WITNESSETH: That, WHEREAS, by deed.,:: of trust'dated
February 10,' 1973 and April 24, 1973,.and of record in the Office
of the Clerk of the Circuit Court of Frederic?t County, Virginia,
in Deed Book 405, Page 97 and Deed Book 407; gage 473, respectively, ,
the parties of the second part, in order to E;acure to the party
of the fourth part the payment of certain noles or bonds d
therein, did convey in trust to the part of t, -ie first part,
parcels of land described therein; and,
WHEREAS, by deed of -trust dated Fel..ruary 25, 1972 and
recorded in said Clerk's Office in Deed Book 387, Page 338, the
parties of the second part, in order to secuya.to the party of
the third part payment of a certain bond desc-ribed therein, did
convey in trust to the party of the first past, certain tracts
or parcelsof land described in said deed of trust; and,
WHEREAS, the party of the third pa:'t and the party of
the fourth part have requested that the Trus>>k'se release from the
lien of said deeds of trust the land herein (tinveyed.
NOW, THEREFORE THESE PRESENTS WITN3SETH: That for.

assigns forever, with -Special Warranty rf Title, all those certai
parcels of land, .together with all improvements and appurtenances
thereto belonging, lying and being situ,«te in Opequon Magisterial
District, Frederick County, Virginia, i(,.entified as "Chinkapin
Drive" and"Lakeside Recreational" on the, plats of survey prepared
by Higgs and -Shumate, Surveyors, dated 1.'ovember 22, 1972, attach,
hereto and by this reference made a par-,, hereof; being a portion
of the realty conveyed to the parties 01 the second part by
deed of Gustav V. Swenson, et ux, dated April 8, 1964, and of
record in said Clerk's Office in Deed B,•ok 298, Page 527. A
reference -to said records and to the re'°erenc.es therein contained
is hereby made for a further and more p,,.rticular description of
said land.
It is to be expressly understood that the release of
said real estate described herein from .he lien of said deeds of

between S. Herbert Shackelford and :Madge H. Shackelford, his wife,
of the one part, hereinafter called the Grantors, and Lakeview
Townhouses, Inc., a Virginia corporation, of the other part,
hereinafter called the Grantee.
WITNESSETH: That for andin consideration of the sum
of Ten Dollars ($10..00); cash in han=d paid, and other valuable
consideration, receipt whereof is hereby acknowledged, the
Grantors.do grant and convey, with General Warranty of Title,
unto the Grantee, in fee simple, together with all rights,
privileges and appurtenances thereto belonging, all those certain
parcels of land, lying and being situate in Opequon Magisterial
District, Frederick County, Virginia., identifed as "Chinkapin
Drive" and "Lakeside Recreational" on the plats of survey pre-
pared by Higgs and Shumate, Surveyors, dated November 22, 1972,
attached to that certain Deed of.Release dated June 6, 1973 and
of record in the Clerk's Office of the Circuit Court of Frederick
County, Virginia in Deed Book 410, at Page 388, said plats being
at Page 391 and 392, respectively; 1ping a portion of the realty
conveyed to the Grantors herein by!deed of Gustav V. Swenson, et
ux, dated April 8, 1964 and of record in said Clerk's office in
Deed Book 298, at Page 527. A reference to said records and to
the references therein contained is hereby made for a further and
more particular description of said land.
This conveyance is made subject to the legally
enforceable restrictive covenants, conditions, building lines
and rights of way of.record, if any, 'affecting the aforesaid
realty.
The Grantors covenant thdt.they have the right to
convey said realty to the Grantee= that the Grantee shall have
quiet possession thereof, free from all encumbrances; that -they
have done no act to encumber said realty, and that they will
