BE IT RESOLVED,that the Board of Supervisors for the County of Frederick,Virginia,does hereby approve a
General Fund Supplemental Appropriation and an Economic Development Authority Supplemental Appropriation in
the amount of$150,000.00 for a Local Economic Development Incentive Grant as stated in the Performance
Agreement to assist in the location for DESI FRESH FOODS,LLC, in Frederick County,Virginia.

appropriate the payment of$150,000.00 to the Economic Development Authority of Frederick County,Virginia
from the Commonwealth Opportunity Fund to assist in expanding the operation for DESI FRESH FOODS,LLC in
Frederick County,Virginia.
BE IT RESOLVED,that said funds are subject to an executed Performance Agreement outlining the required
performance criteria.
BE IT FURTHER RESOLVED,that the Board of Supervisors for the County of Frederick,Virginia,does authorize
the County Administrator to execute the Performance Agreement on its behalf.

The Board of Supervisors of Frederick County,in regular meeting on the 11th day of
December 2024,adopted the following:

WHEREAS,the streets described on the attached Form AM-4.3,fully incorporated herein by reference, are shown
on plats recorded in the Clerk's Office of the Circuit Court of Frederick County; and
WHEREAS,the Resident Engineer of the Virginia Department of Transportation has advised this Board that the
streets meet the requirements established by the Subdivision Street Requirements of the Virginia Department of
Transportation; and
WHEREAS,the County and the Virginia Department of Transportation have entered into an agreement on June 9,
1993,for comprehensive stormwater detention which applies to this request for addition; and
NOW,THEREFORE,BE IT RESOLVED,this Board requests the Virginia Department of Transportation to add the
streets described in the attached Form AM-4.3 to the secondary system of state highways,pursuant to 33.2-705,
Code of Virginia,and the Department's Subdivision Street Requirements; and
BE IT FURTHER RESOLVED,this Board guarantees a clear and unrestricted right-of way, as described, and any
necessary easements for cuts,fills and drainage; and
BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded to the Resident Engineer for the
Virginia Department of Transportation.

Supervisor Jewell offered condolences on the death of Shawneeland Sanitary District Advisory
Committee member Paul Gartner.
Chairman Ludwig offered condolences to Commissioner of the Revenue Tonya Sibert upon the
death of her mother.
COUNTY OFFICIALS
BROADBAND INITIATIVE UPDATE
County Administrator Michael Bollhoefer provided an update on the regional broadband initiative and
noted that Jimmy Carr of All Points Broadband will address the Board in January 2025 with a more detailed
update.

SCHOOL ZONE PHOTO SPEED ENFORCEMENT SYSTEM PROPOSAL
Sheriff Lenny Millholland introduced Lt. Warren Gosnell, Sheriff's Office Traffic Division Commander.
Lt. Gosnell gave a presentation explaining a proposal from Blue Line Solutions to install photo speed
monitoring enforcement systems in school zones.
The Board and Lt. Gosnell discussed the proposal and the specific school zones identified in the
document.
Chairman Ludwig opened the public comment period.
The following addressed the Board:
James Moulder, Stonewall District, spoke in opposition to the use of photo speed monitoring
enforcement systems in school zones.

Joseph Brand,Stonewall District, spoke in opposition to the use of photo speed monitoring enforcement
systems in school zones and provided a petition supporting his position.
Tim Regan, Back Creek District, spoke in opposition to the use of photo speed monitoring enforcement
systems in school zones.
Robert Gallalee, Back Creek District, spoke in opposition to the use of photo speed monitoring
enforcement systems in school zones.
Leslie Spencer, Gainesboro District, spoke in favor of school safety.
Chairman Ludwig closed the public comment period.
Chairman Ludwig noted his concerns about both the proposal and the suggested contract.
Supervisor Jewell said he had spoken to sheriffs in other localities and supported the proposed use of
photo speed monitoring enforcement systems in school zones.
Supervisor Wells spoke in favor of the proposed use of photo speed monitoring enforcement systems
in school zones.
Supervisor Liero spoke in favor of the proposed use of photo speed monitoring enforcement systems
in school zones.
Supervisor Dunn spoke in favor of the proposed use of photo speed monitoring enforcement systems
in school zones.
Chairman Ludwig said he was not in favor of a taxing system when other solutions may be available.
The Board and Lt. Gosnell discussed the proposal. It was noted that by the Code of Virginia, the Sheriff
may proceed with procuring the enforcement system without further action by the Board. It was also noted
that the proposed contract would be reviewed by legal counsel before being finalized.
Randy Campbell of Blue Line Solutions reviewed policies and procedures used by the company
regarding data handling.
Chairman Ludwig polled the Board for an informal consensus on the use of such systems. All members
expressed support for the use of the photo speed monitoring enforcement systems in school zones except
the Chairman who said he was opposed.

PLANNING COMMISSION BUSINESS—PUBLIC HEARINGS
REZONING #07-24 OF WILLIAM AND BARBARA HOUDERSHELL - DENIED
Planner Kayla Peloquin explained the request for rezoning the property from M1 (Light Industrial) to
RA (Rural Areas) District in an effort to protect the historic property by restricting the allowed uses and
ensuring future underwriting for loans on the property is not obstructed.
Chairman Ludwig opened the public comment period.
Alax Vonhell, representing an adjoining property owner spoke in opposition to the rezoning because
it will negatively affect the adjoining property's allowable uses.
Karen Beck-Herzog of the Cedar Creek and Belle Grove National Historic Park spoke in favor of the
rezoning which would support a preservation effort.
John Good, representing an adjoining property owner spoke in opposition to the rezoning because
it will negatively affect the adjoining property's allowable uses.
Ty Lawson, representing an adjoining property owner spoke in opposition to the rezoning because
it will negatively affect the adjoining property's allowable uses.
Leslie Spencer, Gainesboro District, spoke in favor of preservation and agriculture.
Chairman Ludwig closed the public comment period.
The Board and Mr. Pearson discussed the requested rezoning. Supervisor Wells said he hoped to
find a solution that would please both sides.
Vice Chairman Slaughter and Supervisors Lockridge and Dunn spoke in favor of denial of the
rezoning.
Supervisor Jewell moved for denial of Rezoning #07-24 of William and Barbara Houdershell.

