CITIZEN COMMENTS
Blaine Dunn, Red Bud District, commented on the budget and encouraged the Board to fund the
eight new firefighter positions that had been cut from the budget.

Supervisor Liero made the following statement: 1, Supervisor Robert Thomas Liero of the Shawnee
Magisterial District of the Frederick County, Virginia, Board of Supervisors, would like to disclose for the
record, relative and pursuant to the State and Local Government Conflict of Interests Act, and specifically
pursuant to the Code of Virginia 2.2-3112, B.3., and Code of Virginia 2.2-3115, H., that my wife, Deanna L.
Liero, is employed as a teacher by the Frederick County Public Schools and therefore is a member of a group
who is or may be affected by Board of Supervisors votes on educational related issues, and that I am able to
participate in the transaction fairly, objectively, and in the public interest."

PURSUANT TO SECTION 24.2-701.2 OF THE CODE OF VIRGINIA, A VOTER SATELLITE
OFFICE SHALL BE ESTABLISHED AT 261-263 SUNNYSIDE PLAZA DRIVE, WINCHESTER, VA
22603 - APPROVED
County Attorney Andrew Fox explained that because of planned renovations to the central precinct
early absentee voting location, the Office of Elections/General Registrar will be using the County-owned
space at Sunnyside Plaza to conduct early absentee voting for the August primary elections,with early voting
commencing on June 18,2026. He said State law requires the local governing body to establish by ordinance
any absentee voting location no later than sixty days prior to the election date.

Pursuant to section 24.2-701.2 of the Code of Virginia,a voter satellite office shall be established at 261-
263 Sunnyside Plaza Drive,Winchester,VA 22603,no later than June 18,2026,for the purposes of absentee voting
in person and as the Central Absentee Voting Precinct for the August 2026 primary election.

ORDINANCE TO AMEND THE FREDERICK COUNTY CODE, CHAPTER 158 VEHICLES AND
TRAFFIC,ARTICLE III COUNTY VEHICLE LICENSES, §158-9 FEES. THIS ORDINANCE UPDATES
THE COUNTY CODE TO REFLECT THE ANNUAL VEHICLE LICENSE (DECAL) FEE OF $30 TO
BE ENACTED AS PART OF THE FISCAL YEAR 2027 COUNTY BUDGET—APPROVED
County Attorney Andrew Fox said this ordinance updates the County Code to reflect the annual
vehicle license (decal) fee of$30 to be enacted as part of the Fiscal Year 2027 County budget.

The Board of Supervisors of Frederick County,Virginia,hereby ordains that Frederick County Code,Chapter 158
(Vehicles and Traffic),Article III County Vehicle Licenses, Section 158-9(Fees)be amended as follows(deletions

There is hereby levied and assessed an annual license tax,fee or charge on all such motor vehicles required to be
licensed in the County in the amount of W$30,except motorcycles,for which the license tax,fee or charge is$10,
and except for"antique motor vehicles," as defined and licensed in Title 46.2 of the Code of Virginia, 1950,as
amended,and as provided for herein,and vehicles not registered for use on highways,for which there is no annual
license tax,fee or charge,and further except that such license tax,fee or charge shall in no event be greater than the
amount of the license tax,fee or charge by the commonwealth on such motor vehicles.

PLANNING COMMISSION BUSINESS—PUBLIC HEARINGS
REZONING #02-26 OF PLASTERS HVAC - 161 COMMONWEALTH COURT (WINCHESTER
REAL ESTATE, LLC)—APPROVED
Planner Eric Bittner reviewed the request to rezone approximately 1.21 acres from the B2 (General
Business) Zoning District with proffers to the B3 (Industrial Transition) Zoning District with proffers. He said
the proposed proffers include use restrictions barring gas stations, movie theaters, and parks, as well as a
cash proffer for any new building square footage for impacts to County Fire and Rescue.
Chairman Jewell opened the public comment period.
Leslie Spencer, Gainesboro District, spoke in favor of the proposed additional landscaping included
for the project.

ORDINANCE AMENDING THE ZONING DISTRICT MAP
REZONING#02-26 FOR PLASTERS HVAC
(WINCHESTER REAL ESTATE,LLC)
WHEREAS, REZONING #02-26 of Plasters HVAC (Winchester Real Estate, LLC) was submitted to rezone 1.21+/-
acres from B2 (General Business) Zoning District with proffers to the B3 (Industrial Transition) Zoning District with
proffers to develop an HVAC repair facility. The property is located at 161 Commonwealth Court, Winchester, and is
identified by Property Identification Number 75-A-91E in the Back Creek Magisterial District; and
WHEREAS,the Frederick County Planning Commission held a public hearing on this rezoning on March 18,2026,
and recommended approval; and
WHEREAS,the Frederick County Board of Supervisors held a public hearing on April 8,2026; and
WHEREAS,the Frederick County Board of Supervisors finds the approval of this rezoning to be in the best interest
of public health,safety,and welfare,and in conformance with the Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors, that Chapter 165 of the
Frederick County Code, Zoning, the Zoning District Map is amended in accordance with Rezoning #02-26 of Plasters
HVAC(Winchester Real Estate,LLC)submitted to rezone 1.21+/-acres from B2(General Business)Zoning District with
proffers to the B3(Industrial Transition)Zoning District with proffers dated January 16,2026.The conditions voluntarily
proffered in writing by the Applicant and the Property Owner are attached.

