Susan, I was hoping to speak at tomorrow's Board of Supervisors meeting but due to pressing work I will be
unable to attend. Therefore, I am sending my comments to you and CC Board Members DeHaven and VanOsten
for their information. I would appreciate if you could sharing or provide this e-mail to the appropriate parties for
their information as well.
First, I want to thank the applicant for recognizing that 130 homes on 1/3 acre lots does not match the character
of the area. I also want to thank the local citizens for speaking out and having their voice heard. The applicant's
decision to reduce the number of houses from the original 130 to what I understand is 30 homes on 2/3 of an acre
is, in my opinion, a move in the right direction. The question that I have for you and the Board is while the area in
question is certainly within the UDA and is the right place to build is this still too high a density to place adjacent to
what amounts to rural and industrial land? What type of density does the Planning staff and Board envision for
this area? Certainly some of the rural character of the area will be lost as development pressures continue but in
an area that currently has active orchards and houses on five acre lots homes placed on 2/3 of an acre certainly
seem out of place. Furthermore, if this rezoning passes I fear that the Board will have established the new density
requirements in the area. Land that is currently tied up in five acre plots or more will be subdivided in the future as
the currently homeowners sell their homes and new developments on 2/3 of an acre or less will occur. I have
seen this trend occur in the counties to our East and it is maddening to the residents who want the character of
their community to remain, only to see it lost one piece at a time.
Is this what the Planning Staff and Board envision for this area in the future? If not what are their future views?
They need to know that their vote tomorrow affects more than this one single rezoning.
Please note that other jurisdictions have tried to provide for transition zones from heavily urbanized areas to the
less populated rural areas. Is this the policy of Frederick County and if not why? It would seem appropriate as you
go farther away from our cities that the land be transitioned from urban to rural. In keeping with this theme if a
transition zone overlay was placed over the Glendobbin area what type of density would be appropriate? Perhaps
one or two acres per house
I think that a compromise can be worked out that allows for the applicant to develop this property but is done so at
a density that does not affect the future character of the area. Hopefully you can the Board can be the instruments
of such a compromise.
In addition to the above issue I noticed in the staff report that the area is wooded. While it appears to be an island
of woods in a sea of homes and likely would not qualify as a wildlife corridor (if I am wrong on this please let me
know) it is an area that should be carefully developed as to not disturb the wildlife that thrives in the area. Has this
applicant proffered tree protection areas that can act as wildlife areas and become buffers between the adjacent
property owners? Is there any thought on the impact this project (and others in the UDA) have on our wildlife?
Also what is the Planning Staff and Board's opinion on wildlife corridors within the UDA area to allow wildlife to
traverse our region without having affecting traffic, safety and reducing the interactions between man and them?
Is this being addressed as part of the UDA study

I have been going back and forth on whether to write you all regarding the meeting this evening. Then I decided
that I really had nothing to lose. After the last meeting, I must say, I am somewhat nervous about the meeting for
tonight. You see, I had no idea that there were people who would go to the extent of slandering us and using the
volunteer work that I do in order to get their way. I have had a hard time with this. I realize that most of the people
against this rezoning are used to getting their way, while we are used to following the rules. With this ground
being in the UDA and with water and sewer availability, I don't have to tell you that we could be asking for more.
We started off by trying to rezone a piece of ground that is in preservation. At the time of planning for Glendobbin
Ridge Subdivision, we did not have the knowledge of it being in the UDA and our engineer at the time failed to
point this out. So with trying to change that, we were proposing one acre lots, which is not normally heard of in the
UDA and SWSA area. This was voted against so now we are trying our second option. Obviously, this does not
make the people happy either. We have invested in a piece of ground that we had much bigger hopes for and
now we are asking that you simply vote to approve the 45 Tots that we are proposing. Please remember that this
ground was in the UDA and the SWSA area when the residents of Glendobbin purchased their home.
Proffers would be paid that would not have to be paid if this is not approved. I am very involved at school and I
know that we have an overcrowding issue. We are going to have that regardless of this plan. Our county is
growing and that is not a bad thing. Things get done where there is growth, and growth should happen in all areas
of the county. I work very hard to raise money for the school that my son attends and I see first hand the needs of
our schools. The school system could use that money. The number of students that this would add will not make
or break our school system, it would just balance the growth a little bit.
We understand that the future Route 37 bypass will be coming through there in some way. This has been in the
Manning stage for a very long time and the proposed way it is to go would not interfere with this plan.

