3.A.Update of the 2025-2030 Agricultural and Forestal Districts
Every five years Frederick County is required by the Code of Virginia to evaluate, add,
renew, or remove properties from its Agricultural & Forestal Districts. It is the task of the
ADAC to review proposals for the renewal of these Districts to ensure conformity with
the provisions of Section 15.2-4300 of the Code of Virginia. Following review by the
ADAC, the Board of Supervisors will then approve, approve with modifications, or deny
the proposal to renew an Agricultural and Forestal District.
The following districts are up for renewal:

MEETING MINUTES
OF THE
FREDERICK COUNTY AGRICULTURAL DISTRICT ADVISORY COMMITTEE
Held in the first-floor Board of Supervisors Room of the Frederick County Administration
Building, 107 N. Kent Street, Winchester, Virginia on February 20, 2024.
PRESENT: Jason McDonald, Shawnee District; Cordell Watt, Gainesboro District; John Marker,
Back Creek District Alternate; Harman Brumback, Back Creek; Patricia Scheulen-Ferrell,
Gainesboro; John Jewell, BOS Liaison and Mark Sutphin, Virginia Co-Extension
ABSENT: John Stelzl, Opequon District; and William Cline, Stonewall District.
STAFF PRESENT: Mark Cheran, Zoning Administrator; Pam Deeter, Secretary.
CALL TO ORDER
The meeting was called to order by Mr. Cheran at 6:00 p.m.
On a motion made by Mr. Marker and seconded by Mr. Harman, the minutes for the March 14, 2023,
meeting were unanimously approved as presented.
Mr. Cheran updated the Committee about a change in the agenda items and he also informed the
Committee that next year 2025 is the renewal of all the Agricultural and Forestal Districts. Planning
will have the application online if anyone is interested in coming into the Districts. Committee
members were made aware that they will be contacted to see if they want to serve again on the
Committee or if they know someone that wants to become a Committee member to contact their Board
of Supervisors directly.
Mr. Cheran came forward to present his report. Staff noted the first item is an addition to the South
Timber Ridge District. This addition is 76.866+/- acres with a Property Identification Number 37-A-
8 and this will be 24 parcels that the property owner manages. Currently the District has 1,170.94
acres. If approved, the South Timber Ridge District would have a total of 1,247.84+/- acres.
On a motion made by Mr. Marker approved the additional acreage of 76.866+/- (PIN 37-A-8) to the
South Timber Ridge District and seconded by Mr. McDonald were unanimously approved.
Mr. Cheran presented the second item being the removal from the South Frederick Agricultural &
Forestal District. The District currently has 6,921.63 acres.

Staff noted that Mr. Charles and Robin Bentley requested to have 64.14+/- acreage removed from the
District. Mr. Bentley provided a letter with the request. If approved, this would bring the South
Frederick District to 6,857.49+/- acres.
Mr. Cheran noted that under the Code of Virginia in1950 as amended provides property owners with
the ability to request removal of land from an agricultural and forestal district through a process via
the local governing body. Staff mentioned the reason why Mr. Bentley requested to be removed from
the District. Mr. Bentley wants to create a family subdivision by giving his son a 2-acre parcel.
Anytime a parcel is in Agricultural & Forestall District, there cannot be any subdivision of land.
Mr. Bentley mentioned that after this is completed the remainder of the parcel will be going back into
the District, but he will do the renewal in 2025.
On a motion made by Mr. Harman to remove the 64.14+/- parcel from the South Frederick Agricultural
& Forestal District with parcel (PIN 84-A-28A), and seconded by Mr. Marker, were unanimously
approved.
Mr. Cheran gave a presentation on the third item for another request to remove 71.21+/- acres (PIN
74-A-3) owned West Oaks Farm Market, LLC., (Joseph and Mary Snapp) from the South Frederick
District. This District was established in 1980 and is renewed every five years. This particular parcel
will be part of the Bartonsville Solar Farm. At the time of the CUP, for the Bartonsville Solar Farm it
was undetermined which way the solar panel would be placed. Construction is going to begin, so the
property needs to be removed from the district. There is still discussion on solar farms as to them being
considered farms. If approved, the District would contain a total of 6,786.28+/- acreage.
A Committee member asked, does the company own the property. Mr. Cheran replied that he wasn’t
sure.
On a motion made by Mr. Watt, to remove the 71.21+/- parcel from the South Frederick Agricultural
& Forestal District with parcel (PIN 74-A-3), and seconded by Mr. Marker, was unanimously
approved.
Staff said the next item is not on the agenda, but since we are meeting here, and the paperwork has
been turned in we will proceed.
Mr. Jason McDonald requested the parcel (PIN 73-A-20) with 238.51+/- be included in the South
Frederick Agricultural and Forestal District. Mr. McDonald already has his farm in this district, and
he is just adding to the district. Staff noted the previous two items on the agenda was to remove parcels
from that district and now we are adding to the District.
On a motion made by Mr. Watt to include parcel (PIN 73-A-20) 238.51+/- acres to the South Frederick
Agricultural & Forestal District and seconded by Mr. Marker, was unanimously approved.

