BUS LC Property-Application to designate +/-37.35 acres from "Business" to "Recreation". 3. Carmeuse Lime & Stone -Application to designate +/-47.58 acres from ''Industrial" and "Heavy Industrial" to "Extractive Mining". 4. KSS LC Property-Application to designate +/-30.10 acres from "Business" to "Recreation". WHEREAS, the Frederick County Board of Supervisors finds it appropriate in the public necessity, convenience, general welfare, and good planning practice to direct staff and the Comprehensive Plans and Programs Committee (CPPC) to study the aforementioned requests further; NOW, THEREFORE, BE IT REQUESTED by the Frederick County Board of Supervisors that the Frederick County Planning Commission shall hold the necessary public hearings to consider amendments to the Comprehensive Plan. Wells Aye A COPV AITEST Frederick County Administrator No. 001-26 COUNTY of FREDERICK Department of Planning and Development 540/ 665-5651 Fax: 540/ 665-6395 107 North Kent Street, Suite 202 • Winchester, Virginia 22601-5000 MEMORANDUM TO: Frederick County Board of Supervisors FROM: Planning and Development Staff RE: 2026 Comprehensive Policy Plan Amendment (CPPA) – Consent Amendments DATE: June 24, 2026 Background: This memo summarizes the 2026 Comprehensive Policy Plan Amendments (CPPA) reviewed at the Board of Supervisors and Planning Commission June 17th Joint Work Session and had a consensus to authorize for further study. The CPPA process allows owners and developers to modify adopted Comprehensive Plan (2021*) policies, text (area plans), and maps. CPPAs are not rezonings, they are a land use planning exercise and otherwise conceptual. That being said, the Comprehensive Planned land use and text is consulted in the consideration of a wide variety of land use actions (rezoning, conditional use permits, conservation easements, etc.). When reviewing CPPA requests, the County should determine whether the applicants have demonstrated that a change in the land use designation, density, or intensity would be appropriate using the following criteria: • Would the proposal benefit the public health, safety, and welfare? • Is the proposal consistent with the “Goals, Objectives, and Policies” of the Comprehensive Plan? • Will the proposal not be detrimental to the use of properties in the immediate vicinity of the subject property? • Does the proposal have merit and value for the community as a whole? • Will the proposal result in benefits (fiscal, aesthetic, employment, etc.) that will outweigh any significant impact of the change? *The Comprehensive Plan is currently being updated, with an anticipated completion of Fall 2027. Authorizing the amendments to proceed will result in the applicants paying the application fee ($3,000) and the application materials will be forwarded for agency review and comments. Following this, they will proceed through the Historic Resources Advisory Board (HRAB) and the Comprehensive Plans and Programs Committee (CPPC). Page 2 of 3 Attached you will find supporting documentation for the requested plan amendment, including the application, proposed plan and map changes, location maps, and other supporting materials. An informal consensus vote was held at the June 17th work session. Formal action must still be taken by the Board of Supervisors at an advertised meeting. The applications with the supporting vote count from the work session are below. 2026 Requests: Project Name Description Magisterial District AMK Properties This is a request to amend the Comprehensive Plan and designate the future planned land use of +/-99.25-acres of property from “industrial” and “residential, 4 units per acre” to “Sensitive Natural Areas”. The properties are presently zoned RA (Rural Areas) and M1 (Light Industrial), and the current use is agricultural and vacant. The properties are located on the south side of Airport Road between Tailspin Circle and at 846 Airport Road. Shawnee BHS LC Property This is a request to amend the Comprehensive Plan and designate the future planned land use of +/-37.35-acres of property from “business” to “recreation”. The property is presently zoned RA (Rural Areas), and the current use is agricultural. The property is located on the west side of Echo Lane. Gainesboro Carmeuse Lime & Stone This is a request to amend the Comprehensive Plan and designate the future planned land use of +/-47.58-acres of property from “industrial” and “heavy industrial” to “extractive mining”. The properties are presently zoned RA (Rural Areas), and the current uses are residential and vacant . The properties are located at 271 Branson Spring Rd, Clear Brook, west of 271 Branson Spring Dr and north of Branson Spring Rd., 2619 Woodside Rd, Clear Brook, and east of 2619 Woodside Rd and south of Branson Spring Rd. Stonewall KSS LC property This is a request to amend the Comprehensive Plan and designate the future planned land use of +/-30.10-acres of property from “business” to “recreation”. The property is presently zoned RA (Rural Areas), and the current use is agricultural. The property is located Gainesboro Page 3 of 3 past Procession Way, north of Retail Boulevard, and between Wal-Mart (501 Walmart Dr) and the Village at Orchard Ridge (100 Procession Way). Requested Action: Staff is seeking action by the Board to authorize staff to advertise the CPPA for public hearing following further study. Applications for Comprehensive Plan amendment consideration must be received in the Planning Department no la1er than June 1st. A copy of the application fom, is attached. (Please note that while a single application may include multiple parcels, these parcels should be cont;guous and be part of the same request). Out of cycle amendments may be considered if their Is consensus from the Board of Supervisors. Please respond in full to those questions that pertain to the particular map, text, or both map and text amendment(s) you