WHEREAS, REZONING #04-25 for Laurel Ridge Community College Educational Foundation Inc. (MDP.
Facilities Solutions) submitted to rezone 19.81+/- acre parcel from RA (Rural Areas) Zoning District to HE
(Higher Education)Zoning District with proffers to enable commercial development. The property is located at
131 Garland Snapp Drive,Middletown and is identified by Property Identification Number 91-A-9913 in the Back
Creek Magisterial District; and
WHEREAS,the Frederick County Planning Commission held a public hearing on this rezoning on August 6,
2025, and recommended approval; and
WHEREAS,the Frederick County Board of Supervisors held a public hearing on September 10, 2025; and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be in the best
interest of the public health, safety, and welfare,and in conformance with the Comprehensive Plan;
NOW,THEREFORE,BE IT ORDAINED by the Frederick County Board of Supervisors,that Chapter 165 of
the Frederick County Code,Zoning,the Zoning District Map is amended in accordance with Rezoning#04-25 for
Laurel Ridge Community College Educational Foundation Inc. (MDP. Facilities Solutions) submitted to rezone
19.81+/-acre parcel from RA (Rural Areas) Zoning District to HE (Higher Education) Zoning District with
proffers. The conditions voluntarily proffered in writing by the Applicant and the Property Owner are attached.
This ordinance shall be in effect on the date of adoption.

PLANNING COMMISSION SUMMARY&ACTION FOR THE 08/06/25 MEETING:
The Planning Commission held a public hearing on August 6,2025. One(1)member of the public
spoke with concern about the location of the proposed building locations and an existing easement
to a private well. The applicant stated that they were aware of the easement, and neither the
buildings nor internal roadways were infringing upon the easement. The applicant will meet with
the owners onsite to discuss the private well location and the proposed development.
The Planning Commission asked for verification of the use of the facility and proposed substation.
The applicant responded that the facility was for training purposes (electrical trade) and would
have electricity beyond a normal facility. To clarify, the facility would not be associated with
producing power.
The Planning Commission unanimously recommended approval of the proposed rezoning.
Following a public hearing, staff is seeking a decision from the Board of Supervisors on this

