The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on October 26, 2007. The site plan is for approved revisions to the previously
approved Rutherford Crossing Site Plan (SP# 13 =07). Th "is commercial center is located off of
Martinsburg Pike (Ro,ute ,11) "in the Stonewall ;Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in; the approved site plan,
including review agency comments from all relevant review agencies.; I am providing you with five (5)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference; and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, `the owners) should contact this office to schedule an on -site inspection. Do not hesitate �to

This is to acknowledge receipt of the latest revised sife plan sheets for the Rutherford
Crossing Project, as received by this office on September 27, 2007. The revisions
appear safi'sfactory and are approved, subject to the addressing of the following
comment.
Add current VDOT Standard PB -1 detail to the plans. Add a note
stating that storm culverts within public right -of -way are to be installed
in. accordance VDOT'Standard PB -1 Detail..
Please provide 4 complete sets of approved construction plans with signed and dated
seal for VDOT distribution.
I offer the following comments:

• Materials used and method of construction shall apply to current observed VDOT

exist such that additional _measures are warranted, such measures shall be,
completed to the satisfaction of the Department prior to inclusion into the
Secondary :Road System.
. Attached is a copy of the minimum requirements and' information needed prior
to acceptance of subdivision streets into the Secondary System. This is the
responsibility of the developer.
. All drainage is to be carried within the right -o.f -way in ditch lines or gutters along
the street to a pipe or drainage easement.
• The contractor sh`dll notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections,
The appropriate land use permits shall be obtained before any work is performed
on the State's right -of -way. The permit is issued by this office and will require a
minimum, processing fee, surety bond coverage, and the salary & expenses of a
State assigned Inspector.
Any entrances constructed from the referenced streets) shall meet VDOT
minimum standards. This is the developer's responsibility..
Any signs to be installed will be in accordance with attachments.
. I suggest any utilities and /or storm sewer placed within the proposed right -of -way
be backfilled completely with C.R. Type 21 -B Stone. This will greatly reduce the
possibility of any pavement settlement.
e. An agreement between VDOT and Frederick County to absolve the Department
of any maintenance or liability of the detention basin will be required. This'is' the
developer's responsibility. The executed agreement is needed before the street
(s) is elig:ibie for acceptance into the State's Secondary Road System.

Comment 5) Historic Area. Indicate why the historical area has been revised since the last
submission.
Response: Upon further review of the grades in the historical area, the path location was revised
to accommodate handicapped access from the parking area designated for the
handicapped parking. The grades were too steep to come directly from the parking
lot, as previously shown. A. path has been added. from the parking area to the trail
along Route 11 to allow access to the relocated path in the historic area.
Comment 6) handicap Ramps.. 'There are handicap ramps shown at some of the larger
buildings (2A 5B, �A).. The. sidewalks in front of the buildings can be depressed
concrete if desired to avoid the transition.
Response: The sidewalks are not depressed and require the ramps.
Comment 7) Lowe's Parking. The, parking area beside the Lowe's garden area has been
revised since the lash submission to remove the curb and gutter and sidewalks.
Revise the.plan to show the previous layout.
Response: The parking area has been revised to show the previous layout.
Comment S) Loading Spaces. There are loading spaces behind the Lowe's building for pallet
trailers and used appliances ensure that the storage of these materials will not
occur behind the building.
Response: We have indicated areas where; according to Lowe's, they load the noted items on to
trailers. I do not have any additional information about the operational practices of
Lowe's at this time.
Comment 9) Milton Ray Drive. The cul -de -sac for Milton Ray Drive near the :railroad does
not extend to 'the edge of the property /railroad easement. If the 'intent is not to
build the road to the limits of the railroad, then an I easement needs to be shown
so the adjacent property can connect into this road when it develops.
Response: Milton Ray Drive right of way is shown on the plan extending to the railroad property
so that future extension can occur. No easement is needed. The cul -de -sac is a
temporary turn- around required by VDOT since it is not known when the extension of
Milton Ray Drive will occur.