REVOCATION OF CONDITIONAL USE PERMIT#03-24 FOR (A CUT ABOVE) —APPROVED
Mark Cheran, Zoning Administrator, reviewed the timeline of violations of approved CUP#03-24. He
said the Planning Commission held a public hearing at their regular meeting on March 18, 2026, regarding
the CUP, and recommended that the CUP#03-24 be revoked.
The Board and staff discussed the timeline and the applicant's failure to have a minor site plan
approved before commencing business under the CUP.
Stephen Pettler of Harrison and Johnson, representing the business holder of the CUP, said that the
business is working through the process to address the violations and should be given additional time to
complete the necessary tasks and have the minor site plan approved.
The Board and Mr. Pettler discussed the request for additional time and the Board's role in revoking
the CUP.

Rocky Keplinger, Back Creek District, spoke in favor of the revocation because of the applicant's
violations, which have affected his adjacent property.

violations, which have affected his adjacent property.

Supervisor Orndorff moved to revoke CONDITIONAL USE PERMIT#03-24 FOR (A CUT ABOVE).
Supervisor Oates seconded the motion.
The Board discussed whether there were any intervening options other than revocation and the
relative ease of acquiring the minor site plan approval.

ORDINANCE REVOKING CONDITIONAL USE PERMIT#03-24
172 FIREHOUSE LANE LLC
(BARBARA SINGHAS)
WHEREAS, REVOCATION OF CONDITIONAL USE PERMIT #03-24 for 172 Fire House LLC and Barbara
Singhas (A Cut Above) was considered due to the violation of condition #4 from Conditional Use Permit#03-24,
which pertains to receiving approval of a minor site plan prior to establishing the use. The property is located at 171
Old Firehouse Lane,Winchester,and is identified with Property Identification Number 52-A-287B in the Back Creek
Magisterial District; and
WHEREAS, the Frederick County Planning Commission held a public hearing on this conditional use permit on
March 18,2026,and recommended revocation; and
WHEREAS,the Frederick County Board of Supervisors held a public hearing on April 8,2026; and
WHEREAS, the Frederick County Board of Supervisors finds the revocation of this conditional use permit to be in
the best interest of the public health,safety,and welfare,and in conformance with the Comprehensive Plan;
NOW,THEREFORE,BE IT ORDAINED by the Frederick County Board of Supervisors,that in accordance with Chapter
165 of the Frederick County Code, Zoning, Conditional Use Permit#03-24 for 172 Firehouse Lane LLC and Barbara
Singhas (A Cut Above) for a landscape contracting business on the parcel identified with Property Identification
Number52-A-28 7B is revoked.

Deputy County Administrator Jay Tibbs reviewed the two resolution options with version`A', including
a real estate tax rate of$0.05 per$100 of assessed value, and version `B', including a real estate tax rate of
$ 0.04 per$100 of assessed value.

WHEREAS a notice of public hearing and budget synopsis has been published and a public hearing held on
March 25,2026, in accordance with Title 15.2, Chapter 25, Section 15.2-2506, of the Code of Virginia, 1950 as
amended.
THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Frederick, Virginia, that
the budget for the 2026-2027 Fiscal Year as advertised in The Winchester Star on March 17,2026,be hereby approved

BE IT FURTHER RESOLVED that appropriations are hereby authorized for the central stores fund,special
welfare fund,comprehensive services fund,county health insurance fund,school health insurance fund,public schools
grant fund, employee benefits fund,maintenance insurance fund,development project/transportation fund, sales tax
fund, commonwealth sales tax fund, unemployment compensation fund, Forfeited Assets Program, Four-For-Life
Funds,Fire Programs,Peg funds,and Economic Incentive funds equal to the total cash balance on hand at July 1,2026,
plus the total amount of receipts for the fiscal year 2026-2027. The County Capital Projects Fund, County Capital
Reserve Fund, Airport Capital Fund and Fire Company Capital appropriation will include the current year
appropriation plus any unused funds at the end of the fiscal year 2026.The County Capital appropriation shall include
funds transferred from and to other funds for classification and policy purposes.
BE IT FURTHER RESOLVED that construction and development fund projects are appropriated as a
carryforward in the amount that equals the approved original proj ect cost,less expenditures and encumbrances through
June 30,2026.