Preliminary Matters:
Pursuant to Va. Code Ann. § 15.2-2296,et seq.,and § 165-102.06 of the Frederick County
Zoning Ordinance, the undersigned hereby proffers that the development and use of the Property
shall be in substantial conformance with the following conditions. In the event this rezoning is
granted as applied for by the Applicant, then these proffers shall supersede and replace in their
entirety all other proffers made prior hereto with respect to the Property. In the event this rezoning
is not granted as applied for by the Applicant,then these proffers shall be deemed withdrawn and
shall be null and void, and any existing proffers will remain in full force and effect.
The headings of the proffers set forth below have been prepared for convenience or
reference only and shall not control or affect the meaning or be taken as an interpretation of any
provision of the proffers. Any improvements proffered herein below shall be provided at the time
of development of the portion of the site served by the improvement, unless otherwise specified.
The terms"Applicant" and"Developer" shall include all future owners and successors in interest.
For purposes of reference in this Proffer Statement, the "Generalized Development Plan"
shall be that plan, consisting of three (3) sheets, prepared by Timmons Group entitled, "LRCC
Educational Foundation-Rezoning"("GDP")dated March 24,2025 and revised through June 16,
2025.
1. DEVELOPMENT AND USE OF THE PROPERTY
1.1. The subject Property shall be developed in substantial conformance with the GDP.
Upon submission of final site or subdivision plans, minor changes and adjustments
may be made to the internal travelways, entrances, parking, dimensions and
location of the SWM/BMP facilities, the exact configuration and location of
building footprints, and other similar features as shown on the GDP, provided they
meet the intent of these Proffers and are approved by the Director of Planning.
1.2. The Property may be developed with College, University, and Professional School
uses. Permitted structures include an existing 2 story masonry and metal Student
Union building and associated parking, a proposed 6,000 square foot building, and
two future buildings and associated parking, ingress, and egress improvements, as
depicted on the GDP. The Property may further be developed with accessory uses
customarily associated with the primary use of the Property.
1.3. The Property may be developed with public utilities,to include a future substation,
as depicted on the GDP as "FUTURE SUBSTATION" together with associated
accessory structures, to include powerline poles and power lines, pole racks, and
climbing poles.
2. SITE DESIGN
2.1. The Owner shall provide a Category C buffer along the Property's boundaries with
adjacent parcels zoned to the Rural Areas— RA Zoning District. Said buffer shall
be depicted on the site plan or master development plan for the Property. .
2.2. The Owner shall, at no public cost, dedicate necessary right-of-way to allow Route
I INalley Pike to be improved to its ultimate condition as a four-lane-divided
highway. The general location of the right-of-way proposed for dedication is
depicted as "ROW DEDICATION" on the GDP. The exact location and width of
the dedication area shall be determined in consultation with the County and VDOT
as necessary at the time of site plan or master development plan for the Property.
3. LIGHTING
3.1. All outdoor lighting shall be compatible, and harmonious throughout the Property.
Fixtures shall be similar in style. Lighting shall be mounted at a height that is
relative to the property line such that it is no taller than its horizontal distance from
the nearest property line,but in no case shall it be placed more than 25' above grade.
Any luminaire situated within 50' of any property line shall be oriented
perpendicular to and faced away from that property line so as not to cause trespass
onto an adjacent property in excess of 0.1 footcandles onto a residential use, or 0.5
footcandles onto any other property. All luminaires shall meet an up-light rating of
UO (that is zero up-light) according to the Luminaire Classification System(LCS),
as developed and maintained by the Illuminating Engineering Society (IES). They
shall be oriented with the central beam pointed straight down, and shall otherwise
conform to the requirements of the Town's Zoning Ordinance. The Applicant shall
prepare and submit a photometric plan as part of the final site plan process
demonstrating the minimization of off-site lighting impact.
4. FIRE AND RESCUE
4.1. The Applicant shall contribute to Frederick County the sum of $0.10 per square
foot of gross floor area on the Property, as depicted on depicted on each final site
plan, to be used for fire and rescue purposes. The contribution shall be made at the
time of issuance of the certificate of occupancy for each structure built on the
Property.
5. WATER AND SEWER
5.1. The Property shall be served with public water and public sewer. At its expense,
the Applicant shall design and construct all on-site and off-site improvements
necessary to provide service for the demand generated by development on the
Property in accordance with applicable Town of Middletown standards as to sewer
improvements, and City of Winchester standards as to water improvements.
6. MISCELLANEOUS
6.1 The Applicants shall conduct, or cause to be conducted, a Phase I Cultural
Resources Investigation of the Property prior to the approval of the first final site
plan for the Property. Should the Phase 1 Cultural Resources Survey determine that
additional testing or analysis is needed, the Applicant shall complete Phase II and
III investigations as demonstrated to be necessary by the initial study. Such Phase
11 and Phase III investigations, if warranted, shall be diligently pursued by the
Applicant.
6.2 In the event the monetary contributions set forth in this Proffer Statement are paid
to Frederick County within twelve(12)months after final approval of this rezoning,
as applied for by the Applicant, said contributions shall be in the amounts as stated
herein. Any monetary contributions set forth in this Proffer Statement which are to
be paid to the County shall be adjusted in accordance with the Urban Consumer
Price Index(CPI-U),published by the United States Department of Labor,such that
at the time contributions are paid they shall be adjusted by the percentage change
in the CPI-U from that date twelve(12)months after final approval of this rezoning
to the most recently available CPI-U to the date the contributions are paid, or six
per cent(6%)per year,whichever is less.

Executive Summary
This report has been prepared to assess the impact to Fredrick County for the rezoning of the
subject parcel from RA, Rural Areas District to HE, Higher Education District. The subject property
is identified as Tax Parcel 91-A-99B and is approximately +/- 19.81 acres. The property owner
and applicant are Laurel Ridge Community College, Educational Foundation Inc. The property is
located on the east side of Valley Pike (U.S. Route 11 South) approximately 1,500 feet north of
the Town of Middletown Corporate Limits. There is currently one existing building with the site
address of 131 Garland Snapp Dr, Middletown, VA. The subject parcel is within the Long-Range
Land Use (For institutional), and Frederick County Sewer and Water Service Area (SWSA).
The applicant proposed to rezone the property to allow future development of higher education
uses, in conjunction with its adjacent property, Laurel Ridge Community College, owned by
Commonwealth of Virginia and operated by Laurel Ridge Community College. A general
development plan has been developed for the use of outdoor lineman training or construct trades
buildings and associated infrastructure. The applicant is confident that the proposed rezoning is
consistent with the land use policies of the Comprehensive Policy Plan, and development of the
rezoned subject property under the HE, Higher Education, district will not result in negative net
impacts.

