agencies. Thu cumprehcnsive comment response letter is structured to provide fur the specific review
agency, the date the comment was reeeivcd, a►�d hifurmatimi pertaining to each review comment. This
infurmatiun is intended to explain how specific comments have bccn addlcsscd by the rczujiing
application or advise why the spuuific cummcnt was nut included in the prottered development
program for the commercial redevelopment project.

easement agreement.
COMMENT RESPONSE: A deed of easement has been prepared bctwcen the Titans, Inc.
property wid the Lennox, LLC property that includes intci-paled connectivity and a shared
right-in/rigrit-out entrance ontu Fiunt Ruyal Pike (US Route 522). A Memorandum of
Understanding has bccn executed by both parties and by CPRA, Inc (IHOP Tenant) advising
that this deed of easement is under review by all panics. Additionally, a letter has been
included from Greenway Engineering advising that the deed of easement document will be
legally rccurded prior to lezuning consideration by the hoard of Supervisuls, which has bccn
deemed to be an acceptable approach by the Planning Dr-palt111c11t.

❖ Include a copy of the deed of dedication which highlights the stormwater management system
that was constructed during the developutritt of rhe C.acke, ua,rel site. The capacity of this
systern will need to be verified during the site elan design process.
COMMENT RESPONSE: A copy of UB 556 Fu 692 identifying deed of dedication for the
regional stormwater management system has becn pruvided. This negiunal stormwa[cn
managcmcut system was installed during the development of the Cracker Barrel site and the
subject property has existing stormwater pipe development on-site that ties into this systern.
Information pertaining to the uaat,auity of this system will be venified during the situ plan design
prucess.
Frederick County Transportation — Comment dated October 5, 2016
❖ A Traffic Impact Analysis will not be necessary for this project.
COMMENT RESPONSE: Information that was preparea for consideration of the 'Fratfic

application addresses transportation concerns associated with this request. It should be noted
That to ensure the r ighr-111/r ight-out, the entrance design will require a median device to be
constructed to prevent a left turn in/out of the proposed entrance.
Winchester Regional Airport — Comment dated November 11, 2016
❖ Rezoning is compatible with airport operations. The developer will be required to file FFA
documents for airspace study comphunre as part of the site plan process.
