vacant, and/or residential land uses. The Site is bordered to the north by wooded land, followed by a farmstead. The Site is bordered to the south by a radio station, followed by U.S. Route 522 and wooded land. The Site is bordered to the east by vacant and wooded land_ The Site is bordered to the west by a maintained lawn, followed by a residence. Phase t Environmental Site Assessment -5- October 20, 2009 North Annel Site 09L2020 4.0 GEOLOGIC, HYDROGEOLOGIC, AND TOPOGRAPHIC SETTING Geologically, the Site is located in the Blue Ridge Physiographic Province of Virginia, which is characterized by rugged regions with steep slopes, narrow ridges, broad mountains, and high relief. Within this province, elevations have been documented to range between 1500-4200 feet above rnean sea level. (Geologic Map of Virginia, 1993). According to the United States Department of Agriculture (USDA) Natural Resources Conservation Service's (MRCS) Web Soil Survey, soils mantling the Site have been classified as Berks channery silt loam (1B) with 2 to 7 percent slopes. The Myersville series is documented as deep, well -drained soil formed of residuum derived from acid shale and found on hillsides. The surface layer of these soils is documented to be channery silt loam to approximately 8 inches, followed by very channery silt loam to approximately 22 inches, and extremely channery silt loam to 39 inches. Topographically, the Site is gently sloping to the west and is situated at an approximate elevation of 700 feet above mean sea level. Locally, ground water in the Site vicinity is expected to mimic the surrounding topography and flow to the northeast towards an unnamed tributary of Opequon Creek, which is approximately 1,800 feet away. Therefore, hydraulically upgradient facilities are inferred to be located to the southwest. Phase t Environmental Site Assessment -6- October 20, 2009 North Armel Site 09L2020 5.0 SITE HISTORY The usage history of the Site has been reconstructed frorn information obtained frorn a review of historical topographic maps (1942, 1966, and 1986) and historical aerial photographs (1937, 1950, 1964, 1990, and 1997). Chain of title information was not reviewed, and City Street Directories and Sanborn " Fire Insurance Maps were not available for review as part of this assessment. A review of historic resources confirms the Site as being undeveloped land since at least 1937. A historic topographic map dated 1942 illustrates that the Site had been undeveloped land at this time. Aerial photographs dated 1950, 1964, and 1990 also confirm that the proposed tower location remained an undeveloped portion of a larger property utilized by a local radio station. The Site remained relatively unchanged through 1997 and as of the Site reconnaissance date of October 8, 2009 it was utilized a maintained grass area. Land use within the Site vicinity included wooded and agricultural lands in all directions from at least 1937 to at least 1950, with the exception of Front Royal Pike being situated to the west. The larger property appears to have been developed with a structure, believed to be a residence, immediately adjacent to Front Royal Pike. By 1964, residential and commercial land uses increased to the north and south along Front Royal Pike with areas to the west and east remaining relatively unchanged. The surrounding vicinity of the Site maintained these uses through 1990 and by this time, the larger property had been developed with the radio station building, paved parking lots, and landscaped areas. As of the Site reconnaissance date, the Site vicinity remained relatively unchanged. The historic information reviewed as part of this investigation revealed no obvious environmental concerns on the Site or the surrounding properties. Copies of the aerial photographs and historical topographic maps for the Site are included as Appendices E and F, respectively. Phase l Environmental Site Assessment -7- October20, 2009 North Anne/ Site 09L2020 6.0 RECORDS REViEW AND AGENCY CONTACTS 6.1 Environs -rental Database Search BL Companies contracted FirstSearchT" to conduct a database search for agency records pertaining to the Site or off-site properties located within the search radii as set forth in ASTM E-1527-05. The database report (see Appendix C) defines and summarizes the ASTM databases reviewed and notes if any facilities (including the Subject Property) were identified within the specified radii. Federal, State, and tribal databases searched by FirstSearchTM, and corresponding minimum search distances, included the following: O United States Environmental Protection Agency (USEPA) National Priority List (NPL) of delisted and confirmed Federal Superfund facilities (0.5- and 1.0 -mile radius, respectively); • USEPA Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) list of potential and archived