The above - referenced site plan was approved on December 4, 2012. This site plan is approved for
the construction of three garden apartment buildings with a total of 36 residential units. The site is
located at 737 and 749 Front Royal Pike (Route 5225) in the Shawnee Magisterial District. Required
site improvements include the following:
• Construction of three garden apartment buildings.
• Construction of parking lots with a total of 81 spaces (including six handicap accessible),
including curb and gutter, striping and handicap access.
• One screened dumpster area.
• Construction of a sidewalk along Front Royal Pike and sidewalks intern al to the
development.
• Buffers and landscaping as shown on the plan.
• Outdoor lighting as shown on the site plan. "Please note that all outdoor lighting must be
amber in color per the Airport Authority.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with five
(5) copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved
copy must be kept on the construction site throughout the development process. Once site
development is complete, the owner(s) should contact this office to schedule an on -site inspection.

Dear Ms. Perkins:
The comments from the Frederick County Department of Planning and Development
regarding the above - referenced project have been appropriately addressed on the revised site plan
documents that accompanies this letter. The comments have been addressed as follows:
Department of Planning and Development:
1. The lot consolidation plat has been approved, signed, and submitted for
recordation.
2. The sidewalk provides handicapped accessibility from Route 522, as shown.
Secondly, based on the comments from the public school system during the master
plan phase, it was preferred to have the students catch the bus on Airport Road
rather than Route 522. This walk configuration meets that request.
3 & 4. The lighting plan and legend have been revised as requested.
All comments have been addressed completely in accordance with your review. Please
review the revised plans for compliance and advise me as to your satisfaction for approval.

Dear Tim:
Planning Staff has reviewed the above - referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff's comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Lot Consolidation. The lot consolidation of parcels 64C -A -8 and 64C -I -15 needs to be approved
and recorded before the site plan can be approved,
2) Sidewalks. As indicated on sheet 3 additional sidewalks need to be provided within the
development.
3) Photometric Plan — Outdoor Lighting. On sheet 12 the light fixtures (both building and pole
mounted) need to specify that they are using full cutoff Fixtures. Also, verify the catalog # for the
building inounted lighting in the table (should be TWRC: not KL.F2).
4) Maximum Foot - Candles. The maximum foot - candle allowed at any propertv line used for
residential purposes is 0.2. The site plan needs to show the lighting levels to all property lines and it
appears that some of the areas exceed the maximum lighting levels.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the Final plan
for approval. Comment sheets are required from the following agencies: the Virginia Department of
Transportation, the Frederick County InspectiOns Department, the Fred rick County Engineer, the Frederick
County Fite Marshal, the Frederick County Sanitation Authoe:ty and the Frederick County G.LS.
Department.

Dear Ms. Perkins:
The comments from the Frederick County Department of Planning and Development
regarding the above - referenced project have been appropriately addressed on the revised site plan
documents that accompanies this letter. The comments have been addressed as follows:
Department of Planning and Development:
1. The plat has been prepared and approved by the review agencies awaiting
signature by the Zoning Administrator.
2. The MDP is awaiting signature for final approval.
3. A lighting plan has been added and is indicated on sheet 21 of 21.
4. The general notes have been revised accordingly, as indicated on sheet 1.
5. The building has been appropriately labeled to be removed.
6 & 7. The sidewalks have been revised accordingly to the existing site conditions.
8. The developer has reviewed this proposal and does feel an additional dumpster
is necessary. This is based on similar facilities owned by the developer and the
amount of refuse produced. The developer will monitor this concern and will
adjust the frequency that it needs to be dumped to ensure that the residents' needs
are satisfied.
9. The handicapped spaces have been striped.
10. The landscaping plan has been revised accordingly.

Review Comments:
1) Lot Consolidation. A consolidation of parcels 64C -A -8 and 64C -1 -15 needs to be
completed before the site plan can be approved.
2) Master Development Plan. The MDP for this project needs to be administratively approved
before the site plan can be approved.
3) Photometric Plan — Outdoor Lighting. This development is proposing outdoor lighting
and, therefore, a photometric plan is required. The outdoor lighting requirements can be
found in § 165- 201.07 of the Zoning Ordinance.
4) General Notes. On the coversheet under general notes, revise the following:
• Under #9, reference that the berm for the road efficiency buffer has been waived by the
Board of Supervisors.
• Under #9, revise "parking lot landscaping" to "perimeter lan dscaping ".
• Under #9, interior parking also requires one tree per ten parking spaces.
• Under #9, the residential separation buffer sections do not contain tree calculation figures
similar to the other landscaping categories.
5) Existing Conditions. On sheet 2, one structure needs to be labeled TBR.
6) Sidewalks. As indicated on sheet 3, additional sidewalks need to be provided within the
development connecting the Route 522 sidewalk to the development. Access to the
recreational area also needs to be provided.

7) Route 522 Entrance and Sidewalk. Sheet 3 shows the existing concrete entrance remaining
and the sidewalk stopping. The entrance needs to be removed and the sidewalk continued as
indicated on sheet 3.
8) Dumpster Facility. The site only shows one dumpster site that is being shared by the three
buildings which is located a distance from building A. An additional dumpster should be
considered to ensure they are appropriately utilized and accessible to all residents.
9) Handicap Spaces. On sheet 3, the loading areas for the HC spaces have not been striped.
10) Landscaping Plan. On sheet 8, revise the following:
• The fencing note shows sheet 15 but the fence detail is on sheet 16 (the fencing detail is
also only labeled for the dumpster; expand to also state screening fence).
• A fence needs to be provided along the southern property line.
• Under the landscaping notes, an old Zoning Ordinance reference is used. Revise to show
the new format.
• The parking lot screening shrubs shown in parking lot A are unnecessary because the
residential separation buffer is required to have a fence.
• The screening fence for the northern property line appears to go right over the large
existing tree.
• Interior parking lot trees need to be shown (1 tree /10 parking spaces).
• Clarify the residential separation buffer plant numbers (coversheet and sheet 8).
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for approval. Comment sheets are required from the following agencies: the
Virginia Department of Transportation, the Frederick County Inspections Department, the Frederick
