DEED OF BARGAIN AND SALE
THIS DEED is made and entered into this day of

good and valuable consideration in hand paid, the receipt of
which is hereby acknowledged, has bargained and sold, and
does by the presents grant and convey with covenants of

said WILLIAM P. CONLEY, unmarried, party of the second part
hereto, all the following described real estate, to -wit:
ALL that certain lot or parcel of land together
with the improvements thereon and the appurtenances
thereunto belonging, lying and being situate in
Gainesboro Magisterial District, Frederick County,
Virginia designated as LOT 5 containing 6.4480
acres, more or less, as the same is shown on a plat
and survey entitled Major Rural Subdivision of the
Land of R.S. Contractors, Inc. by Elliott Ritchie,
Jr., L.S. dated June 17, 2002, revised July 22, 2002,
and recorded as Instrument No. 020012246 in the
Clerk's Office of the Circuit Court, Frederick County,
Virginia and further shown on plat made by Elliott
Ritchie, Jr., dated July 11, 2003 and recorded as
Instrument Number 030020665 among the aforesaid land
records.

BEING the same and identical property conveyed to the
Grantor herein by deed dated August 12, 2003, recorded
September 10, 2003, as Instrument No. 030020665 among
the land records of Frederick County, Virginia.
REFERENCE is hereby made to the aforesaid deeds, plats
and surveys referred to therein for a more complete and
accurate description of the tract of land hereby conveyed.
THIS conveyance is made subject to any recorded
conditions, restrictions, or easements affecting the
aforementioned property, and especially SUBJECT TO THE
FOLLOWING RESTRICTIONS which shall have the effect of
covenants running with the land, and shall be binding on all
parties and all persons claiming under them whether or not
referred to in the deed of conveyance:
1. Lots 1, 2, 3 and 4 will share equally the cost
to maintain the two (2) driveways that serve
these homes. Lot 5 is specifically exempt from
this covenant.
2. There shall be no subdivision of the lots.
3. No animals or livestock of any kind shall be
raised, bred or kept for commercial purposes on
the real estate. No chickens, pigs, and
livestock are allowed, household dogs and cats
and horses may be kept, provided they are not
kept, bred or maintained for any commercial
purposes.
4. There shall be no junk or abandoned vehicles
kept on the property.
5. There shall be no trailers or mobile homes
permitted on the property.