General District Location
This District is located within the Gainesboro Magisterial District and is generally located west
of Route 37, and North and South of Route 522, near the Albin Rural Community Center. The
District was updated in 2020.

District Characteristics:
Agricultural & Forestal Significance:
The District is 90 percent agriculture (livestock, orchards, and crop harvest) and 10 percent open
space/woodlands. The land within the District is rural in nature.
Lakes/Ponds/Streams:
The District lies primarily within the Abrams Creek drainage area. The establishment of this
District will further assist with managing the quality of the County’s water resources.
Prime Agricultural Soil:
The largest amount of prime agricultural soils located within the District is Frederick-Poplimento.
The District generally varies from a broad rolling hills to the west and, gently rolling hills to the
north and east. This District lies within the Abrams Creek watershed and water is available from
ponds, wells and springs. Most of the areas within the District are in pasture, orchards, livestock,
and few areas are woodland.
Comprehensive Plan: The 2035 Comprehensive Plan of Frederick County provides guidance
when considering land use actions. The District is located within the limits of Route 37 West Land
Use Plan of the Comprehensive Plan. The Route 37 West Land Use Plan identified a study area
which encompassed 645-acres bounded by Route 522 to the north, Route 37 to the east and the
Round Hill Community Land Use Plan bound to the south. The Plan identified 120 acres of that
study area for potential business uses and the remaining 525-acres within the study area was
proposed to remain rural.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan can accomplish this by promoting the inclusion of additional land in
Agricultural and Forestal Districts. The Comprehensive Plan supports the renewal of the District
for it provides an opportunity for the agribusiness community to conduct long range planning
efforts for the management of their operations, while providing a reserve of agricultural land
through the year 2030.
Staff Comments:
This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 1,014.45 acre District
will be valid through August 2030.
Staff is seeking a recommendation from the ADAC to forward to the Planning Commission
on District renewal.

actions. The location of this District lies outside the Urban Development Area (UDA) and Sewer
and Water Service Area (SWSA) and is not part of any land use plan or study by the County. It is
noted that the Stonewall Industrial Park is located on the south boundary of this District. The area
of the County where this District is located is intended to remain rural. The intent of the Rural
Areas is to maintain agriculture as a significant portion of the County’s economy, and to maintain
the rural character of areas outside of the UDA.
The Eastern Frederick County Road Plan is the major transportation component of the
Comprehensive Plan. This road plan identifies the future transportation needs within Frederick
County. A major component of this road plan is Route 37, which will provide direct limited east
to west access around the City of Winchester. This proposed roadway will need, at a minimum, a
350-foot right-of-way. Staff would note that a property lies within the right-of-way for future
Route 37.
Staff Comments:
This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 936.03-acre District
will be valid through August 2030.
Staff is seeking a recommendation from the ADAC to forward to the Planning Commission
on District renewal.

The District is located within the Back Creek Magisterial District and fronts Back Mountain
Road (Route 600) and borders the Mountain Falls Subdivision to the west. The District was
updated in 2020.

will further assist with managing the quality of the County’s water resources. There is a large pond
on the parcel.
Prime Agricultural Soil:
The largest amount of prime agricultural soils located within the District is identified as
Hazleton.
The District generally varies from broad rolling hills to the west and, gently rolling hills to the
north and east. This District lies within the Cedar Creek watershed and water is available from
ponds, streams, and springs. Most of the area within the District is in pasture, livestock, and
woodland.
Comprehensive Plan:
The 2035 Comprehensive Plan of Frederick County (Comp Plan) provides guidance when
considering land use actions. The location of this proposed District lies outside the Urban
Development Area (UDA) and Sewer and Water and Service Area (SWSA) and is not part of any
land use plan or study by the County. The land use within this proposed District of 489.91+/- acres
is residential and agricultural. The current land use should remain in its present land use of pristine
condition with land use of agricultural and residential.

693.87+/- acres with this update.
State Code Requirements & District History
Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that
Agricultural and Forestal Districts be reviewed by the local government every five years after
establishment. The Board of Supervisors decides to approve, approve with modifications, or
deny the proposal to establish or renew a District. The District was updated in 2020.