are requesting. Incomplete applications will not be considered. Please note that this is not a rezoning application and detailed information, such as floor plans and building elevations, are discouraged. All applications will be reviewed first at a work session of the Board of Supervisors and Planning Commission. Applications deemed to have merit at this work session may be selected for additional study. Following the work session, Planning Department staff wilf accept the fee check, and distribute (electronically) the application materials for a 30-day agency comment period, induding review by the Historic Resources Advisory Board (HRAB). Following receipt of agency comments, the Applicant may chose to further amend the application and once complete the application wilt be forwarded to the Comprehensive Plans and Programs Committee (CPPC) for review and further policy development Fallowing CPPC study, the application will be sent to the Planning Commission and Board of Supervisors for discussion and public hearing. Th& Board of Supervisors will ultimately decide whether to accept the Comprehensive Plan amendment application or dany the request. Applicants should consult the Comprehensive Plan to identify goals, policies or action strategies which are applicable to individual Comprehensive Plan amendment requests. A pre- applicatlon meeting is highly recommended to prepare a complete and accurate application. Introduction 0-N Minerals (Chemstone) Company, dba Carmeuse Lime & Stone ("Canneuse" or the "Applicant") is the owner of one parcel of land identified as Frederick County Tax Map Parcel 34-1-B and the contract purchaser of three parcels of land identified as Frederick County Tax Map Parcels 34-A-8, 34-A-8B, and 33- A-87C (collectively, the "Subject Parcels") located north and south of Branson Spring Road and due east of Martinsburg Pike in the Stonewall District of Frederick County. In this application, the Applicant proposes map amendments to the Frederick County Comprehensive Plan ("Plan") and components of the Plan identified as the Northeast Frederick Land Use Plan ("NELUP") that are applicable to the Subject Parcels. Specifically, the Applicant proposes that that the NELUP maps in the Plan be amended such that the Subject Parcels are planned for "Extractive Mining" use, instead of the "Heavy Industrial" and "Industrial" planning designations as currently depicted on those maps. In accordance with the Comprehensive Plan Map Amendment Application requirements, an Existing Characteristics Analysis for properties within one half- mile of the Subject Parcels is provided below. II. Existing Characteristics Analysis To the immediate west of the Subject Parcels, there is an electrical substation and a railway. Across that railway further west are Clearbrook Storage, B&B Electrical Systems, and single-family detached homes across Martinsburg Pike, along with a commercial building which appears to be a distribution warehouse. The NELUP designates the properties to the west of the Subject Parcels as a mixture of the "Industrial," "Business," and "Mixed Use Industrial/Office" land uses. To the immediate south are properties owned by the Applicant, and which have been developed as a quarry. Titan Virginia Ready-Mix is located further south. 5093675v2 / 114 74-2 The NELUP designates the properties to the south of the Subject Parcels as the "Extractive Mining" land use. To the east of the Subject Parcels are properties owned by the Applicant and which are either undeveloped or which have been developed with single-family detached homes. Properties to the east of the Subject Parcels are designated as a combination of "Warehouse," "Heavy Industrial," and "Industrial" land uses by the NELUP. To the northeast of the Subject Parcels is a property which is owned by the Applicant, and which appears to have a barn or similar structure, but is largely undeveloped. Further northwest of the Subject Parcels is a railway, across which are multiple warehouses, along with other undeveloped properties. Further north and northwest, there are multiple smaller properties which have been developed into single-family detached homes along Martinsburg Pike. These properties are designated as a combination of "Industrial" and "Mixed Use Industrial/Office" land uses by the NEL UP. The Plan maps in the NELUP currently recommend "Industrial" uses for those Subject Parcels north of Branson Spring Road and "Heavy Industrial" uses for those Subject Parcels south of Branson Spring Road. The NELUP "Industrial" use extends generally north and northwest, with further properties planned to the "Mixed Use Industrial/Office" use. Properties to the northeast, east, southeast, and south are generally zoned EM, with properties to the north, northwest, west, and southwest zoned to a combination of Rural Areas -RA, Light Industrial -M 1, and Industrial Transition -B3. The Plan recommends supporting and protecting mining as a primary industry so long as the large limestone quarry to the east of Martinsburg Pike remains productive. Amending the Plan to reflect a change from "Heavy Industrial" and "Industrial" to "Extractive Mining" aligns with the stated goals of the Plan by fostering the development of a primary industry within Frederick County adjacent to an area already planned to the "Extractive Mining" use, zoned to that use, and currently operating under that use. lll. Conclusion 5093675v2 / I 1474-2 The Applicant believes that a "Extractive Mining" planning designation for the Subject Parcels on the NELUP maps would support and protect a primary industry within Frederick County, and would pennit a future rezoning of the Subject Parcels to the EM zoning district, and that this designation is more in keeping with the development pattern of the surrqunding properties than the current "Heavy Industrial" and "Industrial" designations. The Applicant believes that