HomeMy WebLinkAbout064-26 (2025-2030HayfieldAg&ForestalDistrictAdditions) 40) ORDINANCE Action: PLANNING COMMISSION: February 4, 2026 Recommended Approval BOARD OF SUPERVISORS: February 25, 2026 Adopted ADDITIONS TO THE 2025-2030 HAYFIELD AGRICULTURAL & FORESTAL DISTRICT WHEREAS,there is a proposal to increase the Hayfield 2025-2030 Agricultural&Forestal District by 85.64 acres. With the additions,the District will contain 1,025.54+/-acres.The properties are located 2.5 miles west of the intersection of Route 50 and Hayfield Road (Route 600) and identified by Property Identification Numbers 39-A-9, 39-A-17, 39-A-45A, and 39-A-4513 in the Back Creek Magisterial District; and WHEREAS, the Agricultural District Advisory Committee(ADAC)discussed these District additions at their meeting on December 16,2025, and recommended approval; and WHEREAS, the Planning Commission held a public hearing and recommended approval of the additions to the 2025-2030 Hayfield Agricultural &Forestal District on February 4,2026; and WHEREAS, the Board of Supervisors held a public hearing on these additions to the 2025-2030 Hayfield Agricultural&Forestal District on February 25,2026; and WHEREAS, the Frederick County Board of Supervisors finds that the additions of the 2025-2030 Hayfield Agricultural & Forestal District contribute to the conservation and preservation of agricultural and forestal land in Frederick County; NOW, THEREFORE,BE IT ORDAINED that the Frederick County Board of Supervisors hereby adopts the additions to the 2025-2030 Hayfield Agricultural & Forestal District of 1,025.54+/-acres in the Back Creek Magisterial District, with an expiration date of August 13, 2030. The Agricultural & Forestal District is as described on the attached map dated August 22,2025, and the attached property owners'table. This ordinance shall be in effect on the day of adoption. State Code Requirements & District History Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that Agricultural and Forestal Districts be reviewed by the local government every five years after establishment. The Board of Supervisors decides to approve, approve with modifications, or deny the proposal to establish or renew a District. The District was updated in 2025. Proposed Changes: Current Proposed 2025-2030 District 2025-2030 District Acreage 939.90+/- acres 1,025.54+/- acres Number of Parcels 6 10 Number of Property 2 3 Owners Magisterial Back Creek Back Creek District s Land Use Residential &Agricultural Residential &Agricultural Page 2 of 3 District Characteristics: Agricultural& Forestal Significance: The agricultural operation in the District is 40 percent agriculture (livestock, and crop harvesting) and 60 percent open space/woodlands. The area within the District is rural in nature. Lakes/Ponds/Streams: The District lies within the Green Springs and Babbs Run drainage areas. These two bodies of water are tributaries to Back Creek. This District will further assist with managing the quality of the County's water resources. Prime Agricultural Soil: The largest amount of prime agricultural soils located within District is Weikert-Gainesboro-Berks. The District generally varies from broad rolling hills to the west and gently rolling hills to the north and east. This District lies within the Abrams Creek watershed and water is available from ponds, wells and springs. Most of the areas within the District are in pasture, orchards,livestock, and few areas are woodland. Comprehensive Plan: The Comprehensive Plan for Frederick County provides guidance when considering land use actions. The location of this proposed District lies outside the Urban Development Area (UDA) and Sewer and Water Service Area (SWSA) and is not part of any current land use plan or study by the County. Per the Comprehensive Plan,this current land use should remain in its present land use of pristine condition with land use of vacant and woodland. The intent of the Rural Areas is to maintain agriculture as a significant portion of the County's economy and to maintain the rural character of areas outside of the Urban Development Area. The Comprehensive Plan accomplishes this by promoting the inclusion of additional land in Agricultural and Forestal Districts. The Comprehensive Plan Supports the renewal of the District because it provides an opportunity for the agribusiness community to conduct long range planning efforts for the management of their operations, while providing a reserve of agricultural land through the year 2030. Staff Comments: This addition provides an opportunity for the agribusiness community to conduct long-range planning efforts for the management of their operations. Once renewed, the 1,014.45+/-acre District will be valid through August 2030. The Agricultural District Advisory Committee (ADAC) unanimously recommended approval of the additional 85.64+/- acre to the 2025- 2030 Hayfield Agricultural and Forestal District at their meeting on December 16,2025. The Planning Commission (PC) unanimously recommended approval of the additional 85.64+/- acre to the 2025-2030 Hayfield Agricultural and Forestal District at their meeting on February 4,2026.
