021-04 RESOLUTION BY THE FREDERICK COUNTY BOARD OF SUPERVISORS Action: BOARD OF SUPERVISORS: September 22, 2004 !Il APPROVED 0 DENIED WHEREAS, Warrior Drive is identified in the Frederick County 2003 Comprehensive Policy Plan and the Winchester Area Transportation Study (W A TS) as a major roadway serving the eastern portion of Frederick County; and, WHEREAS, it appears that a future intersection of Warrior Drive (Route 719) and Macedonia Church Road (Route 756) may not provide a significant benefit to the traveling public, yet may create a dangerous intersection; and, WHEREAS, the developer of the Wakeland Manor development has provided the Board with a road alignment and improvements sketch dated August 2004 depicting changes to Macedonia Church Road, which sketch is titled "Macedonia Church Road Right-of-Way Abandonment Exhibit", which is hereby incorporated herein by reference; and, WHEREAS, two existing public roads, Queens Way (Route 740) and Maryland Drive (Route 1460), will continue to provide the residents of Macedonia Church Road (Route 756) access to Tasker Road (Route 642) and the future Warrior Drive (Route 719) and those portions to be abandoned no longer serve a public need. NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of the County of Frederick Virginia does hereby abandon from the Secondary System of State Highways the portion of Route 756 identified on the aforementioned sketch, pursuant to Section 33.1-155, of the Code of Virginia, as amended; and BE IT FINALLY RESOLVED, that a certified copy of this resolution be forwarded to the Resident Engineer for the Virginia Department of Transportation. Lawrence, AICP, Planning Director ~'V RE: Public Hearing: Macedonia Church Road Abandonment and Conveyance DATE: September 15,2004 In working to implement and foster the construction of Warrior Drive, north of its current intersection with Tasker Road, it is appropriate that the County consider a proposal to abandon a portion of Macedonia Church Road. The abandonment will result in the construction of cul-de-sacs on Macedonia Church Road at its future intersection with Warrior Drive. Please refer to the attached illustrative for details regarding the cul-de-sacing of Macedonia Church Road. The cul-de-sac is consistent with previous plans for the extension of Warrior Drive. Following the public hearing, it would be appropriate to take action on this request by forwarding a resolution to the Virginia Department of Transportation. Background Warrior Drive has been identified in the Frederick County 2003 Comprehensive Policy Plan's Eastern Road Plan and the Winchester Area Transportation Study (W ATS) as a major north-south thoroughfare. More specifically, the Eastern Road Plan has identified Warrior Drive as a Major Collector Road ultimately linking Fairfax Pike (Route 277) with the vicinity of Millwood Pike (Route 50). Warrior Drive, at build-out, will ultimately intersect with Tasker Road, Crosspointe Boulevard, Papermill Road, and Front Royal Pike. Phased Construction As part of the development of the Wakeland Manor residential project, the developer (Centex Homes) is responsible for constructing a two-lane section of Warrior Drive across the limits of the project. The developer has agreed to construct Warrior Drive from its current terminus at Tasker Road, north across the Wakeland Manor project. The constructed portion of Warrior Drive will be terminated approximately 300 feet south of the Opequon Creek. Macedonia Church Road abandonment and conveyance As proposed: Macedonia Church Road (Route 756) in its current location would intersect with an extended Warrior Drive (Route 719). The proposed northern extension of Warrior Drive does not enable a connection with Macedonia Church Road. Future cul-de-sacs would be established for both the eastern and western segments of Macedonia Church Road (Route 756). The proposed abandonment would include the conveyance by Frederick County of its right-of-way interests in the land currently within the right-of-way of Macedonian Church Road, consisting of252 linear feet of right-of-way extending 652 feet east of the intersection with Queens Way (Route 740) to 1241 feet west of the intersection of Owens Lane (Route 1460) per Section 33.1-151 of the Code of Virginia. 107 North Kent Street .