(U.S. Route 11 South) approximately 1,500 feet north of the Town of
Middletown Corporate Limits.]

A. Suitability of the Site
Currently, a portion of the site has already been developed for a student union building
that is an assessor use for the adjacent property of Laurel Ridge Community College.
This project constructed adjacent public utilities, such as water, sewer and stormwater,
that can be assessed and used for the future development of this parcel. The
undeveloped portion of the property is approximately +/- 15 acres with site conditions
that are suitable for proposed development activities with no tree clearing activities
needed. The proposed rezoning would not result in impact on areas of existing steep
slopes, stream channels, lakes, ponds, flood plain, or wetlands. The existing topography
of the site drains both to the north and to the south in the form of sheet flow into the
adjacent wooded areas located on the eastern side. There are no steep slopes (between
15 — 25%) or very steep slopes (25% and greater) located in the area with an elevation
difference of around 10 feet for the anticipated area of development. It is not anticipated
that retaining walls will be required for the site improvements. During the engineering
phase of the project, a stormwater management plan will be provided to adequately and
effectively retain stormwater in a manner that will avoid negative impacts on adjacent
properties. The existing soils on the subject property are identified as 5B - Carbo Silt
Loam, 6C - Carbo-Oaklet, 8C — Chilhowie silty and 32B - Oaklet silt loam and do not
present any significant challenges to potential commercial land development.

C. Traffic
Currently, there is an existing site entrance off U.S. Route 11 and an adjacent site access
from the Laurel Ridge Community College property for access from both North and South
bound of U.S. Route 11. Timmons Group prepared a turn lane warrant analysis to asset
need for turn lanes associated with the proposed LRCC Lineman Training Center with the
anticipated number of students and classrooms. It was determined that these
improvements as outlined in the General Development Plan will not require any
transportation improvements or entrance modifications as it will not generate an influx in
additional vehicles or traffic. It is planned that each cohort will meet 5 days a week for 13
weeks at a time. Each course window will run three 13-week cohorts per year with 15-30
students. The estimated average daily traffic to the bookstore was 1,577 while the training
center will be around 257. Both uses were analyzed in the turn lane study
D. Sewage Conveyance and Treatment
The proposed outdoor classrooms buildings will have one unisex restroom in each
building. Sanitary sewer will connect to the existing infrastructure that is currently behind
the Student Union Building. This main is approximately located 200 feet west of the site
from the proposed building site. This existing main currently outfalls into the adjacent

property of Laurel Ridge Community College, which is then sent to an existing grinder and
pumped into a force main. The existing force main connects to the public sewer along U.S.
Route 11 —Valley Pike. The portion in public road is owned and serviced by the Town of
Middletown.
E. Water Supply
The parcel is currently served by the City of Winchester for public water. An existing 8"
water main runs along Garland Snapp Drive and east of the Student Union Building with
an existing blow-off valve that this development would connect to extend the watermain
for domestic water and fire protection. Domestic water will only be used for the use of
restrooms.
F. Drainage
The topography of the site drains both to the north and to the south in the form of sheet
flow into the adjacent wooded areas located on the eastern side. A complete stormwater
management plan will be designed at the time of final engineering design and site plan
approval. All associated stormwater quantity and quality measures will be designed in
conformance with all applicable state and local regulations. During design, all site drainage
and stormwater management impacting adjoining properties and the community will be
mitigated. Based on preliminary analysis, the Applicant has identified the location of a
possible underground SWM/BMP facility on the General Development Plan that will be
designed and constructed to serve the development areas.
G. Solid Waste Disposal Facilities
The property will utilize private collection services administered by Laurel Ridge
Community College, which will result in limited impacts. There will be none to little solid
waste for the outdoor classroom uses.
H. Historic Sites and Structures
The property is located within existing or potential historic districts, Civil War Battlefields
or sites, or landmarks, as identified in the Frederick County Comprehensive Plan. An
archaeological survey investigation and report was prepared by William and Mary Center
for Archaeological Research, The College of William and Mary, of Williamsburg, Virginia,
dated April 21, 2014. The fieldwork was carried out on July 5th through the 8th of 2011.
Based on the report, a portion of the site area is located within the previously recorded
battlefield of the Battle of Cedar Creek (VDHR Architectural Resource 034-0303) and is
situated immediately northeast of a previously re-corded archaeological site (Site
44FK0622), which has been interpreted as the location of a temporary artillery battery