We are pleased to submit the above referenced plan for its final review. Please find attached 2
copies of the revised final plan. The following is our response to the ls` review comments.
Comment 1: Dumpsters: Provide a dumpster detail in the site plan.
Response 1: Please see sheet $, the requested dumpster enclosure details have been added
to this drawing.
Comment 2 Building 5C: Check the parking numbers provided. Loading spaces can't be
within "the driving lane; label the drive thru and width, show any canopies and
proposed signs.
Response 2: Please see sheet 2, the parking table has been updated to reflect the parking
available to this building pad. In addition,. please see sheet 9; the loading
space is no longer being 'utilized as a travelway, the drive thru lane has been
labeled and dimensioned and the location for the menu board has been
added. There is no canopy planned for the drive thru of "this building.

Comment 3: Building 5D: The driving lane with the loading space needs to be one -way
(ensure at least 12 feet clearance); check parking numbers provided.
Response 3: Please refer to sheet 9, the loading space has been relocated so that it is no
longer in a travel way. In addition, please refer to sheet 2; the parking
available for this building pad has been updated, as requested.
Comment 4: Building 6A: Provide sidewalk that is shown on the approved plan and shade all
sidewalks. Label and show widths of the drive thru and bypass lane. Show any
canopies and signs.
Response 4: Please refer to sheet 9, the sidewalk that had been shown on the approved
plan has been added, as requested. In addition, the drive thru and bypass
lanes have been labeled and dimensioned, as requested. Also the location of
the. drive thru menu board has been added. There is no canopy planned for
the drive thru of this 'building at this time.
Comment S: Buildings 5A and 5B: Show the concrete area in front of the building, revise the
curb and gutter behind building SB as indicated, provide 6 inch curb around turf
area and ensure that dumpsters as provided can be accessed with location of turf
area.
Response 5: Please refer to sheet 10, the concrete walks along the front and sides of these
building -pads have been added to the plans, as requested. In addition,
please note that we have determined that the turf area will be to restrictive
to the movement of truck traffic in the rear of the building. As such, it has
been eliminated from the plan.
Comment 6: Building 3B: Building 3B needs a dumpster.
Response 6: Please refer to sheet 12, a dumpster pad has been provided for this building,
as requested.
Comment 7: Building 3A. Tlie turf area behind building 3A needs a six inch curb around it.

VDOT's Road Design Manual (Page,C -20,� Figure C -1 -2). This applies to the NB Route 11
lanes and the westbound lanes of Merchant St. at the..intersection of Route 11 with
Merchant Street.
21. The Merchant St. intersection with Route ,11 will need to be signalized when open
to traffic. Signal plans should be submitted to VDOT for approval. The Route 11 signs
and markings plan needs; to be updated to reflect the signalized intersection..
22. More right -of -way may ,be needed at the, intersection: of Route 11 and Merchant
Street for the construction of the traffic signal. Any additional ROW needed to
accommodate the signal pole and, electrical cabinets will need to be dedicated to VDOT.
23. The signal plans will need to verify sufficient vertical .clearance for the traffic
signals relative to the overhead utilities.
24. The service .entrance from Route 'l l to Building; l,, needs to be designed to
discourage use by general traffic as a short-cut to Market St.
25. The double left -turn lanes from Route 11 SB to the Future Road opposite
Merchant St. have been proffered for construction as part of the Route 11
improvements. The Route 11 plans need to be revised to include these left -turn lanes.
This revision needs to be coordinated with the developer /owner east, of Route 11.
26: Verify the transition on ,Rte. 11 at the;;north end of the development is; appropriate
for the existing speed and width of transition specified.
27. The Maintenance of Traffic (MOT) plans and the Sequence of Construction will
need to. be updated for the Route 11 improvements based on the revisions to .the
construction plans and the latest changes to the Virginia Work Area Protection Manual;
Rev, May 2005.
