Therefore, the 2025-2030 renewal of the South Frederick Agricultural & Forestal District was updated and considered. The renewed District will contain 5,905.84+/- acres. The Agricultural & Forestal District is as described on the attached map dated May 13, 2025, and the attached property owner's table. This ordinance shall be in effect on the day of adoption. The District was updated in 2024. State Code Requirements & District History Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that Agricultural and Forestal Districts be reviewed by the local government every five years after establishment. The Board of Supervisors decides to approve, approve with modifications, or deny the proposal to establish or renew a District. The District was updated in 2024. The area within the District is rural in nature. Lakes/Ponds/Streams: The District lies primarily within the Opequon Creek and Stephens Run drainage area. The District will further assist with managing the quality of the County's water resources. Prime Agricultural Soil: The largest amount of prime agricultural soil located within the District is Frederick-Poplimento. The District generally varies from rolling hills to ridges to the north, west, south and east. This District lies within Opequon Creek watershed and water is available from ponds, wells and springs. Comprehensive Plan: The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use actions. The District is outside the Urban Development Area(UDA) and Sewer and Water Service Area (SWSA) and is not part of any land use plan or study by the County. The current land use should remain in its present land use with orchards, agricultural, and residential. The intent of the Rural Areas is to maintain agriculture as a significant portion of the County's economy and to maintain the rural character of areas outside of the Urban Development Area. The Comprehensive Plan can accomplish this by promoting the inclusion of additional land in Agricultural and Forestal Districts. The Comprehensive Plan Supports the renewal of the District for it provides an opportunity for the agribusiness community to conduct long range planning efforts for the management of their operations, while providing a reserve of agricultural land through the year 2030. Staff Comments: Staff would advise the committee that the four (4) properties listed below be removed from District. These properties do not meet the criteria to be included within an agricultural district. The properties are part of the Bartonville Solar project. This project is operating under Conditional Use Permit(CUP) and more of an industrial use than an agricultural use. 74-A-3 74-A-18B 74-A-18A 85-A-1 This would bring the District to a total of 5,905.84+/-acres. This renewal provides an opportunity for the agribusiness community to conduct long-range planning efforts for the management of their operations.