is piece of ground is located on the end of Glendobbin Road which is near many different sized lots. Most of
residents would use Payne Road and Welltown Pike as means to go to work or shop. Wildlife would not be
)aged, remember, we have 38 acres right beside it for them to go to. If safety is an issue now, then certainly it
'Id be addressed. The speed limit should not be 55mph on that road, but this proposal does not effect that. It
only takes one person to speed to cause a wreck.

Since this subdivision would be next to the Industrial Park and the future 37 bypass, we certainly could not expect
to build $800,000 homes and be able to sell them. So obviously, it would not be suitable to try for 2 acre lots that
would normally sell for $175,000- $200,000 per lot. So we are trying to keep the lot size down so we could build
moderate sized homes that would sell to the normal single family that perhaps might have to commute back and
forth, yet could still afford a nice home. These homes would in no way bring down the neighborhood. A moderate
sized home anymore is around a 2500 square feet. It would be a nice transition from the higher priced homes to
the'/ acre homes on Payne Road.
We feel like we have tried to compromise and are trying to meet in the middle. We realize that you are faced with
a difficult decision, however, if you take in consideration all of the facts in this matter, we feel that you would have
no choice but to vote "Yes

I wish to weigh in on the Russell Glendobin request for rezoning (albeit a bit late).
I for one am not against growth. I am against uncontrolled and unrestricted
growth. Having grown up in Maryland in several areas of growth (Darnestown,
Germantown Middletown) I have seen good and bad approaches. Based on
this the reduction in lot size, I feel, causes nothing more than a formula to
overburden existing services and utilities. I do not think half acre to acre sized
lots ensure good septic or water usage. I don't think tax revenues vs. the
number of residents will support road, school or police and fire needs. I vote for
keeping the existing 2- 5 acre zoning requirements.
On a side note I really think the area planning should take a realistic look at
impact fees. I think present levels are woefully inadequate. Ten to twenty
thousand would not have stopped me or anyone I know from buying a house in
Frederick County. Especially when it is rolled into the price of a new house
mortgage. The 60 to 120 extra cars on the road from this request alone, plus
construction equipment who would pay for the road wear and tear? 60 multi
bedroom houses at least 80% would have at least 1 child in school...more
How about doing some real planning here. I think it is time to do some realistic
evaluation of the cost of these endeavors and who is really benefiting.

I am a resident of Frederick County I live near the subdivision that the Russells are proposing on
Glendobbin road. I just want you to know that I am strongly against this rezoning application.

This application is not consistent with the surrounding community. This type of development is not
conducive to building strong communities. I lived in a community that had a mix of densities within a
small radius and can tell from experience that there was no sense of community built between the
different densities. It had nothing to do with economic class as their were people in my neighborhood
who were much less well off than some of the people in the smaller homes and townhomes nearby.
There was a significant difference in priorities and a sense of care and responsibility for the surrounding
land and environment.
On an envioronmental impact level, when property is developed below about 2 acres, a completely
different environmental dynamic occurs the ground must be scraped clean and compacted, completely
removing the vast majority of wildlife and native trees that live there.
I moved here because Frederick County was different in a great way. If we continue to develop in an
intelligent, controlled, planned manner, we will continue the excellent quallity of life and environmental
friendlieness Frederick County has to offer. Putting high density housing right smack in the middle of of
Glendobbin road will seriously damage this.
I noticed that the vast majority of the people at the April 5th hearing who were in support of the
rezoning were doing so for monetary reasons they wanted the business. Of course Mr. Russell is going
to be a wonderful community figure to them he signs their paychecks.
Approving this rezoning application means giving in to greed and loopholes in the law /code that Mr.
Russell's attorney is attempting to exploit to their fullest extent namely the UDA boundary and waiver
of the 10 -year restriction on rezoning of preservation lots.
Why was a preservation lot allowed to be created knowing that it can be removed without any
restrictions? The preservation lot was a factor in several people dropping $700,000 for their home
paying a premium for what seemd to be a guarantee on controlled development. This was very
deceiving.
Please make the right decision for the future of Frederick County and deny this application.

