CONDITIONAL USE PERMIT #01-14
WESLEY W. RUDOLPH
WHEREAS, Conditional Use Permit #01-14 of Wesley W. Rudolph,
submitted by Wesley Rudolph, to enable small engine_ and compact tractor repair was
considered. The property is located on the west side of S. Pifer Road, at 2360 S, Pifer Road.
The property is further identified with Property Identification Number 81-A-50 in the Back
Creek Magisterial District. The conditional use is permissible as an automobile repair
without body repair; and,
WHEREAS, the Frederick County Planning Commission held a public
hearing on the conditional use permit on February 5, 2014, and recommended approval of
the Conditional Use Permit with conditions; and,
WHEREAS, the Frederick County Board of Supervisors held a public
hearing on this Conditional Use Permit during their regular meeting on February 26,
2014, and,
WHEREAS, the Frederick County Board of Supervisors finds the
approval of this conditional use permit to be in the best interest of the public health,
safety, welfare, and in conformance with the Comprehensive Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County
Board of Supervisors that Chapter 165 of the Frederick County Code, Zoning, is
amended to revise the zoning map to reflect that Conditional Use Permit Application
#01-14 - Wesley W. Rudolph for a Public Garage without Body Repair (small engine and
compact tractors repair) is permitted on the parcel identified by Property Identification
PDRes 402-14
Number (PIN) 81-A-50 with the following conditions:
1. All review agency comments and requirements shall be complied with
at all times.
2. Any proposed business sign shall conform to the Cottage Occupation
sign requirements and shall not exceed four (4) square feet in size and
five (5) feet in height.
3. Operation limited to the Applicant and one employee.
4. All repair activities and storage shall occur entirely within the enclosed
structure.
5. No more than 5 vehicles awaiting repair may be stored outside of an
enclosed structure.
6. Any expansion or change of use shall require a new Conditional Use
Permit.

This letter is to confirm action taken by the Frederick County Board of Supervisors at their meeting on
February 26, 2014. Conditional Use Permit 401-14 was approved for a Public Garage without Body
Repair (small engine & compact tractor repair). Further conditions associated with the approval of the
Conditional Use Permit include the following:
1. All review agency comments and requirements shall be complied with at all times.
2. Any proposed business sign shall conform to the Cottage Occupation sign requirements and shall