Federal Superfund facilities (0.5 -mile radius); • USEPA list of Resource Conservation and Recovery Act hazardous waste generators (RCRAGN), treatment, storage, and/or disposal facilities (TSDF), and corrective action facilities (RCRACOR) (Site and adjacent properties, 0.5 -mile radius, and 1.0 -mile radius, respectively); • USEPA institutional control/engineering control registries (Site only); • USEPA Emergency Response Notification System (ERNS) list (Site only); • State and tribal inventory of known or suspected State hazardous waste (SHW) facilities (1.0 -mile radius); • State and tribal equivalent of CERCLIS and NPL facilities (0.5- and 1.0 -mile radius, respectively); ® State and tribal list of solid waste landfills (SWL) (0.5 -mile radius); • State and tribal underground storage tank (UST) registration list (Site and adjacent properties); • State and tribal leaking underground storage tank (LUST) list (0.5 -mile radius); • State and tribal institutional control/engineering control registries (Site only); • State and tribal voluntary cleanup facilities (0.5 -mile radius); and © State and tribal Brownfield facilities (0.5 -mile radius). Site 09L2020 6.2 Site Review Results The Site was not identified by the environmental database report as an active or proposed Federal Superfund facility, SHW facility, hazardous waste TSDF, or a SWL. In addition, the Site was not identified on the registered UST, LUST, Brownfield, or RCRAGN lists, there have not been any releases of hazardous materials reported for the Site by the ERNS database, and no Federal or State institutional/engineering controls were identified at the Site. 6.3 Area Review Results The database report identified one off-site facility within the ASTM E-1527-05 search radii. Off-site facilities which are either located hydraulically downgradient of the Site, based on the inferred direction of ground water flow, have a "closed" status, or are located outside the minimum search distance for an environmental record source, are not believed to have the potential to adversely impact the Site and are not discussed in detail. Several facilities were identified by the database search, but could not be located in reference to the Site due to missing or inadequate address information. According to ASTM Designation E-1527-05, these facilities are "not practically reviewable," and thus, are not described below. These facilities were not observed to be present in the immediate vicinity of the Site during the Site reconnaissance. 6.4 Agency Review Results As no file reviews were deemed necessary for this ESA due to the completeness of the database search and the historical research, BL Companies did not perform any such review. BL Companies did, however, conduct interviews with local officials (see Section 7.0) to obtain additional information regarding the Subject Property that was not available through historical sources or Site reconnaissance. Phase I Environmental Site Assessment -9- October2q 2009 North Annel Site 09L2020 7.® INTERVIEWS 7.1 Current Owners/Operators No current owner/operator contact information was provided by the Client within the timeframe of this report. 7.2 Past Owners/Occupants No past owners/occupants were interviewed by BL Companies during this assessment. 7.3 Mate/Local Government Officials BL Companies attempted to contact Mr. Craig Smith, Deputy Direction for the City of Winchester Emergency Management Office, on October 19, 2009 to inquire about incidents of environmental significance that may have been reported in relation to this Site. A response was not received within the timeframe of this investigation. Any environmentally significant information obtained as a result of this inquiry will be forwarded to the Client upon receipt. 7.4 Other BL Companies spoke with Mr. Lynn Koerner of Shentel, on October 19, 2009 to inquire about his knowledge pertaining to environmental incidents related to the Site. For the purpose of this assessment, Mr. Koerner was identified as the Key Site Manager, a person having good knowledge of the uses and physical characteristics of the property as defined by ASTM E-1527-05. Mr. Koerner stated that to the best of his knowledge there are no ASTs or USTs currently or previously located on the Site. He further explained that he was not aware of any significant environmental impacts to the Subject Property, Phase 1 Environmental Site Assessment -10- October 20, 2009 Noah Armel Site 09L2020 8.0 SITE RECOHMAISSANICE The Site was visited by a Bt_ Companies scientist on October 8, 2009 for the purpose of performing a surficial reconnaissance. During the reconnaissance, accessible portions of the Site and boundary lines as well as surrounding roadways were traversed on foot and inspected for evidence of releases or threatened releases of hazardous substances/petroleum products. All