HomeMy WebLinkAboutJanuary 13, 1936 to August 10, 193662 At a meeting of the Board of Supervisors for Frederick County held at the Court House thereof on Monday January the 13th, 1936. The newly elected members C. I. Brumback, E. W. Adams, W. H. Branner, P. H. Gold and C. M. Rosenberger were all present. The meeting was called to order by the Clerk. On motion of Mr. Branner seconded by Mr. Rosenberger, C. I. Brumback was unanimously elected Chairman. COMMITTEES On motion it is unanimously ordered that the same commit that served heretofore shall continue. BUDGET On motion C/ I. Brumback is unanimously directed to pre- pare the budget for the fiscal year beginning July lst, 1936 and ending June 30th, 1937. REPORT OF I. FRED STINE I. Fred Stine, County Agent, presented his report and the same was unanimously approved. REPORT OF J. M. MASSEY J. M. Massey, Superintendent of the County Home, presented his report and the same was unanimously approved. RESOLUTIONS FOR SURPLUS PRODUCTS On motion the following resolution was unanimously adopted "Whereas it is the desire of this Board that they receive surplus commodities for the ne families of Frederick County; it is ordered that Miss Eulalia S. Nalley, Welfare Worker for Frederick County apply to State Surplus Commodity Director, 11 South 12th St., Rich- mond, Va., for said commodities and prepare such estimates and statistics as the said State Surplus Commodity Director may require." JOHN BOWMAN RENT It is ordered that the Sheriff procure a distress warrant and levy the same for back rent due by John Bowman forrent at the Hitching Yard. REPORT OF MISS NALLEY Miss Eulalia S. Nalley, Welfare Worker, presented her report and the same was unanimously approved. WARRANT FOR PETTY CASH ACCOUNT On motion the Clerk is ordered to draw a warrant for $22.87 for the petty cash account. 63 RECOMMENDATION OF SURVEYOR On.motion, A. J. Tavenner is recommended_to the Judge of the Circuit Court for appointment of County Surveyor. COMPENSATION OF CLERK .On motion the Clerk shall receive $115.00 per year as Clerk for the Board. Said allowance to be paid quarterly. SALARY OF CLERK OF THE COURT On motion it is ordered that the salary of the Clerk of the Court shall be $700.00. Said salary to be paid quarterly. SALARY OF SHERIFF On motion it is ordered that the salary of the Sheriff shall be $700.00. Said salary to be paid quarterly. SALAR OF THE COMMISSIONER OF THE REVENUE On motion it is unanimously agreed that the salary and expense account for 1936, of Lee N. Whitacre, Commissioner of the Revenue shall be the same as tentatively fixed by the Compensation Board. SALARY OF TREASURER On motion it is unanimously agreed that the salary and expense account for 1936, of Robert S. Smith, Treasurer shall be the same as tentatively fixed by the Compensation Board. SALARY OF COMMONWEALTH'S ATTORNEY On motion it is unanimously agreed that the salary for 1936, of B. P. Harrison, Commonwealth's Attorney, shall be the same as tentatively fixed by the Compensation Board. ° MINUTES OF THE PREVIOUS MEETING The minutes of the previous special meeting were read and the same were unanimously approved. CHH , CLERK 64 At a regular meeting of the Board of Supervisors of Frederick County, Virginia, held in the Court House thereof on Monday, February 10, 1936. PRESENT: C. I. Brumback, Chairman, E. W. CEDAR CUTTING On motion of Mr.'Branner, seconded by Mr. Gold the Board h approves the project of cedar cutting of which the foreman of said job is to be paid from the General County fund to be reimbursed from a levy on the orchards according to law for the same as expended for foreman and transportation of men as per each District. The acts expense of other than the foreman and transportation is to be paid from Emergency Relief Funds. REPORT OF MISS FARRAR Miss Farrar, Home Demonstrator, presented her report and the same was unanimously approved. REPORT Or' MISS NALLEY Miss Nalley, welfare Worker, presented her report and the was approved. COMMITTEE On motion it is ordered that Y. B. Gold, R. S. Smith, and B. Harrison, Commonwealth's Attorney, be appointed a committee of three to have the County hitching yard surveyed in metes and bounds which said hitching yard was formerly deeded to said County. .S URPLUS COMMODI`1'IES It is ordered that C. I. Brumback, be authorized by the Board to secure a truck to bring surplus commodities from Front Royal to Winchester to be dis- tributed among the poor. 65 DAMAuS DONE BYNDOGS It is ordered that B. P. Harrison, Commonwealth's Attorney and P. H. Gold communicate with Senator T. Russell Cather in Richmond in regard to the great amount of damage done by police dogs in this County. It is desirable to have, if possible, legislation to the effect that police dogs be tied up at night or such other remedy thatbwill reduce the large amount of damage done by these dogs: JOHN BOWMAN On motion of Mr. Rosenberger, seconded by Mr. Adams it is o ordered that John Bowman who operates a blacksmith shop on the hitching yard shall not be permitted to operate the wood yard on said lot. A copy of this minute to be sent to Mr. Bowman. HOSPITAL