WHEREAS,WAIVER APPLICATION#02-25 was submitted by Painter-Lewis PLC on behalf of Storage
Solutions CB LLC for a waiver of the Subdivision Ordinance §144-24(C)requiring all new lots to have direct
access to a public street at 3470 Martinsburg Pike Clearbrook, Virginia,identified with Property Identification
Number 33-2-A in the Stonewall Magisterial District; and
WHEREAS,the Frederick County Planning Commission held a public meeting on this Subdivision Ordinance
waiver application on May 21, 2025,and recommended approval; and
WHEREAS,the Frederick County Board of Supervisors held a public meeting on this Subdivision
Ordinance waiver application on June 11,2025; and
WHEREAS,the Frederick County Board of Supervisors finds the approval of this waiver application to be
in the best interest of the public health, safety, and welfare, and in good zoning practice;
NOW, THEREFORE, BE IT RESOLVED by the Frederick County Board of Supervisors, that in
accordance with Chapter 144 of the Frederick County Code, Subdivision of Land, waiver #02-25 of the
Subdivision Ordinance §144-24(C)requiring all new lots to have direct access to a public street for Property
Identification Number 33-2-A is approved.

RE: Waiver 402-25 for Storage Solutions CB LLC

Waiver Request:
Painter-Lewis PLC,on behalf of Storage Solutions CB LLC,is requesting a waiver of the Subdivision
Ordinance §144-24(C) requiring all new lots to have direct access to a public street. Painter-Lewis
submitted a Master Development Plan (MDP) to subdivide a +/- 27.12-acre property (Property
Identification Number 33-2-A). One lot would be created for the existing commercial/warehouse
building, one lot for the rail transload land bay, and one lot for rail car storage and stormwater
management. The property is zoned M1 (Light Industrial) District and is in the Stonewall Magisterial
District.
Subdivision Ordinance Requirement:
§144-24(C) Lot Access
"All lots shall abut and have direct access to a public street or right-of-way dedicated for maintenance
by the Virginia Department of Transportation."
§144-5 Interpretations and Appeals
"Variations in or exceptions to the provisions of this chapter may be granted by the Board of
Supervisors in cases of unusual situations or when strict adherence to the general regulations would
result in substantial injustice or hardship."
Background:
The draft MDP includes a main truck and car entrance along Martinsburg Pike (Route 11) parallel to
the Winchester and Western Railroad line. This is intended to be a right-in entrance only. The private
road would be along the eastern portion of the property from Brucetown Road and would be a full
movement entrance. VDOT has reviewed the draft MDP and stated that the new entrance must be
brought up to current VDOT standards. The draft MDP cannot be approved without a waiver of the
public street requirement as a new lot would be created that does not have direct access to a public
street or right-of-way maintained by VDOT.
Meeting Summary& Requested Action:
The Planning Commission discussed this item on May 21, 2025, and asked if VDOT has provided
comments. Staff stated VDOT has commented on the MDP and did not have an issue with the proposed
private street, only that it must be built to current VDOT standards. Mr. Painter, representing the
application, stated they believe the proposal is the best solution as VDOT prefers the full access

entrance along Brucetown Road rather than Martinsburg Pike. The applicants do not want the road to
be public as it could lead to additional trips that may interfere with the operations. The Planning
Commission recommended approval of the waiver.
Staff are seeking a decision by the Board of Supervisors on this waiver request.
