HomeMy WebLinkAbout089-26 (StephensCity-FrederickCoBoundaryLineAdjustment) Action: BOARD OF SUPERVISORS: May 13,2026 Adopted RESOLUTION TO APPROVE AN AGREEMENT BETWEEN THE COUNTY OF FREDERICK AND THE TOWN OF STEPHENS CITY,A BOUNDARY LINE ADJUSTMENT WHEREAS,a certain parcel of land is located straddling the existing corporate limits of the Town of Stephens City,Virginia,totaling 10.0319 acres, of which 6.7289 acres lie within the Town and 3.3030 acres lie outside the Town within Frederick County, further described on the Exhibit Plat prepared by Greenway Engineering on March 19,2026, a copy of which is attached hereto as Exhibit A and made a part hereof; and WHEREAS,the Town desires to provide services to the parcels and the affected property owners have agreed to be brought into the Town; and WHEREAS,the Town of Stephens City,pursuant to authority granted to it under Code of Virginia§15.2-3106, as amended,desires to enter into an agreement to change the boundary line at the location of the subject parcel to place the parcel wholly within the Town; and WHEREAS,the Town held a public hearing in accordance with Code of Virginia§15.2-3107,as amended,on April 7,2026,and at that meeting resolved to approve an agreement between the County of Frederick and the Town of Stephens City to conduct a.Boundary Line Adjustment for the parcel in question;and WHEREAS, Frederick County held a public hearing on May 13, 2026, on the Agreement to Change the Boundary Line,a copy of which is attached hereto as Exhibit B and made a part hereof;and NOW, THEREFORE, BE IT RESOLVED that the Frederick County Board of Supervisors approves the Agreement to Change the Boundary Line between the County and the Town. Fox, County Attorney DATE: May 12, 2026 RE: Boundary Adjustment—Passage Lane, Stephens City This Resolution authorizes an Agreement between the County and Stephens City for a minor boundary adjustment concerning an approximately ten-acre property located at 5145 Passage Lane, Tax Map 74-A-44, whereby approximately three acres currently situated in Frederick County would fall within the adjusted boundary of Stephens City. Maps and drawings showing the boundary line adjustment are attached to the Resolution. The Stephens City Town Council authorized the Agreement at its April 7, 2026,business meeting after advertising and conducting a public hearing. Upon approval and execution,the Agreement will be presented to the Frederick County Circuit Court for approval and recordation. Petition for a Jurisdictional Boundary Adjustment Petitioners,Margaret J. Wolfrays,Trustee, Helen Pyne, and Louis C. Carbaugh own this parcel.The Town of Stephens City,Virginia, a Virginia municipal corporation, and the County of Frederick,Virginia, a Virginia political subdivision,by counsel,join the Petitioners to request that the Court relocate and change the boundary line between the two jurisdictions regarding one property. In support of this Petition the parties state as follows: 1. This parcel of land,along with several others adjoining,have made up a family farm held for well over 120 years. Most of the family farm is now a solar farm.The parcel in question,tax map 741 A14411, is made up of 10.0319 acres. Approximately 67%of the parcel is in the Town limits and approximately 33% is only in Frederick County. Improvements on the property are within the existing Town limits.A copy of the plat of this property is attached as Exhibit A. 2. With the passing of senior members of the Carbaugh family,the heirs desire to bring the parcel completely into the Town as they work through their divided ownership. This Petition was initiated by and is at the request of the property owner, and the County and Town are working together to satisfy the request. 3. The property owners, and the two localities,have entered into a Boundary Line Adjustment Agreement("Agreement") in accordance with Virginia Code § 15.2-3106. A copy of this agreement is attached as Exhibit B. Page 1 of 3 4. The Town of Stephens City and Frederick County each advertised their intention to approve the Agreement by running a notice of public hearing once a week for two successive weeks in a newspaper having general circulation in the Town of Stephens City and Frederick County as required under Virginia Code Section 15.2-3107. The Town of Stephens City advertised for two successive weeks in the Northern Virginia Daily. Frederick County advertised for two successive weeks in the Winchester Star. The notices included a descriptive summary of the proposed agreement,the new boundary,and a statement that a copy of the proposed agreement was on file in the Town and County offices. The property owners have agreed to reimburse the localities for this advertising expense. 