this ground is very close to city limits, it seems to be a good area for a subdivision. So we

On April 5 you will hold a meeting to decide whether you should rezone ground off
of Glendobbin Road in order for the Russells to be able to develop. This ground 1s in
the UDA and the SWAB area. As far as I can tell that means that the ground in
question should be allowed to be developed since it was set aside for just that. With
water and sewer availability, It should also have the capability to have several lots
per acre. I believe Mr. Russell Is asking for 60 lots, which is equal to one lot per
acre. That is a lot less than he could ask for. 1 would hope that our local government
is fair enough to see this and realize that even though some of the surrounding
neighbors may be against this, they may also sell their home next month. Where
would that leave the Russells?

over the proffered rezoning application, #17 -05 of Russell Glendobbin.
I have several concerns about this rezoning request.
First, the requested land use is inconsistent with the surrounding
area. The proposal for less than 1/2 -acre lots would be adjacent to the
Glendobbin Ridge Rural Preservation Subdivision, created in 2002, which
contains two- to five -acre lots and a large set -aside parcel which
together meet the RA zoning of the area specifying an average density
of one home per five acres. Most subdivisions along Glendobbin Road,
inside of the UDA, contain lots of five acres or even greater. Most
other parcels in the immediate vicinity are zoned RA and contain
either five -acre home sites or large orchards.
Second, the Preservation Parcel, the 40% set -aside parcel with 36.54
acres (Parcel 43 -A -16) established in 2002, should remain "preserved
Families in the adjacent Glendobbin Ridge subdivision recently
bought their lots with the expectation that the set -aside parcel would
remain that way. Also, it seems clear that the UDA line in this area
of the Stonewall District seems to follow no natural boundaries nor
follow any zoning logic. It does not follow the line of the SWSA as
it does in other areas of the county.
Third, in the rezoning request, this requested high density subdivision
adjoins the industrial park so there is a real concern about the
likelihood of running a street into the industrial park which would
result in a mix of residential and industrial traffic through the
industrial park as well as through residential areas for cut over
access to Glendobbin, Apple Pie Ridge and Rt. 522.
Speaking of the layout, there are also some unknown factors which would

make things a whole lot worse if this rezoning request goes forward. What
I mean is that there is a non proffered a not guaranteed sample housing
layout submitted. What this means to me is "what you see is not
necessarily what you get" and that the reality when it is built out and
just way to late to do anything about it could be worse than what is in
the "non- proffered" layout submitted with the request.
Also, as you know, the original request last year in September and earlier
this year in February was for 130 homes. The original request from last
year showed 60 homes to be built in year one of the development, then 60 homes
to be built in year two and 10 homes the last year. Based on that past
history, this new request for 60 homes, looks suspicious. Does it mean the
real layout that actually gets built will squash all the first year homes
together to leave room for more homes in the future? If so, then this would
seem like it's just the same old request dressed up in a new disguise.
Furthermore, what really seems unfair, is that the developers are already
clearing the land, putting up a new gate on what was supposed to be
a private drive at the end of Union View Lane, tearing down and widening
the road there and laying gravel to prep for a road bed. They seem to
be acting as if approval is a foregone conclusion. Does that mean that
the opinions of the residents out here don't count? That this rezoning
request is just a formality that they are so sure of getting it
muscled through? It is really discouraging to see that happening out
there when the Board of Supervisors has not even seen the request yet.
If the request is denied, will they be required to plant mature trees
back in the easement there and take up the gravel road bed and plant
grass again?
Finally, VDOT estimates a traffic increase of an additional 1300 trips
daily on Glendobbin Road, Payne Road, Welltown Pike and Apple Pie Ridge!
These additional trips are on top of the already existing traffic and
a lot of this additional traffic would happen during the worst times
when the road system out here is flooded already with the surge when
schools let out and work shifts change. As it is the access to this
area off of Welltown Road on the east and Apple Pie Ridge Road to the
west is backed up in the mornings and afternoons. And traffic is already
constant through out the day. An additional 1300 trips, most of which
will happen during the busiest parts of the day, will have a very
noticeable impact on the area.
If for no other reasons than the traffic increases and the high density
build out, I would respectfully urge you to decline request for rezoning.