BILL Mr. Branner. made a motion to-pay the hospital $2000.00 but there was no second to said motion. On motion of Mr.. Rosenberger, seconded by Mr. . Adams, a motion was made to pay $1750.00 to-the hospital in full for their care and se rendered the poor for Frederick County patients during the period beginning January 1, 1935 to December 31, 1935. A recorded vote Mr. Hosenberger's motion showed the fol ing: Aye; Messrs. Rosenberger, Adams and Gold, nay; Messrs. Branner and Brumback. .It is ordered that the Clerk draw a warrant for $1750.00 payable to the Winchester Memroial Hospital for said amount. C. I. Brumback, as Chairman, asked to be relieved from the position of committing County patients to the hospital from this date on and said hos- pital will take County aptients subject to bills rendered quarterly at which time the Board of Supervisors will pass upon and pay said bills or a portion thereof as approved by said Board, which said request was granted. . H ITCHING YARD BE IT RESOLVED, by The Board of Supervisors of Frederick County, Virginia, at a meeting held at the County Courthouse in Winchester, Virginia, on the 9 day of March, 1936, at which there was a quorum present and voting, that the offer of the City of Winchester to purchase the hereinafter described property, belonging to the County of Frederick, for the cash sum of Two Thousand (82,000.00) Dollars be and it hereby is accepted subject to the approval of the Circuit Court of Frederick County, Vir- ginia. The description of the property to be conveyed is as follows:- Beginning at a point at the intersection of the sou line of Boscawen Street with the east property line of Cameron Street, said point being seven feet south of the south curb of Boscawen Street and twelve and four tenths feet east from the east curb of Cameron Street; thence with the present south property line of Cameron Street east 188.6 feet to a lot owned by the Consumers Utilities Company; thence with a line of said lot at right angle to said property line, south eleven feet; thence with the said Frederick County's other land, and on a line parallel to the first line, westwardly 188.6 feet to a corner to said other land, in the east property line of Cameron Street, said point being 12.4 feet from the east curb of said street; thence with the east property line of said street on a line paralleling said street, northwardly ele- ven feet to the point of beginning, containing 2,074.4 square feet. REST ROOM Mr. Bell, Secretary of the Chamber of Commerce appeared be- fore the Board and asked to be relieved of the management of the Rest Room, and on motion the Board agrees to relieve Mr. Bell of the management of said Rest Room as of April the 1st, 1936, subject, to the approval of the Board of Directors of the Chamber of Commerce. Miss Farrar,_Home Demonstration Agent, presented her report and PETITION FOR REPAIR OF BRIDGES AND REPAIR AND RELOCATION OF ROAD # 704. A petition signed by a large number of re of the County, was presented to the Board requesting the Highway Department to build bridges where nece sary, repair and relocate Road ## 704 from Gore to the West Virginia line. On motion Board unanimously recommneds that the State Highway Commission build the necessary bridges and relocate and repair said road. WOOD IN HITCmING YARD .On motion of Cdr. Rosenberger, seconded by Mr. Gold it is ordered that no wood be unloaded or stored in the hitching yard by any one. For said motion Mr. Rosenberger, Mr. Adams and Mr. Gold. DESA FOR CLERK'S OFFICE On motion the Clerk is given permission to purchase a steel desk for the Clerk's Office. PERMISSION FOR SCHOOL BOARD TO BORROW MONEY School Board," The Following resolution was received from the Frederick County Winchester, Virginia March 9 ,1936 The School Board of Yrederick County at its meeting held on March 9th, 1936, a quorum being present, directed the Division Superintendent to prepare an application for a loan from the Literary Fund of fifteen thousand dollars, the same to be used in paying off a loan of fi£tben thousand dollars in the Union Bank which was borrowed to be used in the erection of the GainesbororSchool. An abstract of title for the school lot on which the building was erected having been prepared, it is directed that this application be submitted to the Board of Supervisors of Yrederick County and if approved the application for the loan and the abstract of title are to be submitted to the State Board of Education. FRED THWAITE, CHAIRMAN ELIZABETH LUCAS SHEETZ, CLERK" On motion the borrowing of said amount by the said Frederick Coun School Board in accordance with said resolution, is hereby unanimously approved. I. Brumback, Chairman of this Board, is authorized, empowered and instructed to execute and deliver on behalf of the Board of Supervisors of Frederick County a deed conveying the said property, to which said deed the seal of this County shall be affixed and attested by C. C. Brannon, Clerk of this Board, and the said deed shall be delivered upon the payment to the Treasurer of Freder County of the said sum of Two Thousand ($2,000.00) Dollars. I. Brumback, Chairman, Phil H. Gold, W. H. Branner, C. M. Rosenberger, and E. W. Adams. BUDGET ALLOWANCE FOR HOSPITAL On motion of Mr. Branner, seconded by Mr. Gold, that an allowance of $1800.00 be placed in the budget for the Winchester Memorial Hospital for the caland year of 1936 and on a recorded vote MR. Branner, Mr. Gold, Mr. Adams, and Mr. Rosenber voted in favor of said amotionce and Mr. Brumback voted against said motion. PUBLICATION OF BUDGET The making of the budget for the calandar year of 1936 was complete and a synopsis of same was ordered to be published in the Winchester Evening btar once a week for four weeks. TENTATIVE LEVY On motion the following tentative levy for 1936 was made. HITCHING YARD MONEY On motion it is ordered that the $2,000.00 to be received for the strip of land off the Hitching Yard sold to the City be set aside as a building fund. MINUTES OF THE PREVIOUS MEETINGS The minutes of the last regular meeting and the special meeting of March 23rd, 1936, were read and unanimously approved. ROAD FUND On motion of Mr. Branner, seconded by Mr. Adams, it is unanimously ordered that the balance in the construction fund not used in Frederick County, Virginia, be transferred to the maintenance fund for roads. PAINTING OF THE COURT HOUSE On motion of Mr. Rosenberger, seconded by Mr. Adams, it is unanimou ordered that the Court House be painted and certain parts of the wood work which are rotten be replaced with new wood. R. S. Smith and P. H. Gold are hereby g7pointed a commit who shall advertise for bids for the painting job and take charge of the necessary repair work to be done. WOOD CHUCK LANE On motion of Mr. Branner, seconded by Mr. Gold, it is asked that the Board pass a resolution asking Mr. Bozel to maintain the road leading from Route 50 to Opequon Post 70ffice known as Wood Chuck Lane. Said resolution was approved unanimously. ADOPTION OF DOG LAW It is ordered that Section 3305, subsection 69a of the Code of Vip- ginia be unanimously adopted. It is also ,ordered that the above section together with a copy of this resolution be published in the Winchester Evening Star once a week for two successive weeks. It is further ordered by the Board of Supervisors that exception be made hereto of fox hounds when on a chase or returning from a chase of foxes. PETTY CASH �f On Motion it is ordered that the Clerk draw a check for $`45.21 for the Petty'Cash account, payable to R. S. Smith, Treasurer. ALDOVlaCE FOR MAKING BUDGET It is ordered that the Clerk draw a check payable to C. L. Brumback; for $25.00 for making the budget for the years 1936 -1937. MINUTES OF THE PREVIOUS MEETING The minutes of the previous meeting were read and unanimous] approved. BUDGET BOOK On motion of Mr. Branner and seconded by Mr. Gold it is ordered that the budget book be produced at each meeting and the amount allowed for each fund and the balance remaining in each fund be ascertained. ADOPTION OY BUDGET A delegation from Back Creek and Gainesboro Districts appear ed before the Board of Supervisors objecting to the School levy on the grounds that they school are not receiving what they consider equitable /facilities. Their protest was based pri- marily on the road conditions and three members of the School Board being present assured this aelegation that if road conditions could not be improved in such manner as would make it possible to operate school buses the next term that they would be furnished a school in their community separate from the consolidated schools. Upon this assurance from the School Board members the delega tion from the County had no further complaint as to the levy being changed from the amoun 72 stated in the budget. There being no other tax payers before the Board to speak for or against the levy as stated, and on motion of Mr. Branner, seconded by Mr. Gold, that the budget be adopted as published, which said motion was unanimously approved. The minutes of the special meeting of Apr. 20th, 1936, were read and the same were unanimously approved. PUBLISHING OF COMPENSATION OF CLERK AND SHERIFF On motion it is ordered that the compensation and expense of the Clerk of the Court and Sheriff be published once a week for two weeks in the Winchest Evening Star. ROAD LEADING FROM ROUTE 11 TO ROUTE 652. A petition was presented to the Board requesting that the ro leading from Route 11 and beginning just South of the bridge over the Creek at Kernstown on said Route 11 and continuing west arounff by the Old Opequon Memorial Presbyterian (,'hurc and the ancient burial ground attached thereto, and continuuing west and intersecting road 74 #652, be taken into the Secondary Highway System. On motion the Board unanimously recommend that the Highway Commission place said road in the Secondary Highway System, and the Clerk is directed to send a copy of this resolution to the State Highway Commissic R EPORT OF MISS NALLEY from the General Uounty Fund. I. Bruu back, Chairman of the Board of Supervisors, R. S. Smith, Treasurer of Frederick County, C. C. Brannon, Clerk of the Circuit Court of Frederick County, B. P. Harrison, Common- wealth's Attorney