Supervisor Liero offered reports from the Planning Commission and the Parks and Recreation
Commission.
Supervisor Jewell noted a vacancy on the Shawneeland Sanitary District Advisory Committee.
Chairman Ludwig offered an update from the Frederick Water Board.
CITIZEN COMMENTS
James Moulder, Back Creek District, discussed an effort to recall School Board Member Sturdivant.
BOARD OF SUPERVISORS COMMENTS
Supervisor Dunn expressed appreciation for our freedom to have meetings with open speaking
opportunities.
CLOSED SESSION
At 10:00 p.m., Vice Chairman Slaughter moved that the Board of Supervisors of Frederick County
enter a closed session pursuant to Virginia Code Section 2.2-3711 (A) (1) for discussion and consideration
of prospective candidates for employment as the County Attorney; and pursuant to Virginia Code Section
2.2-3711 (A) (3) for discussion of the disposition of publicly held real property, where discussion in an open
meeting would adversely affect the bargaining position or negotiating strategy of the public body. Supervisor
Lockridge seconded the motion which carried on a voice vote.
At 10:27 p.m., the Board members being assembled within the designated meeting place in the
presence of members of the public and the media desiring to attend, the meeting was reconvened on motion
of Vice Chairman Slaughter, seconded by Supervisor Dunn, and carrying on a voice vote. Vice Chairman
Slaughter moved that the Board of Supervisors of Frederick County certify that, to the best of each member's
knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia
law were discussed in the closed meeting to which this certification applies, and (ii) only such public business
matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by
the Board. Supervisor Lockridge seconded the motion which carried as follows on a recorded vote:

The Parks and Recreation Commission met on Tuesday, November 12, 2024. Members

TRANSPORTATION COMMITTEE REPORT to the BOARD OF SUPERVISORS
Monday, November 25, 2024
8:30 a.m.

ATTENDEES:
Committee Members Present: Judith McCann-Slaughter Chair (Voting), Will Weber
(Voting), Brandon Monk (Voting), Josh Ludwig (Voting), Robert Liero (Voting) and Tim
Stowe.
Committee Members Absent: Donald Capps, and Lewis Boyer(Liaison Stephens City)

ITEMS FOR INFORMATION ONLY:
Route 37 Eastern Frederick Transportation Study: Staff updated the Committee on the outcome
of the work session with the Planning Commission on November 20th. Staff reported that it was
well received with good discussion from those in the audience. Once all the comments are
received, Staff will be present those to the Committee.
VDOT Road Maintenance Prioritization Process: VDOT staff gave a presentation on how they
prioritize roadways for maintenance spending. Ed Carter, VDOT explained the criteria for
determining road paving projects. VDOT measures roads via a Critical Condition Index (CCI) to
assess the condition of the roadway. CCI is a key factor in determining which roads require
maintenance or repair based on their level of deterioration to see where the condition falls on a
scale. The Committee had many questions after VDOT explained why VDOT has fewer dollars to
road projects in the area since the higher score indicates better road condition,while lower score
signifies a poorer condition. According to data the Staunton District has some of the highest
ratings that means less funding for projects in our area.
Capital Improvement Plan (CIP) Update: Staff gave an overview of the basic updates that reflect
the recent grant approvals for the County applications for the upcoming CIP. Also, Staff gave an
overview of the project additions that represent potential applications in the upcoming round of
Transportation Alternatives and Revenue Sharing programs through VDOT. The Committee
recommended adding Hopewell Road and Brucetown Road realignment project to the CIP. Also,
Staff recommended the potential Alternatives funding application would be completing a quarter
mile trail improvement to the north along Cross Keys Place this round of funding requires a 20%
local match for this funded project.The Committee recommend that more information is needed
on this potential Alternative funding application before moving forward. Staff will bring more
information to the Committee at the next meeting.

Metropolitan Planning Organization (MPO) Study -Exit 321-323 Transportation Study: Staff
presented the MPO work program task 7 that included the project to study traffic, potential traffic
and the needs around Exit 321-323 to the Committee.
Potential Pilot Program for Increased Truck Weights on Interstates: Staff presented legislation
that is under development that could increase the maximum tractor trailer weights on Interstate
highways. The Committee recommended covering this topic more thoroughly at the next meeting
since they will have all the necessary details.
County Project Updates: Renaissance Drive: The expected date has been pushed back by CSX
several times and is currently in March 2025 for the installation of the rail crossing. Staff has
continued to work with the Commonwealth Transportation Board (CTB) members and has
reached Congressman Clines office seeking support in avoiding further delays by CSX.
Gainesboro Road/Route 522 Intersection Project: Staff does not have any additional updates at
the time, as the County's consultant merges the on-site design drawings with the roadway
drawings to create a single set with a cost estimate.
Route 37(Eastern Frederick Transportation) Study: Discussed previously.