I am writing to record my opposition to the proposed rezoning in any form of the Russell property off Glendobbin. My
family and I will be at the hearing next week but 1 wanted all of you to know the depth of my concerns. 1 spoke with
Ms.Eddy at the last meeting and spoke with Mr. DeHaven at my home about this issue while he was campaigning for
election.
We moved to our home on Wilton Drive because the area retained a rural, limited development feel. We were told that all
future housing in the area would be on 5 acre lots. We looked at property in Oakdale Crossing and Meadow Branch and did
not want a high density housing environment, no matter how costly the homes. This remains our view.
Currently the roads are not designed to handle increased traffic. Glendobbin is dangerous in the mornings and evenings with
work and school traffic. The fences along the road are hit by speeding cars AT LEAST once or twice per year. We cannot
allow our children to walk or bike to friends homes and this situation would only worsen with new high density
construction.
The schools in the area are at capacity now. Resources are limited and cannot handle the rapid expansion that a dense
neighborhood would bring. I volunteer every week just to help meet the minimal needs of the students, and fear that any
additional stress to the system would negatively impact the quality of the education provided. As it is, the students are
already sharing computers and headphones and don't always have the essentials.
Finally, I must also express my displeasure at the system which allows the Russell's to constantly "change" and "amend"
their proposal with words but not really the essence of what they want to do. A rose is a rose is a rose. The latest ploy to
request only "half' the land to be developed is so transparent. We know that the plan is to wait till things quiet down and
then push the remaining land to be densely developed as well. We are not stupid. A final ruling needs to be made so that this
issue is settled once and for all. We have a tight community, all the neighbors talk. I have not heard a single resident of the
area support this proposed development. 100% are opposed. Please respect the intentions of the original development plan
to keep a rural feel to our area.

This type of zoning is counterproductive to building strong communities. I lived in such an area of
mixed zoning and have experienced poor community development and high crime first -hand. One
of the reasons I moved my family here is because zoning was more consistent and, as a result, the
feeling of community has been excellent. I am not against urban and high- density development it
is necessary to provide afforable housing and infrastructure to the masses. However, placing high
densitiy housing in the middle of rural- suburban development is poor zoning.
Second, the Preservation Parcel, the 40% set -aside parcel with 36.54
acres (Parcel 43 -A -16) established in 2002, should remain "preserved
Families in the adjacent Glendobbin Ridge subdivision recently
bought their lots with the expectation that the set -aside parcel would
remain that way. Also, it seems clear that the UDA line in this area
of the Stonewall District seems to follow no natural boundaries nor
follow any zoning logic. It does not follow the line of the SWSA as
it does in other areas of the county.
If this area is set aside to be a preserve, then why is it even an option to rezone this? Developing
on preservation parcels sets a bad precedent that this can be a regular practice essentially
making "preservation" meaningless. I would like the county to look carefully at the reasons this
and other preservation parcels are established in the first place.

constant through out the day. An additional 1300 trips, most of which
will happen during the busiest parts of the day, will have a very
noticeable impact on the area.

