This report is prepared by the Frederick County Planning Staff to provide information to the
Planning Commission and the Board of Supervisors to assist them in making a decision on
this request. It may also be useful to others interested in this zoning matter.

EXECUTIVE SUMMARY:
This is a request for outdoor equine recreation.
Should the Planning Commission find this use appropriate, Staff would suggest the following
conditions be placed on the CUP:
Following the requisite public hearing, it would be appropriate for the Planning Commission
to of a recommendation concerning this application to the Board of Supervisors.

PROPOSED USE: This application is for an outdoor equine recreation.
REVIEW EVALUATIONS:
Virginia Department of Transportation: The application for a Conditional Use permit for this
property appears to have little measurable impact on Route 681, the VDOT facility which would
provide access to the property. With the proposed removal of an existing dead tree, the existing
entrance is adequate for proposed use. However, should use ever expand in the future, the
entrance may have to be upgraded to VDOT commercial standards.
Frederick County Fire Marshall: Plans approved per Fire Marshal.
Frederick County Inspections: Horse arena may fall under "Farm exemption" (Uniform
Statewide Building Code; Section 102.3 #6).
Winchester -Frederick County Health Department: A permit from the health department is
required to be obtained by the applicant before any food is to be served in conjunction with this
proposal.
Otherwise, the health department has no objection if there is no increase in wastewater generated

to be disposed into the existing sewage disposal system, and if an adequate number of portable
privies (one or more per 100 persons) are provided for spectators and participants.
If public restrooms are required by others, the applicant would be required to obtain approval for
a new sewage disposal system. In that case, the system must be installed and approved prior to
operation of the proposed arena.
