The above - referenced site plan was approved on November 19, 2012. This site plan is approved for
the construction of a 7 -11 Convenience and Gas Station (demolition and rebuild) at 1026 Millwood
Pike (Route 50E) in the Shawnee Magisterial District. Required site improvements include the
following:
• Construction of a 3,700 square foot convenience store, ten gasoline pumps under one canopy.
C Construction of a parking lot with 15 spaces (including one handicap accessible), including
curb and gutter, striping and handicap access.
• One loading space and one screened dumpster area.
• Construction of a sidewalk along Route 50.
C Landscaping and lighting as shown on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three
(3) copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved
copy must be kept on the construction site throughout the development process. Once site
development is complete, the owner(s) should contact this office to schedule an on -site inspection.

Dear Chris:
Planning Staff has reviewed the above - referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted because it has
not addressed previous staff comments and the plan does not conform to the requirements of the
Frederick County Zoning Ordinance. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review
Staff's comments listed below and prepare a revised site plan which adequately addresses each
concern.
Review Comments:
1) General Notes. On the coversheet, provide a note stating that all utilities must be
underground.
2) Si na e. On sheet 2A, for the sign detail, the area between the top sign panel and the
LED signs needs to have a blank panel inserted.
3) Landscaped Islands. A landscaped island is required at both ends of the parking bay at
the front of the convenience store as well as the parking spaces at the western property
line.
4) CG -6 Requirement. The use of wheelstops and CG -2 is only permitted when LID
techniques are utilized. It does not appear that this site is utilizing any LID techniques
and, therefore, CG -6 is required as indicated on sheet 5.
5) Route 50 Sidewalk. The sidewalk along Route 50 needs to be continued as indicated
along the entire site frontage; crosswalks need to be provided as well.
6) Site Lighting. The following needs to be addressed on the photometric plan:
o The canopy lighting does not appear to meet the outdoor lighting standards. Light
fixtures under fuel station canopies or any other canopy shall consist of full cut -off
lighting fixtures where the light source is either completely flush or recessed within
the underside of the canopy. The portions of the canopy not included in the sign
area shall not be illuminated. All canopy lighting shall be recessed sufficiently so as

to ensure that no light source is visible from or causes glare on adjacent properties or
road right -of -warms.
• The lighting levels indicated for this site exceed the maximum permitted. The
average maintained lighting levels for nonresidential uses shall not exceed the
following standards:
a) Five (5) foot - candles for parking lots and loading areas.
b) Ten (10) foot - candles along fronts of buildings and along main drive aisles.
c) Twenty (20) foot - candles for vehicle fuel station canopies, but not including
parking lots.
• Lighting levels shall not exceed 5.0 foot - candles at any common property line with
property zoned or used for commercial or industrial uses, and at any edge of a
property line adjacent to a road right -of -way.
• Description of all lighting fixtures needs to be provided on the photometric plan.
This needs to consist of catalog cuts and illustrations by manufacturers that describe
the equipment, including lamp types, wattage and initial lumen outputs, glare control
devices, lamps, proposed placement of all fixtures, including engineering detail of
fixtures, manufacturer, model and installation of same.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets and
at least five copies of the final plan for approval. Comment sheets are required from the
following agencies: the Frederick County Sanitation Authority (approved as noted are not
acceptable) and the Virginia Department of Transportation.

Dear Mr. Atwood:
We have received your comments dated October 12, 2012 and offer the following in response.
"General: The previously submitted design waiver for entrance spacing has been approved by
VDOT. "
Response: Acknowledged.
2. "General: Revise the VDOT General Notes to match those attached to this email. "
Response: The VDOT General Notes found on Sheet 1 have been revised as suggested.
3. "General: Provide a Transportation Management Plan including 2011 Virginia Work Area
Protection Manual Standard Details (VWAPM), Traffic Control Plan and Narrative, and Public
Communications Plan for a Type "A " Project. A guide sample has been attached for your use in
creating the TMP. According to the discussions during the Otiimer /Contractor Meeting, the work
within VDOT Right -of -Way should be able to be completed in one to two days, which would
require a shoulder closure in accordance with VWAPMFigure- TTC-4. 0 and /or 7-TC -5.0. Insert
the TTC details and Traffic Control Narrative on the Plans. At most, a minor encroachment into
the roadway may be required to tie in the existing roadway asphalt. "
Response: A Transportation Management Plan has been added on Sheet 9.
4. "General: According to discussions with the Owner, the existing paved entrances will be
removed and replace with concrete entrance treatments. Please show these improvements on the
plan and include a detail of the proposed entrance(s) with a profile (for drainage) and direction
for how to tie the concrete apron to the existing Pavement of the adjacent travel lane. "
Response: The Grading Plan has been revised to include the concrete entrance treatments.
Entrance profiles have been provided on Sheet 5, with direction for the
construction of the proposed entrance improvements. As indicated on the plans,
the existing curb and drainage patterns will remain as they exist today. Only the
asphalt pavement will be replaced.