Glendobbin was the factor which attracted me to build a home and live in this area. Therefore this

of one home per five acres. Most subdivisions along Glendobbin Road,
inside of the UDA, contain lots of five acres or even greater. Most
other parcels in the immediate vicinity are zoned RA and contain
either five -acre home sites (including WellTown Acres II) or large orchards.
Second, the Preservation Parcel, the 40% set -aside parcel with 36.54
acres (Parcel 43 -A -16) established in 2002, should remain "preserved
Families in the adjacent Glendobbin Ridge subdivision recently
bought their lots with the expectation that the set -aside parcel would
remain that way. Also, it seems clear that the UDA line in this area
of the Stonewall District seems to follow no natural boundaries nor
follow any zoning logic. It does not follow the line of the SWSA as
it does in other areas of the county.
There are also some unknown factors which would
make things a whole lot worse if this rezoning request goes forward. What
I mean is that there is a non proffered a not guaranteed sample housing
layout submitted. What this means to me is "what you see is not

necessarily what you get" and that the reality when it is built out and
just way to late to do anything about it could be worse than what is in
the "non- proffered" layout submitted with the request.
Also, as you know, the original request last year in September and earlier
this year in February was for 130 homes. The original request from last
year showed 60 homes to be built in year one of the development, then 60 homes
to be built in year two and 10 homes the last year. Based on that past
history, this new request for 60 homes, looks suspicious. Does it mean the
real layout that actually gets built will squash all the first year homes
together to leave room for more homes in the future? If so, then this would
seem like it's just the same old request dressed up in a new disguise.
Furthermore, what really seems unfair, is that the developers are already
clearing the land, putting up a new gate on what was supposed to be
a private drive at the end of Union View Lane, tearing down and widening
the road there and laying gravel to prep for a road bed. They seem to

Frederick County Zoning Board
Dear Members,
April 2, 2006
We understand that you are soon to decide upon a zoning issue which will have wide ranging
effects upon the future of Frederick County. As new residents here, we admittedly do not fully appreciate
the history of building development and planned growth here. Obviously there will be growth, as this
county remains an attractive place to live. There are jobs here and jobs which can be accessed by 1 to 2
hours drive. There is a fine Medical Center here, and so on...
In the case of the proposed high- density development on Glendobbin, we are very concerned. The
huge stresses which would be placed on the current infrastructure (roads, schools, emergency facilities)
make a vote for liberal re- zoning an unwise thing to do. Keep the current zoning ordinances and do not
relax the rules on lot size. Keep the schools, roads and infrastructure ahead of the population growth. Do
not allow our neighborhood to become over -run.

The purpose of this letter is to express our opposition to the application to rezone 67.7242 acres in the
Glendobbin/Apple Pie Ridge area from RA (Rural Areas) to RP (Residential Performance) Please refer
to the Russell Glendobbin Property Rezoning Impact Analysis Statement dated March 2006. Once we
have completed outlining our objections to this statement, we will address our additional concerns.
Page 1: Introduction Paragraph 1:
The applicant states that the existing Glendobbin Ridge development consists of 2 acre parcels when in
fact, the size of the 16 lots range from 2 to 4 acres.
The statement made by the applicant that the proposed development will provide a "transition from the
more intensive land uses within the Stonewall Industrial Park to the low density residential pattern"
surrounding this area is at best, inaccurate. A better term may be ludicrous. The vast majority of the
surrounding area is orchard, farm land and open tracts of land. The Industrial Park is unobtrusive to this
area. As residents, let us reassure you we have never considered high density housing an appropriate
buffer between low density single family dwellings and apple orchards. We find this statement offensive
to the intelligence of the citizens in this community.