Agricultural & Forestal Significance:
The agricultural operations in the District are 75 percent livestock and cultivation of hay and 25
percent open space/woodlands. The area within the District is rural in nature.
Lakes/Ponds/Streams:
The District lies primarily within the Stephens Run drainage area. The District will assist with
managing the quality of the County’s water resources.
Prime Agricultural Soil:
The prime agricultural soil located within the District is Blairton.
The District generally varies from a broad rolling valley to flat lands, and water is available from
ponds, wells and springs. Most of the soils are suited to a wide variety of farms uses. Most of the
area is in pasture, cultivated crops and hay with few woodland areas.
Comprehensive Plan:
The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use
actions. The Plan identifies this District as an area that is outside the Urban Development Area
(UDA) and the Sewer and Water Service Area (SWSA). The District will be impacted by future
transportation improvements as noted within the Route 277 Land Use Plan approved by the Board
of Supervisors. The parcels in this District have no land use designation, which indicates the area
should remain rural.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan can accomplish this by promoting the inclusion of additional land in
Agricultural and Forestal District. The Comprehensive Plan supports the additions and renewal of
the Districts, for it provides an opportunity for the agribusiness community to conduct long range
planning efforts for the management of their operations, while providing reserve of agricultural
land through the year 2025.
Staff Comments:
This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 693.87-acre District
will be valid through August 2030.

The District is located within the Gainesboro Magisterial District and is generally located west
of the intersection of North Frederick Pike (Route 522) along North Sleepy Creek Road (Route
734) and Bloomery Pike (Route 127). The District was added in 2023.
State Code Requirements & District History
Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that
Agricultural and Forestal Districts be reviewed by the local government every five years after
establishment. The Board of Supervisors decides to approve, approve with modifications, or
deny the proposal to establish or renew a District. The District was updated in 2023.

District Characteristics:
Agricultural & Forestal Significance:
The District consists of approximately 90 percent forestry uses and 10 percent open
space/woodlands. The area within the proposed District is rural in nature.
Lakes/Ponds/Streams:
A portion of the District lies within the Sleepy Creek watershed and drainage area. This will further
assist with managing the quality of the County’s water resources. Water is available from ponds,
wells, and springs.
Prime Agricultural Soil:
The type of soil for this area is Weiket-Gainesboro-Berks. The soil is typically very steep and
found on mountaintops, side slopes and ridges; these soils tend to be well drained and consist of
sandstone and shale. The District are primarily forested, these soils are not classified as prime
agricultural soils.
The District is located along Great North Mountain, west of South Hayfield. The topography
ranges from strongly and steeply sloping along Great North Mountain to rolling along South
Hayfield Road.
Comprehensive Plan:
The 2035Comprehensive Plan of Frederick County provides guidance when considering land use
actions. The location of the District lies outside the Urban Development Area (UDA) and Sewer
and Water Service Area (SWSA) and is not part of any land use plan or study by the County. The
land uses within the proposed District is agricultural, residential and nature. The current land use
should remain in its present condition with land use woodland/open space.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan can accomplish this by promoting the inclusion of additional land in
Agricultural and Forestal Districts. The Comprehensive Plan supports the renewal of the proposed
District because it provides an opportunity for the agribusiness community to conduct long-range

District Characteristics:
Agricultural & Forestal Significance:
The predominant agricultural operations in the District are 75 percent agriculture (livestock, horses
and crop harvest) and 25 percent open space/woodlands. The area within the District is rural in
nature.
Lakes/Ponds/Streams:
The District lies primarily within the Redbud Run drainage area, and partially within the Hiatt
Run drainage area. The District will assist with managing the quality of the County’s water
resources.
Prime Agricultural Soil:
There is a limited amount of prime agricultural soils located within the District, which are Blairton,
Carbo, Frederick, Guernesy and Massanetta.
The District generally varies from a broad rolling valley to the west of Devils Backbone, to very
steep forested land on the eastern parcels and along Redbud Run. This District is within the
Redbud Run watershed and water is available from ponds, wells and springs. Most of the soils,
with the exception of those on the steeper slopes, are suited to a wide variety of farm uses. These
steeper slopes are mostly forested and are heavily wooded. Most of the area is in pasture,
cultivated crops and hay with few woodland areas.
Comprehensive Plan:
The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use
actions. The District lies in an area that is outside the Urban Development Area (UDA) and Sewer
and Water Service Area (SWSA). The area is located within the limits of the Northeastern Land
Use Plan. Approximately half of the District is designated as a Developmentally Sensitive Area
in the Northeast Land Use Plan. The remaining parcels have no land use designation, which
indicates the area should remain rural.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the UDA. The Comprehensive
Plan can accomplish this by promoting the inclusion of additional land in Agricultural and Forestal
District. The Plan supports the addition/renewal of the District, for it provides an opportunity for
the agribusiness community to conduct long range planning efforts for the management of their
operations, while providing reserve of agricultural land through 2030. The location of this District
lies outside the Urban Development Area (UDA) and Sewer and Water Service Area (SWSA) and
is not part of any land use plan or study by the County. The Stonewall Industrial Park is located
on the south boundary of this District. The land use within the District is residential and
agricultural. The current land use should remain in its present land use of pristine condition with
land use of orchards, agricultural, and residential.