adjacent properties that could be viewed from the Site were observed; however, no adjacent properties were traversed. Appendix D contains selected photographs taken on the reconnaissance date. 8.1 Polychlorinated Biphenyls (PCBs) PCB -containing dielectric fluid has historically been used in transformers and fluorescent light ballasts manufactured prior to 1982. In addition, PCB -containing fluid has historically been used in hydraulic equipment, such as elevators and lifts. No transformers, elevators, lifts or other materials or equipment suspected of containing PCB fluids were observed on the Site. 3.2 Aboveground and Underground Storage Tanks No indications of the past or current presence of USTs or aboveground storage tanks (ASTs) were observed on the Site. In addition, the Site was not identified by the Federal and State database review as having any registered USTs or ASTs. 3.3 Hazardous Substance/Petroleum Use and Storage There were no indications of the past or current use or storage of hazardous materials at the Site. In addition, no evidence of surface staining or chemical spills/leakage was observed at the Site. 8.4 Hazardous Substance/Petroleum Disposal There were no surficial indications that the Site is, or has been used for the storage or disposal of hazardous waste. In addition, the Site was not identified by the environmental database report as a generator of hazardous waste. 8.5 Water and Wastewater No evidence of on-site water supply wells, ground water monitoring wells, or on -lot septic systems was observed during the Site reconnaissance. Phase l Environmental Site Assessment -11- October 20, 2009 North Armel Site 09L2020 8.6 Surrounding Properties No surficial indications of obvious environmental impairment were observed at any of the adjoining or neighboring properties. 8.7 Non-ASiilli Considerations Although not required by ASTM E-1527-05, BL Companies conducted a visual determination of the likelihood of the presence of suspect ACMs, LBP, and wetlands at the Site as part of this assessment. 8.7.1 Asbestos -Containing Materials (ACMs) Building construction materials that contain asbestos are found in a variety of types and uses. Common types of ACMs used in building construction include floor tile, linoleum flooring, mastic, ceiling tile, spray -applied acoustical/decorative ceiling materials and fireproofing, plaster, wallboard and wallboard joint compound, pipe and boiler insulation, roofing and flashing, and many other materials in common use prior to 1978. ACMs may also be present in debris piles containing discarded building construction materials. Certain asbestos - containing building construction materials such as roofing, roofing tar, and adhesives were still commonly used after 1978. Materials that contain over one (1) percent asbestos are considered ACMs and must be handled according to the Occupational Safety and Health Administration and USEPA regulations. Because there are currently no structures on the Site, the presence of ACMs is not suspected. In addition, there were no debris piles containing suspect ACMs observed on-site. 8.7.2 Lead -Based Paint (LBP) Many houses, apartments, and other buildings constructed prior to 1978 were painted with LBP. Because there are currently no structures on the Site, the presence of LBP is not suspected. 8. 7.3 Wetlands and Environmentally Sensitive Areas Wetlands are diverse ecosystems characterized by hydric soils, hydrophytic vegetation, and hydrology. Vegetation or other conditions indicative of jurisdictional wetlands are regulated under Section 404 of the Clean Water Act. Because of these regulations, wetlands, and other "Waters of the United States" must be identified prior to final planning to eliminate or minimize impacts to these regulated resources. Phase t Environmental Site Assessment -13- October 20, 2009 Noah Annel Site 09L2020 9.0 DATA GAPS AND *- As noted in Sections 2.0, 5.0, and 7.0 of this report, BL Companies made an effort to obtain information from the User and review all reasonably ascertainable historical sources to develop a history of the previous uses of the Site and surrounding area, in order to help identify the likelihood of past uses having led to RECs in connection with the property. The historical research is considered complete when either the above objectives have been met, or when data failure is encountered. Da'La failure, as defined by ASTM E-1527-05, occurs when all of the standard historical sources that are reasonably ascertainable and likely to be useful have been reviewed and yet the objectives have not been met. Data failure is one type of data gap. A data gap, as defined by ASTM E-1527-05, is a lack or inability to obtain information required by this practice despite good faith efforts to gather such information. A data gap is only considered significant when it