We are now aware of the exception that preservation parcels within the UDA can apply for rezoning prior
to the 10 year division restriction. Please note that homeowners within this community were specifically
told the preservation lot could NOT be subdivided for 10 years, and even then it would be an exception.
The builder who purchased the land from the Russells either didn't know of the exception, or lied to us all
by omission. Many, if not all of us chose to purchase here specifically for the rural nature of the area.
Indeed, the requirement for rezoning consideration of a preservation lot is that the proposed development
is consistent with the goals of the Comprehensive Plan in effect. Therefore, a major factor in this matter is
just that: "Is the proposed development consistent with the goals of the Comprehensive Plan in effect
1. The CPP expressly calls for suburban residential uses to predominate within the UDA.
2. In the absence of a designated use as set forth in the Eastern Frederick County Long Range Land
Use Plan, determination of land usage should be left to each individual property owner to decide
what is best for him alone.
3. The area in question is "transitional."
4. High density homes will compliment the area.

5. High density homes will foster a dynamic housing market.
6. Glendobbin should not be considered the "Apple Pie Ridge Road area" solely because it partially
falls within the SWSA.
In response to this, we say, "No, the proposed development is not consistent with the goals of the current
Comprehensive Plan for the following reasons:"
1. There is currently discussion regarding moving the UDA line. It is our understanding that the area
in question is included in the research and evaluation currently underway and there is the
possibility that it may, in fact, be taken out of the UDA. It seems prudent to wait until a final
revision of the UDA is in place before considering this request.
2. Large growth in Frederick County seems likely over the next several years. It is wonderful to
know that the Planning Commission and Board of Supervisors are taking seriously their
responsibility for managing growth in a well thought out, organized, researched and defined
manner. That is why we argue that in the absence of a designation, danger lies in allowing
individuals to interpret the CPP and to determine what is best. The applicant aside, when millions
of dollars are at stake, individuals tend to choose what is best for them, regardless of the best
interests of the community. In this particular case, we hope that you will agree that the proposed
development is not in the overall best interest of this community.
3. As previously discussed, this is not a transitional area. The apple orchards are the most
appropriate transition away from the industrial park.
4. Talk to your friends and family, co- workers and out -of- towners and ask them what makes
Winchester unique? What is their favorite area in Winchester? If they could live anywhere here,
where would it be? Hands down, they'll say "the Apple Pie Ridge area." Apple Pie Ridge
represents "the Sunday drive, the Virginia country, the American dream." It is precisely the
beauty of the area, the attractiveness of the large homes on acreage, and the trees and rolling hills
that makes this community unique. What makes this area so special is arguably the lack of high
density, look at your eight neighbors out your kitchen window, suburban developments found in
every town and city that this request is for.
5. Are we currently in need of a more `dynamic housing market How will this application foster
one? Not convinced.
6. The SWSA does not determine the community's definition of a neighborhood. That is just silly.
Glendobbin Road is as much a part of the Apple Pie Ridge Road area as Butler Estates, Green
Springs, and other developments adjacent to Apple Pie Ridge Road are. The argument could be
made however, that the creation of high density homes in this area will result in Glendobbin
being known as the "downfall of, indeed the sell -out, of Apple Pie Ridge."

"A secondary point of access will be established for emergency vehicles through the existing Glendobbin
Ridge Subdivision."
As the 3'" iteration of this proposal, within the past year the Russell's have attempted to pave and dedicate
this easement to the County, they have attempted to use it as a secondary entry into their proposed
development, and are now stating its new use as emergency access. That's a lot.
Be advised that they are not the owners of the easement land. If you have not yet received a letter from
our attorney on this matter, one will be forthcoming shortly. There is no further need to comment on this
issue here.

