C] Action: PLANNING COMMISSION BOARD OF SUPERVISORS Recommended Approval on May 1, 1996 Approved on June 12, 1996 WHEREAS, Rezoning Application #002 -96 of Dr. Raymond L. Fish, D.V.M. to rezone 4.7 acres of PIN 33- A -164C from B2 (Business General) to B3 (Industrial Transition), 7.3 acres of PIN 33 -A -165 from RA (Rural Area) to B3 (Industrial Transition), and .28 acres of PIN 33 -A- 164 from B2 (Business General) to B3 (Industrial Transition), all located on the southeast comer of the intersection of I -81 and Route 672 in Clearbrook, was submitted for consideration; and, WHEREAS, the Frederick County Planning Commission held a public hearing on this rezoning application on May 15, 1996; and WHEREAS, the Board of Supervisors held a public hearing on this rezoning application on June 12, 1996; and WHEREAS, the Frederick County Board of Supervisors finds this rezoning to be in the best interest of the public health, safety, welfare, and in good zoning practice; 0 • NOW, THEREFORE BE IT ORDAINED by the Frederick County Board of Supervisors that Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map to change 4.7 acres of PIN 33- A -164C from B2 (Business General) to B3 (Industrial Transition), to change 7.3 acres of PIN 33 -A -165 from RA (Rural Area) to B3 (Industrial Transition), and to change .28 acre of PIN 33 -A -164 from B2 (Business General) to B3 (Industrial Transition). These parcels are located in the Stonewall Magisterial District and are described by the application and plat submitted, subject to the attached conditions voluntarily proffered in writing by the applicant and the property owner. Clear Brook, VA 22624 Frederick County, VA We the undersigned, sole owners of the lands to be rezoned under rezoning request number 002 -96, (hereinafter the "Property ") referred to as the Kingdom Farm rezoning, and the applicants for said rezoning, hereby voluntarily proffer the following conditions. The conditions proffered sha.11 be binding on the heirs, executors, administrators, assigns and successors in interest of both the applicant and owners. In the event the Frederick County Board of Supervisors grants said rezoning and accepts these conditions, the following proffered conditions shall apply to the land rezoned in addition to the other requirements set forth in the Frederick County Code: 1.