Response: The front yard setback has been revised to 50'. Please see Sheet 2.

Response: A detail showing the conversion of the existing sign to the required monument
style has been provided on Sheet 2A.

3. "General Annotations. Annotate name of R O. W (See mark up) "
Response: The name of the existing right -of -way Delco Plaza has been provided on Sheets 3
and 4, per the provided mark -up.

4. "Signs. Note that the existing Interstate Overlay Sign is to remain. The sign on the north part of
the property would have to be brought to today's Zoning Ordinance standards. "
Response: The existing Interstate Overlay Sign has been noted to remain on Sheet 4. A
detail showing the conversion of the existing sign to the required monument style
has been provided on Sheet 2A. -
5. "Setback. The front setback is annotated at 35 feet; it should be 50 feet. "
Response: The front yard setback line has been revised to 50' from the property line. Please
see Sheet 3.

6 "Entrance. One of the two entrances needs to be vacated. What is the VDOT comment? "
Response: To provide needed vehicle circulation for fueling operations, the entrances being
utilized by this site are existing entrances which are not being altered. The
entrance spacing requirements provided in Section 165- 202.03 are specifically
for new entrances. VDOT suggests that a request for an exception to the spacing
standard be submitted. The appropriate form will cite the parcel's location on an
older, established business section of a highway corridor where existing spacing
did not meet the spacing standards prior to July 1, 2008 as justification for the
exception, per VDOT comments.
"Curb and Gutter. Curb type is noted as a CG -2; this should be CG -6 Also, with a CG -6 curb,
are wheel stops necessary? "
Response: As per your discussion with Nathan Bales on September 7, 2012, 6" curb will be
provided through the use of CG -2. The standard VDOT CG -2 detail appears on
Sheet 2. Wheel stops are provided in front of the building where flush curb is
used to allow ADA access, and in the northeast corner of the site where there is
no curb to promote drainage to the nearby concrete channel.
8. "Lab elin . See sheet for additional comments. "
Response: All suggested labels have been provided per the attached markup.
"Sidewalk. Five foot side is required per Ordinance along Millwood Pike. "
Response: Due to the location of the site between two properties without sidewalk along the
frontage, one of which received Site Plan approval for a similar use within the
past two years, a five foot sidewalk along Millwood Pike is not provided.
Moreover, it is unclear which zoning ordinance section specifies that provision of
a 5' sidewalk along the road right -of -way is required.
10. "Landscaping. As part of the plant schedule, please annotate height at planting."
Response: The plant schedules on Sheet 7 have been revised to include height at planting.
11. "Wall mounted lights. Provide a note that all wall fixture lights shall be shielded. "
Response: A note has been added on Sheet 8 stating that all wall fixture lights will be
shielded.

Please find attached a revised Rte. 50 7- Eleven Site Plan. The revisions include those made to
address VDOT comments, the location of existing underground fuel storage tanks as requested
by the Dept. of Public Works for conditional approval, the items requested by FCSA for
conditional approval, and the inclusion of the 5' sidewalk along Millwood Pike. Also, approval
letters from all of the Frederick County Departments are attached in preparation for final Site
Plan approval.

Your response letter dated September 11, 2012 has adequately addressed a majority of
our comments dated August 1, 2012. The only exception is your response to our previous
comment 42. We would appreciate a plan showing the exact number and location of each
underground fuel tank.
The revised site plan documents dated September 10, 2012 are approved by the public
works department pending receipt of the above referenced plan.