impacts the ability of the environmental professional(s) to identify RECs. Phase 1 Environmental Site Assessment -16- October 20, 2009 North Annel Site 09L2020 12.0 LIMITATIONS The innocent landowner, contiguous owner and prospective purchaser defenses to liability under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) require that a person acquiring property conduct all appropriate inquiry with respect to the Subject Property. BL Companies has conducted this environmental assessment in accordance with the requirements of ASTM E-1527-05. Those standards require the application of scientific principles and professional judgment to certain facts with resultant subjective interpretations and exercise of discretion. Professional judgments expressed herein are based on the facts currently available within the limits of the existing data, and data gaps identified herein, scope of work, budget, and schedule. Those standards also require that the Client undertake certain additional inquiries. In addition, the liability defenses under CERCLA require, among several other things, that the Client, after the acquisition, stop any continuing releases, prevent any future threatened releases and prevent or limit human, environmental, or natural resource exposure to any hazardous substance released at the Subject Property. Therefore, BL Companies makes no warranties, expressed or implied, including, without limitation, warranties as to merchantability or fitness for a particular purpose, including any warranty that this Phase I ESA will in fact qualify the Client for the innocent landowner, contiguous property owner or prospective purchaser defense to liability under CERCLA. The assessment of the current condition of the Site is based on visually discernible conditions found at the Site on the dates and at the locations specified and does not include the removal of any soil, water, or air samples, the moving of furniture or fixtures, or any type of inspection that would require extraordinary effort to access. The conclusions and recommendations stated herein are based solely on the information described in this report. Detection of asbestos -containing materials, lead-based paint, or lead in drinking water at the Site are beyond the scope of this assessment and were not addressed by this study. Although the detection of wetlands at the Site is beyond the scope of this study, a visual determination of the possible presence of wetlands has been provided. Observation of asbestos -containing materials, lead-based paint, and wetlands was limited to those portions of the Site that were visible at the time of the reconnaissance. Where visual observations are included in the report, they represent conditions at the time of reconnaissance, and may not be indicative of past or future conditions. An independent data research company provided the environmental database report referenced in this report. Surrounding properties were listed within specific approximate minimum search distances intended to meet the requirements of ASTM E-1527-05. The information provided within the environmental database report was assumed to be correct and complete unless obviously contradicted by BL Companies' observations or other credible referenced sources reviewed/interviewed during this assessment. Phase I Environmental Site Assessment -17- October 20, 2009 North Annel Site 09L2020 Although every attempt has been made, the accuracy of Federal, State, and tribal database searches cannot be assured. Since subsurface exploration, observation, and sampling are beyond the scope of a Phase I ESA, no statements can be made concerning the condition of ground water or subsurface soils beneath the Site. No attempt was made to confirm the compliance of past or present owners or operators of the Site with Federal, State, or local laws concerning land usage. Unless specific documentation or evidence indicates that off- site sources have impacted the Site, certainty that such impact has or has not occurred cannot be provided without on-site testing. Conclusions regarding the potential for off- site sources to impact the Site are based upon inferred ground water flow, which is based on surficial topography. Latent conditions and other information may become evident in the future based on currently unavailable evidence. BL Companies assurnes no responsibility for such conditions, or for the inspection, engineering, or repair, which might be required to discover or correct such factors. Should such evidence arise, it should be forwarded to BL Companies so that the conclusions and recommendations of this study may be modified as necessary. In addition, changes in the applicable or appropriate standards may occur, whether they result from legislation, regulation or judicial decisions, from the broadening of knowledge or from other reasons.