5. Following publication and service of the notice,the Town of Stephens City and Frederick County each held a public hearing on the proposed agreement in accordance with Virginia Code § 15.2-3107(A).The Town of Stephens City held its public hearing on ,while Frederick County's hearing was held. on 6. The parties represent to this Court that the procedures required by Virginia Code §15.2-31 Q6 and 15.2-3147 have been complied with and this Petition is in proper order. 7. Wolfrays, Trustee, Helen Ryne, and Louis C. Carbaugh, parties of the third part. WITNESSETH: WHEREAS, the Carbaugh family has owned a family farm property known as tax map 74-A-44 in the Frederick County area for well over 120 years. The parcel is located slightly mare than 67% within the Town of Stephens City boundaries and just under 33% within 'Frederick County. WHEREAS, with the passing of one of the senior Carbaughs,the family desires to consolidate this parcel into one jurisdiction. They approached both jurisdictions requesting a boundary adjustment. As the primary structures on the parcel are all within the Town limits, the family asks that the County and the Town grant its request to place all 10.0319 acres of this single parcel within the Town limits by way of a agreed boundary adjustment. The property owners understand that all lands within the Town of Stephens City are also a part of Frederick County for purposes of certain taxes, and for receipt of certain services such as schools and they understand the implications of coming into the Town limits entirely. WHEREAS, Section 15.2-3106 of the Code of Virginia of 1950, as amended, authorizes Virginia Counties and Towns to change the boundary lines existing between them by agreement in accord with the specified statutory procedures contained therein; and WHEREAS,the Town and the County consider the property owner's request for the parcel to be incorporated into the Town to be in accord with the policies and guide-lines of the comprehensive plans of both the Town of Stephens City, Virginia, and the County of Frederick, Virginia, and furthering the best interests of the citizens of the Town, the County and the Commonwealth of Virginia; NOW,THEREFORE, the parties hereto hereby agree as follows: 1. The Town and the County will conduct the requisite public hearing on this boundary adjustment after proper notice to the public. Following the public hearings the Board and Council of the respective jurisdictions will Vote for their approval or denial of the request. If approved by both jurisdictions, the new boundary line for this parcel is to be established is as more particularly described in its tax map number metes and bounds description and the exact boundaries of the parcel are as outlined on the attached survey from Greenway Engineering. 2. If approved by bath localities the Frederick County Attorney and the Stephens City Town Attorney are hereby authorized to act on behalf of the County and the Town, respectively, to prepare, file, and sign any documents, pleadings, and Orders necessary to ensure that a Court Order designating and establishing the new boundary line in accordance with this agreement be entered by the Court in accordance with Section 15.2-3106 of the Code of Virginia of 1950 as amended. The parcel is located slightly more than 67% within the Town of Stephens City boundaries and just under 33% • within Frederick County. WHEREAS, with the passing of one of the senior Carbaughs, the family desires to consolidate this parcel into one jurisdiction. They approached both the Town of Stephens City and Frederick County Virginia requesting a boundary adjustment. As the primary structures on the parcel are all within the Town limits, the family asks that the County and the Town grant its request to place all 10.0319 acres of this single parcel within the Town limits by way of an agreed boundary adjustment. The property owners understand that all lands within the Town of Stephens City are also a part of Frederick County for purposes of certain taxes, and for receipt of certain services such as schools and they understand the implications of coming into the Town limits entirely. WHEREAS, Section 15.2-3106 of the Code of Virginia of 1950, as amended, authorizes Virginia Counties and Towns to change the boundary lines existing between them by agreement in accord with the specified statutory procedures contained therein; and WHEREAS, the Town conducted a public hearing on the boundary adjustment, following proper advertisement and notice on April 7, 2026 and favorably considers the property owner's request for the parcel to be incorporated into the Town to be in accord with the policies and guidelines of the comprehensive plans of both the Town of Stephens City, Virginia, and the County of Frederick, Virginia, and furthering the best interests of the citizens of the Town, the County and the Commonwealth of Virginia. The Town will sign an agreement with the County, which tracks this language, to proceed with the Boundary Adjustment.