continuing deve]opment of the existing quarry use would be more appropriate than those use s permitted under the "Heavy Industrial" or "Industrial" designations. This proposed amendment to the Plan supports the stated goals of the Plan while permitting the growth of a targeted industry in Frederick County. In this application, the Applicant proposes map amendments to the Frederick County Comprehensive Plan ("Plan") and components of the Plan identified as the Northeast Frederick Land Use Plan ("NELUP") that are applicable to the Subject Parcels. Specifically, the Applicant proposes that that the NELUP maps in the Plan be amended such that the Subject Parcels are planned for "Extractive Mining" use, instead of the "Heavy Industrial" and "Industrial" planning designations as currently depicted in those maps. The Applicant would first note that its proposed amendment furthers the goals set out in the NELUP, which lists Extractive Manufacturing Areas as a primary industry. The Applicant believes that a change in the land use planning designation of the Subject Parcels from Heavy Industrial and Industrial to Extractive Mining would better accomplish the overall goals and intent of the Plan. The NELUP states that mining should be supported and protected as long as the quarries remain productive. The proposed Plan amendment would allow for a future rezoning of the Subject Parcels from their current zoning of Rural Areas to Extractive Mining. This proposed map amendment furthers the Plan's goal further encouraging the development of targeted industries in the County, such as Extractive Manufacturing. The Applicant 's proposed amendment to the Plan to allow for an EM planning designation on the Subject Parcels, adjacent to an existing and thriving EM use, will 5093322vl / 11 474-2 enhance its ability grow a strong, attractive, tax-base-enhancing development to the Subject Parcels. Proposed Map Amendment to the Plan: The Applicant has filed with this application a proposed revision to the NELUP map showing: the proposed EM planning designation on the Subject Parcels instead of the current "Heavy Industrial" and "Industrial" planning designations. As discussed above, this amendment to the NELUP map will support a future application to rezone the Subject Parcels from RA to EM, and will ensure that such future rezoning is consistent with the Comprehensive Plan. Trip Generation Analy sis According to the Trip Generation Manual, 6th Edition prepared by the Institute of Transportation Engineers ("ITE Manual"), a General Heavy Industrial use (ITE Code 120) is anticipated to generate an average rate of 6.75 trip s per acre on a given weekday, an av erage rate of 6.41 trips per acre during the weekday A.M . peak hour of generator ("Morning Peak Hour"), and an average rate of 4.22 trips per acre during the weekday peak hour of generator ("Evening Peak Hour"). No weekend data was provided. Applied to the 39 acres of the Subject Parcels that are planned to the "Heavy Industrial" planning designation, this would equate to 509485 6v l / 11 474-2 approximately 263 trips per given weekday, 250 trips during the Morning Peak Hour, and 165 trips during the Evening Peak Hour. The ITE Manual does not list a generalized "Industrial" use for trip calculation; as such, the Applicant has used the Industrial Park use (ITE Code 130) as an analogue. An Industrial Park use is anticipated to generate an average rate of 63.11 trips per acre on a given weekday, an average rate of 8.29 trips per acre during the Morning Peak Hour, an average rate of 8.67 trips per acre during the Evening Peak Hour, an average of 34.23 trips on a given Saturday, an average of 4.71 trips per acre during the Saturday peak hour of generator ("Saturday Peak Hour"), 10.11 trips per acre on a given Sunday, and 0 .99 trips per acre during the Sunday peak hour of generator ("Sunday Peak Hour"). Applied to the 8 .58 acres of the Subject Parcels that are planned to the "Industrial" planning designation, this would equate to approximately 541 trips per given weekday, 71 trips during the Morning Peak Hour, 74 trips during the Evening Peak Hour, 294 trips on a given Saturday, 40 trips during the Saturday Peak Hour, 87 trips on a given Sunday, and 8 trips during the Sunday Peak Hour. The ITE Manual does not list an "Extractive Mining" use for trip calculation. The Applicant believes that the descriptor for "General Heavy Industrial" most accurately describes the proposed planning designation. However, the Applicant would note that while "General Heavy Industrial" may describe the characteristics of the use, the ITE Manual states that heavy industrial facilities usually have a large number of employees, which is not applicable to extractive mining uses, as such uses typically have a smaller number of employees than heavy industrial uses which are focused on the manufacture oflarge items. While the ITE manual would characterize the trips generated as equivalent between "Heavy Industrial" and Extractive Manufacturing, the Applicant believes that its use will generate significantly fewer trips than the projected amount in the ITE manual. However, given the comparison above between "General Heavy Industrial" and "Industrial Park," it would appear that the worst-case scenario for trips generated would be significantly fewer trips than the "Industrial Park" use and an equivalent number to the "General Heavy Industrial" use if the Subject Parcels are remapped to the "Extractive Mining" use. III. Conclusion Based on the ITE Manual, the Applicant's proposed remapping of the Subject Parcels from the "Heavy Industrial" and "Industrial" planned uses to the "Extractive Mining" planned use would, at worst, generate an equivalent number of trips for those Subject Parcels planned to the "Heavy Industrial" planned use, and significantly fewer trips for those Subject Parcels planned to the "Industrial" planned use.