Traffic patterns in this area are already at bottleneck proportions during certain times of the day. First,
Apple Pie Ridge Road is heavily congested before and after school hours and Glendobbin Road is used as
a major thoroughfare for high school students commuting to and from school. Second, the traffic exiting
Interstate 81 onto Rt. 11 has become so congested between the hours of 3 p.m. and 7 p.m. that cars are at
times stuck stopped on the freeway, attempting to exit.
In addition, Apple Pie Ridge Road and Glendobbin Road are 55 mph zones. Traffic often exceeds the
limit on these narrow, windy rural roadways. To make matters worse, the entrance to Union View Lane is
located such that the sight line for intersecting traffic is only 150 ft! The line of sight for the proposed
new entrance off of Glendobbin Road is equally as short. This limited distance requires extreme caution
when turning onto Glendobbin Road. More traffic will exacerbate the problem.
Having stated these current concerns, this application indicates the proposed development will increase
the average daily car trips by 1300! What exactly does that mean to existing homeowners living in and
around Apple Pie Ridge, Glendobbin, Payne, and Welltown Roads? Well, given that most car trips occur
between 6 am, and 9 pm, that averages out to 86 more cars per hour or an additional 1.5 car trips a
minute. In other words, if this proposal goes through, there will be no more days of peaceful, country
living for these neighborhoods. Instead, the existing homeowners will spend their time at stop signs trying
to catch a break in traffic remembering the `good old days' when a car didn't pass every 40 seconds: Yes
indeed, every 40 seconds.
Additional comments
While we have now fully outlined our objections to the March 2006 proffer statement and request for
rezoning, there are additional concerns and comments we would like you to consider as follows:
1. School system: It is over capacity as it is. The instant addition of a whole neighborhood of
students will overburden the teachers and the school administration. This type of growth results
in a lower quality of education for existing students as well as the newcomers.
2. Neighborhood impact: This subdivision of 60 homes will immediately almost double the
number of homes currently built in this area.

3. Lot layout: The applicant has not provided a proffered proposal, nor accounted for the total
67.7242 acres. As you are aware previous requests were made but withdrawn, attempting to put
130 homes on 15000 sq ft lots. The current request is for 60 homes on 20,000 sq ft lots. Given
there is a total of 67.72 acres, 58 homes on 20,000 sq ft lots, plus 2 homes each on 3.6 acres (see
Impact Analysis Statement, page 4, E. Sewage Conveyance and Water Supply Paragraph 2),
plus an estimation of 7 acres allotted for roads (see note) accounts for 40.83 acres. With all roads
in place, 26.89 acres is left unaccounted for. That's a lot of undeveloped property. Hmm, that's
even enough to get about 58 more homes on 20,000 sq ft lots at a later date.
The non proffered layout submitted with this application means exactly nothing. It cannot even
be considered for discussion or comment. Furthermore, the Russell's have not allotted for
setbacks, screenings, buffers or fences for adjacent property owners. They have not indicated
how new homes backed into orchards impacts the integrity of the existing environment and
working farms. They have not demonstrated how new homes built on the hill adjacent to and
directly below Glendobbin Ridge lots 3 -7, 9, 10, 13, 16 will affect the current homeowners who
have view property. How will clear cutting the hill and putting up new homes affect drainage
issues and runoff waters from these steep lots? What size and kind of homes are they intending to

build Smaller tract housing Large $500K homes that in effect really won't offer
consumers the alternative they proposed?
*Note: 7 acres for roads estimated by using the 2.8876 acres dedicated for the existing Union
View Lane, then multiplying by 2.5.)