The Eastern Frederick County Road Plan is the major transportation component of the Comp Plan.
This road plan identifies the future transportation needs within Frederick County. A major
component of this road plan is Route 37, which will provide direct limited east to west access
around the City of Winchester. This proposed roadway will need, at a minimum, a 350-foot right-
of-way. There is one (1) parcel within this proposed District which will be affected by future Route
37.

This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 1,333.25-acre District
will be valid through August 2030.
Staff is seeking a recommendation from the ADAC to forward to the Planning Commission

District Characteristics:
Agricultural & Forestal Significance:
The District is 90 percent agriculture (livestock, and crop harvest) and 10 percent open
space/woodlands. The area within the District is rural in nature.
Lakes/Ponds/Streams:
The District lies primarily within the Opequon Creek drainage area. The District will further assist with
managing the quality of the County’s water resources.
Prime Agricultural Soil:
The largest amount of prime agricultural soil located within the District is Weikeert-Berks-
Blairton.
The District generally varies from slight rolling hills with open land and woodland. The eastern
portion of the District is woodland. This District lies within the Opequon Creek watershed and
water is available from streams and springs. Most of the area within the District is in pasture and
livestock with areas that are woodland.
Comprehensive Plan:
The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use
actions. The location of this proposed District lies outside the Urban Development Area (UDA)
and Sewer and Water and Service Area (SWSA) and is not part of any land use plan or study by
the County. The land use within District is residential and agricultural. The current land use should
remain in its present land use of pristine condition with land use of agricultural and residential.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan can accomplish this by promoting land in an Agricultural and Forestal
District. The Comprehensive Plan supports the renewal of the District, for it provides an
opportunity for the agribusiness community to conduct long range planning efforts for the
management of their operations, while providing reserves of agricultural land through the year
2030.
Staff Comments:
This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 221.50-acre District
will be valid through August 2030.
Staff is seeking a recommendation from the ADAC to forward to the Planning Commission on
District renewal.

Permit (CUP) and more of an industrial use than an agricultural use.

District lies within the Gainesboro watershed and water is available from ponds, wells and springs.
Comprehensive Plan:
The 2035 Comprehensive Plan of Frederick County provides guidance when considering land use
actions. The location of the District lies outside the Urban Development Area (UDA) and Sewer
and Water Service Area (SWSA) and is not part of any land use plan or study by the County. The
land use within the District is agricultural and residential and nature. The current land use should
remain in its present condition with land use of orchards, agricultural, and residential.
The intent of the Rural Areas is to maintain agriculture as a significant portion of the County’s
economy and to maintain the rural character of areas outside of the Urban Development Area. The
Comprehensive Plan can accomplish this by promoting the inclusion of additional land in
Agricultural and Forestal Districts. The Comprehensive Plan supports the renewal of the District
because it provides an opportunity for the agribusiness community to conduct long range planning
efforts for the management of their operations, while providing a reserve of agricultural land
through the year 2030.
Staff Comments:
This renewal provides an opportunity for the agribusiness community to conduct long-range
planning efforts for the management of their operations. Once renewed, the 1312.44-acre District
will be valid through August 2030.
Staff is seeking a recommendation from the ADAC to forward to the Planning Commission on
District renewal.

General District Location
The District is located within the Gainesboro Magisterial District and is generally located on
Wright Road (Rt. 661) and Apple Pie Ridge Road (Rt.739). The District was added in 2023.
State Code Requirements & District History
Chapter 43, Section 15.2-4300 of the Code of Virginia, 1950, as amended, requires that
Agricultural and Forestal Districts be reviewed by the local government every five years after
establishment. The Board of Supervisors decides to approve, approve with modifications, or
deny the proposal to establish or renew a District. The District was added in 2023.

District Characteristics:
Agricultural & Forestal Significance:
The District consists of approximately 70 percent forestry uses and 30 percent open space, pasture,
and orchard. The area within the proposed District is rural in nature.
Lakes/Ponds/Streams:
A portion of the District lies within the head waters of Sylvan Springs Run and drainage area. This
will further assist with managing the quality of the County’s water resources.
Prime Agricultural Soil:
The soils for this area are Hazleton and Laidig-Weikert. Both soils are typically strongly sloping
to very steep and found on mountaintops, side slopes and ridges; these soils tend to be well drained
and consist of sandstone, quartzite, and shale. While the subject properties are primarily forested,
these soils are not classified as prime agricultural soils.
The District is located along Great North Mountain, west of Interstate 81. The topography ranges
from steeply sloping along Great North Mountain to rolling along Wrights Road (Rt.661).
