Eddy, AICP, Senior Planner The Department of Planning and Development 107 North Kent Street, 2nd Floor, Winchester, Virginia 22601 Ms. Eddy, I write to you this evening to formally express my concerns over the proffered rezoning application, #17 -05 of Russell Glendobbin. I have several concerns about this rezoning request; First, the requested land use is inconsistent with the surrounding area. The proposal for less than 1/2 -acre lots would be adjacent to the Glendobbin Ridge Rural Preservation Subdivision, created in 2002, which contains two- to five -acre lots and a large set -aside parcel which together meet the RA zoning of the area specifying an average density of one home per five acres. Most subdivisions along Glendobbin Road, inside of the UDA, contain lots of five acres or even greater. Most other parcels in the immediate vicinity are zoned RA and contain either five -acre home sites or large orchards. Second, the Preservation Parcel, the 40% set -aside parcel with 36.54 acres (Parcel 43- A- 16)'established in 2002, should remain "preserved Families in the adjacent Glendobbin Ridge subdivision recently bought their lots with the expectation that the set -aside parcel would remain that way. Also, it seems clear that the UDA line in this area of the Stonewall District seems to follow no natural boundaries nor follow any zoning logic. It does not follow the line of the SWSA as it does in other areas of the county. Third, in the rezoning request, this requested high- density subdivision adjoins the industrial park so there is a real concern about the likelihood of running a street into the industrial park which would result in a mix of residential and industrial traffic through the industrial park as well as through residential areas for cut over access to Glendobbin, Apple Pie Ridge and Rt. 522. Speaking of the layout, there are also some unknown factors which would make things a whole lot worse if this rezoning request goes forward. What I mean is that there is a non proffered a not guaranteed sample housing layout submitted. What this means to me is "what you see is not necessarily what you get" and that the reality when it is built out and just way to late to do anything about it could be worse than what is in the "non- proffered" layout submitted with the request. Also, as you know, the original request last year in September and earlier this year in February was for 130 homes. The original request from last year showed 60 homes to be built in year one of the development, then 60 homes to be built in year two and 10 homes the last year. Based on that past history, this new request for 60 homes looks suspicious. Does it mean the real layout that actually gets built will squash all the first year homes together to leave room for more homes in the future? If so, then this would seem like it's just the same old request dressed up in a new disguise. By clearing the land, putting up a new gate on what was supposed to be a private drive at the end of Union View Lane, tearing down and widening the road there and laying gravel to prep for a road bed, the developers seem to be acting as if approval is a foregone conclusion. Does that mean that the opinions of the residents don't count? The developers are acting as if this rezoning request is just a formality that they are sure of getting muscled through. It is really discouraging to see that happening when the Board of Supervisors has not even seen the request yet. If the request is denied, will they be required to plant mature trees back in the easement there and take up the gravel road bed and plant grass again? Fourth, VDOT estimates a possible traffic increase of an additional 1300 trips daily on Glendobbin Road, Payne Road, Welltown Pike and Apple Pie Ridge. These additional trips are on top of the already existing traffic and a lot of this additional traffic would happen during the worst times when the road system out here is flooded already with the surge when schools let out and work shifts change. As it is the access to this area off of Welltown Road on the east and Apple Pie Ridge Road to the west is backed up in the mornings and afternoons. And traffic is already constant through out the day. An additional 1300 trips, most of which will happen during the busiest parts of the day, will have a very noticeable impact on the area. In addition the construction of a possible 130 homes in a short period of time would likely dramatically increase the number of students in our already overcrowded schools adding to the tax burden on citizens of Frederick County. As long time area residents, we are sick and tired of seeing virtually automatic approval of high density subdivisions granted before the infrastructure to handle the increased population is in place and with little thought of the impact on area the quality of life. If for no other reasons than the traffic increases and the high- density build out, I would respectfully urge you to decline request for rezoning. April 5, 2006 Frederick Co. Kent Street, 2" Floor Winchester, Va 22601 To Whom It May Concern: We would like to take the opportunity as taxpayers and voters in the area to write this letter in consideration of new zoning and future developments particularly affecting the Apple Pie Ridge area, specifically the Russell Glendobbin rezoning issue, as well for the future growth in all of Frederick County. We moved to Apple Pie Ridge Road because of the unparalleled natural beauty and also its close proximity to the city. Daily, we enjoy seeing student athletic groups running from James Wood High school down Apple Pie Ridge and also watch the many bicycle groups ride these beautiful roads. As traffic is getting heavier we are increasingly concemed how long before this will be a thing of the past. Whatever is decided tonight and in future zoning meetings will set a precedent for further developments and forever change the landscape of our great community and of this area as a whole. This will not only affect our families' lives but future generations. The Shenandoah Valley has an amazing history and unique beauty that is solely its own. We, as landowners, taxpayers