ADDITIONS TO THE 2025-2030 SOUTH FREDERICK AGRICULTURAL &
FORESTAL DISTRICT
WHEREAS,there is a proposal to increase the South Frederick 2025-2030 Agricultural&Forestal District by
942.64-acres. With the additions,the District will contain 6,848.48+/- acres. The properties are located along
Cedar Creek Grade(Route 622),Middle Road(Route 628),Marlboro Road(Route 631)and Hites Road(Route
620) and are identified by Property Identification Numbers 61-A-30, 72-A-22A, 72-A-54A, 73-A-31, 73-A-
66, 73-A-67, 83-A-44, 84-A-1, 85-A-2, 85-A-43, and 85-A-44 in the Back Creek Magisterial District; and
WHEREAS,the Agricultural District Advisory Committee(ADAC)discussed this District's additions at their
meeting on December 16,2025, and recommended approval; and
WHEREAS, the Planning Commission held a public hearing and recommended approval of the additions to
the 2025-2030 South Frederick Agricultural&Forestal District on February 4,2026; and
WHEREAS, the Board of Supervisors held a public hearing on these additions to the 2025-2030 South
Frederick Agricultural&Forestal District on February 25, 2026; and
WHEREAS, the Frederick County Board of Supervisors finds that the additions of the 2025-2030 South
Frederick Agricultural & Forestal District contribute to the conservation and preservation of agricultural and
forestal land in Frederick County;
NOW, THEREFORE, BE IT ORDAINED that the Frederick County Board of Supervisors hereby adopts the
additions to the 2025-2030 South Frederick Agricultural & Forestal District of 6,848.48+/-acres in the Back
Creek Magisterial District,with an expiration date of August 13,2030.The Agricultural&Forestal District is
as described on the attached map dated August 22,2025, and the attached property owners' table.
This ordinance shall be in effect on the day of adoption.

General District Location
This District is located within the Back Creek Magisterial District and is generally located along
Cedar Creek Grade (Route 622), Middle Road (Route 628), Marlboro Road (Route 631) and
Hites Road(Route 625).
State Code Requirements & District History
Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that
Agricultural and Forestal Districts be reviewed by the local government every five years after
establishment. The Board of Supervisors decides to approve, approve with modifications, or
deny the proposal to establish or renew a District. The District was updated in 2025.

District Characteristics:
Agricultural& Forestal Significance:
The agricultural operation in the District is 90 percent agriculture (orchard, and crop harvesting)
and 10 percent open space/woodlands. The area within the District is rural in nature.
Lakes/Ponds/Streams:
The District lies primarily within the Opequon Creek and Stephens Run drainage area. The District
will further assist with managing the quality of the County's water resources.
Prime Agricultural Soil:
The largest amount of prime agricultural soil located within the District is Frederick-Poplimento.
The District generally varies from rolling hills to ridges to the north, west, south and east. This
District lies within Opequon Creek watershed and water is available from ponds, wells and
springs.
Comprehensive Plan:
The Comprehensive Plan for Frederick County provides guidance when considering land use
actions. The District is outside the Urban Development Area(UDA) and Sewer and Water Service
Area (SWSA) and is not part of any land use plan or study by the County. Per the Comprehensive
Plan, the current land use should remain in its present land use with orchards, agricultural, and
residential.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County's
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan accomplishes this by promoting the inclusion of additional land in
Agricultural and Forestal Districts. The Comprehensive Plan Supports the addition to the District
because it provides an opportunity for the agribusiness community to conduct long range planning
efforts for the management of their operations, while providing a reserve of agricultural land
through the year 2030.
The location of this District lies outside the Urban Development Area(UDA)and Sewer and Water
Service Area(SWSA) and is not part of any current small area plan or study by the County.
Staff Comments:
This addition provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 1,014.45+/-acre
District will be valid through August 2030. The Agricultural District Advisory Committee
(ADAC) unanimously recommended approval of the additional 942.64+/- acre to the 2025-
2030 South Frederick Agricultural and Forestal District at their meeting on December 16,
2025.The Planning Commission(PC)unanimously recommended approval of the additional
942.64+/- acre to the 2025-2030 South Frederick Agricultural and Forestal District at their
meeting on February 4,2026.

Following a public hearing, staff is seeking a decision from the Board of Supervisors on these
additional parcel applications.