for Frederick County, Lee a N. Whitacre, Commissioner of the Revenue for Frederick County, and Harry L. McCann, Sheriff of Frederick County, be appointed as a committee of six to submit plans as soon as they can be had. Project # 1393A. PETITION TO BOROW MONEY The following resolution was received from the Frederick Coun School Board. " Winchester, Virginia June 8, 1936. At a meeting of the Frederick County School,Board held on June 8, 1936 all members being present, the following resolution was passed by the unanimous vote of the Board: Whereas, the balance in the 'treasurer's office to the of the School Board is $6,550.56 and whereas the uncollected school taxes for 1934 -1935 02,457.26 and for 1935 -1936 the uncollected school tax is $9,741.36, making a total of $12,198.62 and whereas there are not sufficient funds in hand to pay the bills now due, therefore be it resolved that the School Board request the board of Supervisors of Fred County to approve a loan from bank on July 1, 1936 of $8,000.00, or as much thereof, as may be necessary depending on the amount collected by the treasurer up to that date, to ck 76 be paid back to the bank during the fiscal year of 1936 - 1937. ORDINANCE IN REFERENCE TO DOGS Be it ordained, that on and after July 1, 1936, it shall be un- lawful for any dog unaccompanied by some person to roam between sunset and sunup. If a dog is found off the premises where he is regularly kept shall be deemed to be roaming. For violation of this ordinance the owner, and /or the person in charge and control of the said dog, shall be guilty of a misdemeanor and upon conv thereof shall be fined not less than $5.00 nor more than $50.00 for each offense. If the said dog commits any depredations upon the person or property of any person, or if he be afflicted with any contagious.or dangerous disease, the said dog shall be killed upon orde of the Trial Justice. Harrison, Commonweal Attorney: RESOLUTION OF PARTICIPATION IN STATE PUBLIC ASSISTANCE PROGRAM On motion of Mr. Gold, seconded by Mr. Rosenberger, the ing resolution was adopted: BE IT RESOLVED, by the Board of Supervisors of the County of Frederick, that need of state assistance existing in the County of Frederick, to provide iI s 77 for destitute persons in need of public relief, application is herewith made tothe Commissioner of Public Welfare,.pursuant to provisions of Chapter 223, Acts of Assembly, 1936, for participation in the state relief appropriation subject to the provision of the said Act and Rules and Regulations which have been adopted or may hereafter be adopted by the Governor pursuant to the provisions of the said Act, which it is herewith agreed will be complied with in the administration of the said funds. It appearing under the said Act that the said county of Frederick is entitled to the sum of $5,028.99 for the year beginning July 1, 1936, provided the said codnty of Frederick appropriates the sum of $3,017.39 to match said state allowance, be it, therefore, resolved that the sum of $3,017. be, and the same is hereby, appropriated to provide for destitute persons in need of public relief and the same is hereby segregated to match the said state allowance to be expended in the manner provided by said Act and the Rules and Regulations adopted pursuant thereto. The Clerk is herewith authorized to prepare and submit the necessary forms and supporting data to accompany this application. It is ordered that the Board do now adjourn. NALLEY Mrs. Nalley, Superintendent of the Board of Public Welfare, presented her report and the same was unanimosuly approved. TRANSFER OF FUNDS _ On motion it is unanimously ordered by the Board of Super- visors that $679.00 be transferred from the General County Fund to the Virginia Public Assistance Fund. BOND OF MRS NALLEY It is ordered by the Board of Supervisors that a bond be se- cured to cover the expenditure of County and State funds through Mrs. Nalley as Welfare Superintendent in the amount of $2000.00 and said bond to be filed with the Clerk of the County Court and R. S. Smithis hereby authorized to secure and pay for said bond from the General County Fund. ADDITIONAL SALARY OF MRS. NALLEY It is ordered by the Board of Supervisors that Mrs. Nalley be allowed $20.00 per month additional salary to be paid out of th 10% from the Virginia Public Assistance Fund which said 10% is placed in the General County Fund and this additional pay shall cove all mileage and traveling expenses. REMODELING OF CLERK'S OFFICE Tentative plans were submitted by the committee appointed to secure same for remodeling the Clerk's office, and on motion of Mr. Gold seconded by Mr. Rosenberger, the said plans are unanimously approved and the said committee is hereby authorized to have blue prints,'specif'ications and estimation of costs made to be present- ed to the Board for future consideration. DOG LAW Intention to pass the following ordinance having been ad- vertised according to law, it is hereby enacted: " Be it ordained, that on or after July 1, 1936, it shall be unlawful for any dog unaccompanied by some person to roam between sunset and sunup.