4. The Russell's have not yet been able to prove their ability to supply 2 separate means of access to
the proposed development.
5. It is our stance that this development will not help but in effect, harm existing property values in
this area. From all accounts, it appears the new development will place homes next to industrial
facilities and backed into the Route 37 connection resulting in an undesirable neighborhood
location.
6. Applicant Behavioral History This applicant has made a lot of assumptions along the way.
From the beginning, the applicant has acted as if this process has already been completed. It
began in October 2005 when one day he came and bulldozed a 50 ft swath of old growth trees,
pushed through a substantial sized road, laid crushed gravel and prepared to pave. He didn't talk
to the adjacent homeowners who actually own the land rights; he just did it. While the road in
place was not 50 ft wide, it was at the time adequate for his large farming machinery. It is now a
mess and looks terrible.
Due to construction debris left by G &M Homes, there was a period this past winter where the
road was difficult to traverse. The applicant repeatedly drove on our property to get through, and
most recently ran a bulldozer on top of our drain field.
The numerous proposals, along with withdrawls and postponements, as well as inaccuracies and
errors in the proposals have frustrated and angered the surrounding community. Furthermore,
despite the Planning Commissions strong advisement to hold a community meeting before the
April 5 meeting, no such attempt was made.
This past week there was once again a flurry of activity on the part of the applicant. As if you
had already approved the proposal, the applicant punched the road back through and added his
access gate. With the new gate in place, cars and trucks without gate access now turn around on
our property. Again, we've witnessed them backing onto our drain field in order to turn around.
Given this history, we have concluded that unfortunately the applicant is not interested in
anything but a hostile resolution. As fellow community members and adjacent property owners,
we have felt completely dismissed, disregarded, and disrespected and therefore have surmised
that the Russell's have no intention of compromise, no intention of relationship and no intention
of considering anyone other than themselves.
Given these strong objections, we respectfully ask you to deny this rezoning application.

I am a resident of Frederick County and live in the area around Apple Pie
Ridge, Glendobbin, Welltown and Payne Roads.
1 object to the Russell Glendobbin rezoning request because
It is NOT %onsistent with the current land usage and the existing
neighborhoods already in this area.
Part of the request is to develop a recently set -aside preservation parcel.
This would violate the purpose of a preservation parcel by developing it
rather than preserving it.
Depending on what could get built, it will double or even triple the
number of homes already built in the area.
It will significantly increase traffic in the area and will add many more
students to a school system that is full already.
It would put a high density subdivision in close proximity to an existing
industrial park and to orchards as well as to the proposed future Rt. 37
bypass.

I am a resident of Spring Valley Estates which adjoins the Russell Glendobbin parcel being
considered for rezoning. I object to the Russel Glendobbin rezoning because of several reasons.
One, it is not consistent with the current land usage and the existing neighborhoods already in this
area. Second, part of the request is to develop a recently set -aside preservation parcel. This
would violate the purpose of a preservation parcel by developing it rather than preserving it.

Because of the reasons above and the fact that this type of development is not appropriate for this
area I urge you to deny this request for rezoning.

My name is J.P. Darlington and I am writing to you to formally express my
concerns over the proffered rezoning application, #17 -05 of Russell
Glendobbin. I own land adjoining two sides of the Russell property in
question. I have three hundred acres which consists of 51 5- acre lots and a
45- acre parcel on which I live. All of this land is part of Spring Valley
Estates. My land extends from Rt. 37 to large lots along Glendobbin Rd.
I have a number of concerns and objections to this request for rezoning.
First, the requested land use is inconsistent with the surrounding area. The
proposal for less than 1/2-acre lots would be adjacent to land owned by me
and the Glendobbin Ridge Rural Preservation Subdivision, created in 2002,
which contains two- to five -acre lots and a large set -aside parcel which
together meet the RA zoning of the area specifying an average density of
one home per five acres. Most subdivisions along Glendobbin Road, inside
of the UDA, contain lots of five acres or even greater. Most other parcels in
the immediate vicinity are zoned RA and contain either five -acre home sites
or large orchards.
Second, the Preservation Parcel, the 40% set -aside parcel with 36.54 acres
(Parcel 43 -A -16) established in 2002, should remain "preserved Families
in the adjacent Glendobbin Ridge subdivision recently purchased their lots
with the expectation that the set -aside parcel would remain that way. Also,
it seems clear that the UDA line in this area of the Stonewall District seems
to follow no natural boundaries nor follow any zoning logic. It is my
opinion that even though the current UDA would double the value of my
property I feel that the UDA is inappropriate for this area and should be
lifted.
