FREDERICK COUNTY BOARD OF SUPERVISORS
Action:
BOARD OF SUPERVISORS: DECEMBER 8, 2004 IKl APPROVED 0 DENIED
WHEREAS, it appears to the Board that a 0.25865 acre portion ofthe Sulky Drive cul-de-sac, located
in the Battlefield Subdivision in the Back Creek Magisterial District, serves no public necessity and has never
been part of the Secondary System of State Highways; and,
WHEREAS, the Board has been provided with an email dated October 29,2004 from the Virginia
Department of Transportation, approving the Vacation of the Boundary Lines, which is hereby incorporated
herein by reference; and (
WHEREAS, that 0.7346 acre portion, designated as "New Dedicated Area" on said plat for a public
turn-around area at the terminal of Sulky Drive, now serves the same citizens as that portion of the cul-de-sac
identified to be abandoned and that portion to be abandoned no longer serves a public need.
NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of the County of
Frederick Virginia does hereby abandon from the Secondary System of State Highways the 0.25865 acre portion
of the Sulky Drive cul-de-sac, located in the Battlefield Subdivision in the Back Creek Magisterial District,
identified on the aforementioned plat, pursuant to Section 33.1-155, ofthe Code of Virginia, as an1ended; and
BE IT FINALLY RESOLVED, that a certified copy of this resolution be forwarded to the
Resident Engineer for the Virginia Department of Transportation.

Living Trust established by Richard G. Hardison and Kathleen A. Hardison on June 18,
1998, unrecorded and identified as Richard G. Hardison Revocable Living Trust and the
Kathleen A. Hardison Revocable Living Trust, parties of the second part, hereinafter
called the Grantees.
WHEREAS, following a public hearing duly advertised and held by the Board of
Supervisors of Frederick County, Virginia on the 8th day of December, 2004, such Board
duly passed a Resolution directing this conveyance on behalf of the County of Frederick,
Virginia, and authorized John R. Riley, Jr., County Administrator, to execute this Deed
on behalf of the County of Frederick, Virginia.

This is a portion of the same land which was dedicated to the County of Frederick

by Deed of Dedication of record in the Clerk's Office ofthe Circuit Court of Frederick
County, Virginia, in Deed Book 854 at Page 1572 and in Deed Book 692 at Page 491.
The party of the second part, joins in the execution of this Deed to Dedicate that
certain 20- foot storm drainage easement over the tract ofland herein conveyed and further
dedicates a certain 20- foot storm drainage easement running from the terminus of Sulky
Drive, along the southwestern comer of the subject property and the southern boundary
of the subject property, all of which is shown on the aforesaid plat of survey drawn by'H.
Bruce Edens, CLS, dated June 2, 2004, attached hereto and by this reference made a part
hereof as if set out in full.
The party of the second part does further dedicate to the County of Frederick a
certain area containing .07346 acre, as shown on the aforesaid plat drawn by H. Bruce
Edens, CLS dated June 2,2004, and designated as "New Dedicated Area" on said plat for
a public turn-around area at the terminal of Sulky Drive.
Further shown on said plat is the Vacation of the 20-foot storm drainage easemehts
also shown on the aforesaid plat drawn by H. Bruce Edens, CLS and dated June 2, 2004.
This conveyance is made subject to all rights of way and restrictions of record
affecting the subject property.

Vacation of Sulky Drive Cul-de-Sac

Staff has received a request for the Board of Supervisors to approve the conveyance of its right-of-way
interest in that certain parcel ofland containing 0.25865 acres and being a portion of the Sulky Drive cul-
de-sac. The request is necessitated by Richard Hardison and Kathleen A. Hardison.
The plat showing Vacation and Rededication of Right-of- Way and Easements of a Portion of Sulky Drive
is attached to this memo as "Exhibit A". The proposed Quit Claim Deed is labeled "Exhibit B".
The area of Sulky Drive cul-de-sac requested to be vacated contains 0.25865 acres and is a portion of the
Sulky Drive cul-de-sac, located in the Battlefield Subdivision in the Back Creek Magisterial District.
The subject area of vacation request is unimproved and has been maintained by the adjoining property
owners throughout time. The Virginia Department of Transportation finds the vacation of the boundary
lines acceptable.
Approval of the road abandonment resolution is requested. Staff is available to answer any questions.