position (Light Battery B, 5th US Artillery).Given the potential to provide significant
information about the Military/Defense theme during the Civil War (1861-1865), the
archaeological resources identified within an area of the parcel as potentially contributing
to the NRHP eligibility of Site 44FK0622 and the Battle of Cedar Creek Battlefield under
Criterion D; Criteria A through C are considered not applicable. The contributing resources
within Site 44FK0622 should be avoided. During the survey, shovel and metal detector
tests were performed and positive for artifacts. These tests indicate the presence of a
dispersed subsurface scatter of artifacts consisting of military, domestic, and architectural
material that represent remains of battle activities, as well as a possible military
encampment component that represents encampment sometimes either before or after
the Battle of Cedar Creek. However, after the research team examined findings and
artifacts, the research potential of the archaeological resources within the property were
unlikely to provide additional significant new information about the Military/Defense theme
during the Civil War (1861-1865) in the Shenandoah Valley of Virginia and has been
effectively exhausted with the completion of this study. As such, the portion of the site
investigated in this study does not contribute to the NRHP eligibility of Site 44FK0622 and
the Cedar Creek Battlefield under Criterion D. Therefore, the proposed rezoning of the
subject property will not generate negative impacts associated with historic resources.
I. Impact on Community Facilities
1. Educational Facilities
The development of the property would be for educational uses under the proposed
HE zoning will result in a net positive fiscal impact for Frederick County and continue
to be in conformance with the County's Long-Land Land Use of Institutional. This use
would allow Laurel Ridge Community College to continue future educational courses.
2. Emergency Services
Police protection will be provided by the Frederick County Sheriff's Department. The
property is in the first response area for the Middletown Volunteer Fire and Rescue
Station. Response times from the station to the site remain the same as the existing
times with a low service demand for the additional classroom buildings.
3. Parks and Recreation:
The rezoning and development of this site do not impact Frederick County parks and
recreation facilities.

I spoke with the City Engineer in relation to capacity.
The City is fine with the pass-through service.
The City can only confirm capacity for approved service connections but cannot confirm the capacity of
additional components or connections.
As noted previously to Mr. Patterson on 4/16/25, Laurel Ridge is fine to proceed with a water service
connection originating from the Student Union Building as long as the service line is on a single lot.
Service to a separate lots would require a new meter and tap.Also, on 4/22/25,the City commented to
Mr. Paterson the water service connection is fine, but if a hydrant will be required,you would need to tap
the main.
Finally, the 6/30/25 Rezoning review request comment; "The City has no comment but awaits site plan
for further review.",would stand as the items provided for the Rezoning were not engineered plans for
utility review and standards.

The Historic Resources Advisory Board (HRAB) considered the above referenced rezoning application
during their May 16, 2025 meeting. The rezoning application is for a +/- 19.81 acre property from the
RA (Rural Areas) Zoning District to the HE (Higher Education) Zoning District with proffers. The
property is generally located east of Valley Pike (Route 11) north of the existing Laurel Ridge
Community College campus.
Following their review of this application, HRAB recommended proffering a Phase 1 Archeological
survey be conducted for the remainder of the property that was not included in the Archaeological
Survey of the Proposed Student Center Building (2014) or the Supplementary Archaeological
Evaluation of Site 44FK0622 at the Proposed Student Center Building Project Area (2014) prior to any
construction on the property. If the survey finds a Phase 2 survey is warranted, a phase 2 survey
should be conducted as well prior to construction. The surveys should be provided to the County as
record.