BE IT FURTHER RESOLVED that, upon receiving notice of unbudgeted grant or program opportunities
offered by various federal, state,local and other outside organizations,the County Administrator or his designee be,
and is hereby,designated as the agent to execute the necessary grant or program application and other documentation,
unless the terms of the grant or program require specific actions by the Board of Supervisors. The funding awarded,
not to exceed$100,000,and not requiring unbudgeted matching funds,and not requiring a continuing obligation,and
not requiring the addition of staff,shall be,and is hereby,appropriated to the applicable functional area.
BE IT FURTHER RESOLVED that, all previously appropriated grants that remain outstanding at
June 30,2026 are re-appropriated to the 2027 fiscal year to the same program for which they were originally
appropriated.
BE IT FURTHER RESOLVED that, upon receiving funds as donations, contributions, reimbursements,
restitution, and/or funds held in trust for specific purpose(s), the County Administrator or his designee be, and is
hereby, authorized to accept the funds, unless the terms of acceptance require specific actions by the Board of
Supervisors. The funding,not to exceed$100,000,and not requiring additional unbudgeted funds,and not requiring
a continuing obligation,and not requiring the addition of staff,shall be,and is hereby appropriated for the purpose(s)
intended.
BE IT FURTHER RESOLVED that,upon receiving funds through insurance claims for damages incurred to
County property, not to exceed $100,000, and not requiring additional unbudgeted funds, shall be, and is hereby
appropriated for the repair and/or replacement of the damaged property.
BE IT FURTHER RESOLVED that,upon receipt of written notification from the State Compensation Board
of additional funds for the Constitutional Officers (Commonwealth's Attorney, Sheriff, Clerk of Circuit Court,
Treasurer,and Commissioner of the Revenue),the County Administrator or his designee be,and is hereby,authorized
to accept the funds,unless the terms required specific actions by the Board of Supervisors,and not requiring additional
unbudgeted local funds,the funding awarded shall be,and are hereby to be appropriated and expended in accordance
with guidelines as established by the state government.
BE IT FURTHER RESOLVED that, the County receives funds per §17.1-279.1 of the Code of Virginia
restricted for the County Sheriff solely to fund software, hardware, and associated equipment costs for the
implementation and maintenance of electronic summons (e-summons) systems, the County Administrator or his
designee be,and is hereby authorized to approve the purchase,shall be,and is hereby appropriated for the purpose(s)
intended.
BE IT FURTHER RESOLVED that funding for all outstanding encumbrances on June 30,2026, are re-
appropriated to the 2026-2027 fiscal year to the same department and account for which they are encumbered in the
2025-2026 fiscal year.

Supervisor Aikens provided an update from the EDA.
CITIZEN COMMENTS
Blaine Dunn, Red Bud District,discussed the Board holding a town hall meeting on data center projects,
and said the public should not accuse the Board members of a conflict of interest regarding data centers.

Leslie Spencer, Gainesboro District, announced a private citizens-sponsored data center information
meeting.
Gary Krause,Shawnee District, said a conversation on data centers is needed and announced a private
citizens-sponsored data center information meeting.
BOARD OF SUPERVISORS COMMENTS
Supervisor Guevremont discussed plans for changes in the County's communications with the
constituents.
Chairman Jewell thanked the Board for its work on the budget.

TRANSPORTATION COMMITTEE REPORT to the BOARD OF SUPERVISORS

ITEMS FOR INFORMATION ONLY:
Smartscale Update: Staff updated the Committee on the Smartscale cycle and preapplications.
The county is in the preapplication window for Smartscale, with up to 4 local applications, plus
additional potential applications via the MPO and Regional Commission. Priority project remains
181 Exit 307, but changes in VDOT's bridge section policies have reduced competitiveness. There
are concerns that VDOT has diminished appetite for blended projects (bridge repair + capacity
improvements). Exit 307 may require higher local funding leverage (possibly above 20%) to be
competitive.
Other potential preapps discussed include:
• Route 522 at Siler Road
• Route 50/Back Mountain Road
• Route 50 West at Stony Hill Road
• Route 522/37/Apple Pie Ridge improvements
• Route 7/Greenwood Road turn lane project
• Winchester Gateway upgrades and Route 7 continuous turnlane concept
• Diverging Diamond Interchange (37 &50) delayed due to new study requirements
County Project Updates: Renaissance Drive:Currently, Staff are waiting for the final invoices from
the contractors. CSX equipment is to be picked up to complete closure and finalize reconciliations
on the project.
Gainesboro Road/Route522 Intersection Project: Surveying has been underway and 30% design
plan set is under review.
Other: Automated Enforcement: The Committee had strong support for expanding automated
enforcement with the school zone speed cameras. They have already produced high violation
counts. Plans to pursue construction zone speed cameras due to upcoming long-term 1-81 works
were discussed as well with adding red-light cameras, which require an ordinance. The desire to

collaborate with VDOT on establishing standards for primary highway safety corridors (Route 7,
Route 50, Route 522).Also discussed were the significant concerns about speeding and dangerous
driving in school areas and major corridors.
