WORK SESSION
FREDERICK COUNTY BOARD OF SUPERVISORS
WEDNESDAY, FEBRUARY 4, 2026
5:30 P.M.

ATTENDEES
Board of Supervisors: Robert W. Wells, Vice Chairman; Robert T. Liero; Jason C.Aikens;
Albert L. Orndorff; Michael D. Guevremont; and Gary R. Oates were present. John F. Jewell,
Chairman, was absent. Jason C. Aikens participated remotely from Washington, D.C., for personal
business reasons. for personal business reasons.
Staff present: Michael Bollhoefer, County Administrator; Jay E. Tibbs, Deputy County
Administrator; Andrew R. Fox, County Attorney; Wyatt Pearson, Planning Director; John Bishop,
Assistant Director of Planning; Patrick Fly, Director of Information Technologies; and Ann W.
Phillips, Deputy Clerk to the Board of Supervisors.
CALL TO ORDER
Vice Chairman Wells called the meeting to order at 5:00 p.m.
REMOTE PARTICIPATION APPROVED
Vice Chairman Wells moved that the Board authorize remote participation by Supervisor
Jason Aikens. Supervisor Liero seconded the motion, which carried on a voice vote.
REVIEW AND DISCUSSION OF FREDERICK COUNTY'S TRANSFER OF DEVELOPMENT
RIGHTS PROGRAM
Director of Planning and Development Wyatt Pearson gave a presentation on the County's
Transfer of Development Rights program.
The Board discussed the changes made to the ordinance in the fall of 2025, resulting in
the significant reduction of the areas eligible to receive transferred development rights.
Supervisor Oates proposed the creation of a working group to review the program and find

solutions to improve the TDR program.
Mr. Pearson noted that the Board would need to agree on the receiving areas in order for
the program to be viable.
By consensus, Supervisors Oates and Liero were named to the working group, and each
was instructed to appoint members of the Planning Commission and private citizens to participate
in the working group.

There being no further business, at 5:40 p.m., the meeting was adjourned.
