THIS DEED IN LIEU OF FORECLOSURE, made and dated this 711 day of
February, 2001, by and between PHILIP V. BAYLISS, I and PHILIP V.
BAYLISS, 11, parties of the first part, hereinafter called the Grantors; and
ROBERT M. BAYLISS, SR., party of the second part, hereinafter called the
Grantee.
WHEREAS, the Grantee is the holder of a bond secured by a
certain Deed of Trust on the hereinafter described real estate, which
Deed of Trust is dated April 3, 2000, and is recorded in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia in Deed Book 962, at
Page 53, having an unpaid principal balance of $121,107.24; and,
WHEREAS, this conveyance is made in return for full and complete
satisfaction of the note secured by the above-mentioned deed of trust.
NOW, THEREFORE, in consideration of the premises and the sum of
Ten Dollars ($10.00), cash in hand paid and other good and valuable
consideration, receipt whereof is hereby acknowledged, the Grantors do
grant and convey, with General Warranty and with English Covenants of
Title, unto the Grantee, in fee simple, all of the following realty:
All of that certain lot or parcel of land, together with the
improvements thereon and the appurtenances
thereunto belonging, lying and Deing situate along the
southwestern side of U.S. Highway No. 522, about seven
0) miles northwest of Winchester, In Gainesboro
Magisterial District, Frederick County, Virginia, more
particularly described by Building Location Survey
prepared by David M. Furstenau, L.S., dated March
17,1998, of record in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, in Deed Book 906, at
Page 42; AND BEING the same property conveyed to the
Grantors herein by Deed from Robert M. Bayliss, Sr., dated
April 3, 2000, of record in the aforesaid Clerks Office in
Deed Book 962 at Page 51.
Reference is here made to the aforesaid instruments, the
attachments thereto and the references therein contained for a further
and more particular description of the property hereby conveyed.
This conveyance is made subject to all legally enforceable
restrictive covenants and easements of record affecting the aforesaid
realty.
