HumanResourcesMinutes2025March14 SuggestedChangesinRed 1.6Definitions Adjusted Work Schedule shall be defined as a 40 hour work week scheduled through varied hours other than the normal work hours. Administrative Closure shall be defined as work site closures authorized by the County Adminstrator due to unsafe conditions (e.g., inclement weather, hazardous circumstances, emergency situations, etc.). Administrative Termination shall be defined as termination of employment due to budgetary deficits or factors ¡¤¸®­£ ³§¤ ¤¬¯«®¸¤¤Ȍ² ¢®­³±®«ȁ Appointing Authority is the person or group of persons having authority to hire or make appointments under the laws of the State and County. Change in Pay Range for Class shall be defined as a change in pay range when it is determined that the present pay range is not commensurate with the duties and responsibilities of the class. Completion of Temporary Employment shall be the separation from employment of a temporary employee who has worked through the last workday the temporary position is available. County Closure shall be defined as work site closures authorized by the County Administrator due to unsafe conditions (e.g., inclement weather, hazardous circumstances, emergency situations, etc.). XVII.UNSAFECONDITIONS Unsafe Conditions shall be defined as a situation whereby the health or safety of citizens, clients, or employees would be placed at risk or that conditions or events prevent performance of regular operations, services or responsibilities. Frederick County Government prioritizes the safety of employees during inclement weather and hazardous conditions. Employees should use their best judgment in determining whether it is safe to travel to work. 17.1 Administrative County Closure Designation/Notification Administrative County Closure (as defined in this Policy 1.6) may be authorized by the County Administrator. In the case of Administrative County Closure or delayed opening, employees shall be sent an automated message to their contact information of record. Additionally, the information will be posted on the County web site, and social media sites, and the cable channel (Comcast Channel 16). Notification will be sent to the local radio stations - WINC and Q102media. 17.2 Unsafe Conditions Leave In the event thatIf an Administrative County Closure has been authorized, this leave shall be recorded in the timekeeping system under the category of 5­² ¥¤ #®­£¨³¨®­² ȏLeave.Ȑ a. Unsafe Conditions LeaveCounty Closure for Non-Essential Employees Non-essential employees shall not be required to make up the time. An employee who is on scheduled paid leave during an Administrative County Closure may charge Unsafe Conditions Leave in place of the scheduled paid leave (i.e., Paid Time Off (PTO), Individual Disability Account (IDA) and Compensatory Leave). However, an employee on a regular scheduled day off will not receive credit for the Administrative County Closure. b. Unsafe Conditions for Essential Employees Essential employees are individuals whose duties must be performed regardless of Unsafe Conditions, and who must report to work despite an Administrative County Closure. All essential (non-exempt and full-time) employees required by their supervisors to work during an Administrative County Closure shall be paid for all hours worked during the Administrative County Closure. . Additionally, essential employees shall be granted Unsafe Conditions Leave for the time worked, up to a maximum of eight (8) hours per day, not to exceed 32 hours per fiscal year. . Unsafe Conditions Leave hours accrued must be used within sixty ninety (6090) days (or two timesheet periods) or it will be forfeited. Any unused accrued Unsafe Conditions Leave will not be paid out at the time of termination. 17.3 Liberal Leave a. Purpose: Frederick County Government prioritizes the safety of employees during inclement weather and hazardous conditions. Employees should use their best judgment in determining whether it is safe to travel to work. If a decision is made to open the County, and employees feel they cannot make it in safely, liberal leave may be used. b. Definition: Liberal leave is an unscheduled leave option that allows employees to use their accrued Paid Time Off (PTO), compensatory leave, or, if all leave balances are exhausted, Leave Without Pay (LWOP) without requiring prior supervisory approval. Employees who elect to use liberal leave must inform their supervisor as soon as possible. c. Eligibility and Applicability: Liberal leave may be authorized under the following circumstances: )­¢«¤¬¤­³ 7¤ ³§¤±Ȁ 7§¤­ ³§¤ #®´­³¸ ±¤¬ ¨­² ®¯¤­ ¡´³ § ¹ ±£®´² ¢®­£¨³¨®­² ¬ ¸  ¥¥¤¢³ ¤¬¯«®¸¤¤²Ȍ ability to report to work safely. Other Declared Situations: As determined by the County Administrator. d. Request and Notification Procedures Employees must notify their immediate supervisor as soon as possible if they intend to take liberal leave. Supervisors shall grant liberal leave unless employees are designated as essential personnel. In these cases, the essential personnel are expected to report to work as required. e. Exception The County Administrator or designated authority reserves the right to modify, suspend, or cancel liberal leave based on operational circumstances or evolving circumstances. If there are Unsafe Conditions during normally scheduled work hours and there is no Administrative Closure, an employee shall be permitted, after appropriate contact with his/her Department Supervisor, to take Liberal Leave with the stipulation that the time must be made up within sixty (60) days. Liberal Leave make-up time shall be scheduled and approved by the Department Head. When Liberal Leave make-up hours are applied to the regular working day(s) and the total amount then results in overtime, the excess hours are not eligible for overtime payment. The timesheets for essential employees who work during a delayed opening or Administrative County Closure should reflect both the hours worked and Unsafe Conditions Leave.
