AN ORDINANCE AMENDING
THE ZONING DISTRICT MAP
#003 -94 of C. L. ROBINSON CORP.
w"HEREAS, Rezoning application #003 =94 of C. L. Robinson rte, Co was submitted to rezone
16 acres, located on Route 50 West, (Northwestern Pike), at the intersection with with Route
803 (Round Hill Road), in the Back Creek District, and designated by PIN 53 -A -71, from RA
(Rural Areas) to B3 (Industrial Transition); and,
WHEREAS, the Planning Commission held a public hearing on this application on May 4,
1994; and,
WHEREAS, the Board of Supervisors held a public hearing on this application on November
9, 1994; and,
WHEREAS, the Frederick County Board of Supervisors finds this rezoning to be in the best
interest of the public health, safety, welfare, convenience, and in good zoning practice;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors,
That Chapter 165 of the Frederick County Code, Zoning Ordinance, is amended to revise the
Zoning District Map to change 16 acres; designated as PIN #53 -A -71, from RA (Rural Areas)
to B3 (Industrial Transition) as described by the application and plat submitted, subject to the
following conditions voluntarily proffered in writing by the applicant and property owner:

REZONING APPLICATION #003 -94
The undersigned, C. L. Robinson Corporation, sole owner and applicant
of the 16 acre tract to be rezoned under rezoning application #003 -94
does hereby voluntarily proffer the following conditions. The
conditions proffered shall be binding upon the assigns and successors
in interest of the undersigned. In the event the Frederick County
Board of Supervisors grants said rezoning to B -3 and accepts these
conditions, the following proffered conditions shall apply to the land
rezoned in addition to other requirements set forth in the Frederick
County Code:
Any and all future use of this parcel shall be limited to those which
fall under the following headings, as listed in Chapter 165, Zoning,
of the Frederick County Code:

., contractors and special trade contractors.