and voters have a responsibility to not only recognize but make sure that the heritage and quality of life in this area will continue. Without planned growth and good land management we will waste these resources that were left here by our forefathers. We believe new developments need to accommodate future infrastructure. Large residential areas on small plots put burden on the taxpayers by traffic increase on roads, sewers, water lines, schools, parks, etc. We are not opposed to growth and in fact, the development of the Glendobbin Road area was successful in that it partly preserved the integrity of the land and recognized quality of life by not overdeveloping the area. We think Frederick County could continue this planned growth community by also putting conditions to make preparations for a jogging/bike path which would allow all citizens to enjoy our natural resources in a safe and cost efficient manner. We ask that you put in consideration to ask landowners and developers to give consideration in preserving and maintaining the quality of life issues in this area. We would like to see a master plan in Frederick County for planned growth to include recognition of quality of life by including and insuring equal plans for green areas such as parks, bike paths, sidewalks in proportion to new housing growth. For long term growth and good public management, we believe setting standards and recognition of quality of life issues will be a good standard to ensure a community we will all be proud of for future years to come. I strongly agree with these concerns. 1 am not sure you are aware of the potential traffic nightmare at the intersection of Welltown Pike and Rt. 11 if this housing development were allowed. It is already very congested there because of increased traffic from the Stonewall Industrial Park. There are train tracks that cross Welltown Pike right next to the Industrial Park entrance and trains stop traffic there several times a day. There are many new businesses building in the Industrial Park which of course will add traffic. These businesses are a source of tax revenue for the county which we obviously need. I question how many of these businesses would wish to stay in this industrial park if their business quests are hindered by traffic congestion on Welltown Pike. This would certainly occur to a much greater degree if high density housing were allowed in this area. I am planning to attend the zoning request meeting this Wednesday, April 5. It is my understanding that the Frederick County Planning Commission will be deliberating very soon on a request to rezone property along Glendobbin Road to permit higher density housing. As a resident of the Glendobbin Road area, I strongly encourage you to reconsider Pam and Glen Russell's rezoning request to place 60 homes on 65 acres in our neighborhood. Glendobbin Road is a paved country road with steep hills and blind curves which makes it ill- suited to handle the additional stresses of over 120 additional residents. In fact, the road sees many accidents and already experiences heavy traffic from high school students who exceed the posted speed limit of 55 miles per hour, lose control of their cars, and regularly crash into fences lining the lane. Doubling the number of houses on Glendobbin will exacerbate this already dangerous situation. We believe that it would be a tremendous mistake to permit such high density housing on such a road. In addition, the proposed subdivision is inconsistent with the surrounding homes that sit on 2 -5 acre home sites. The additional 60 homes would add more students to Apple Pie Ridge Elementary which is near capacity and cause over crowding at Frederick County Middle School which is currently over capacity. This proposed subdivision is situated adjacent to orchards, an industrial complex, and is within the path of the proposed Route 37 Extension. Finally, I hope that the Planning Commission will seriously consider plans to remove the Glendobbin Road area from the UDA because of these dangers. We even paid additional funds for a lot at the end of the cul -de -sac on Union View Lane so that there would be less traffic, less noise, and a safer environment to walk our dog, mingle with neighbors, and enjoy the natural surroundings. We are writing you to express our concerns and opposition to the rezoning application, #17 -05 of Russell Glendobbin. The rezoning would essentially eliminate the reasons why we purchased our home in this area of Frederick County. There would be a negative impact on the value of our new home, there would be more traffic and noise, the area would become less safe for walking and gathering with neighbors and friends, the natural atmosphere of the area would suffer, and people like ourselves who are considering retiring in Frederick County, would be forced to look elsewhere. With the negative impact the rezoning would have on the quality of life of the current residents in this area, we are hoping that the decision makers on the Frederick County Planning and Development Department will want to maintain and preserve what they have already created. Additionally, we do not understand how the preservation parcel of Gleddobbin Ridge can be changed without approval from the Planning Commission. Since we have moved into our new home, the Russells have removed a significant number of large and small trees within the parcel, widened the roadway through the parcel, laid base rock on the roadway (which is customary prior to asphalting), and installed a large unsightly gate across the roadway. This seems very presumptuous on the part of the Russells, is not consistent with the intent of the preservation, and ignores the authority of the Planning Commission. Personally, we feel that the preservation parcel should be brought back to its original state. In conclusion, we oppose any rezoning and hope that you and the other members of the Frederick County Planning and Development Department will continue to uphold the requirements for land development as was done in Glendobbin Ridge, and that any future development will remain consistent with the existing neighborhoods in the area.
