FREDERICK COUNTY BOARD OF SUPERVISORS

WEDNESDAY, NOVEMBER 6, 2024

Board of Supervisors: Board of Supervisors:Josh E. Ludwig, Chairman; Judith McCann-Slaughter,
Vice Chairman; Robert W. Wells; Heather H. Lockridge; John F. Jewell; and Robert T. Liero were present.
Blaine P. Dunn was absent.
Planning Commission: Tim Stowe, Chairman; Betsy Brumback; Roger L. Thomas; Jason Aikens;
Charles Markert; Justin Kerns; Elizabeth D. Kozel; Mollie Brannon; Kevin Sneddon; Chad DeHaven; Charles
E. Triplett; and Jeff McKay were present. Robert S. Molden was absent.
Staff Present: Michael Bollhoefer,County Administrator; Jay E. Tibbs, Deputy County Administrator;
Austin Cano, Assistant County Attorney; Wyatt Pearson, Planning Director; John Bishop, Assistant Director
of Planning; Tyler Klein, Mark Cheran, Zoning & Subdivision Administrator; Amy Feltner, Planner I; Kayla
Peloquin, Planner I; Senior Planner; Karen Vacchio, Public Information Officer; Scott Varner, Director of
Information Technologies; and Ann W. Phillips, Deputy Clerk to the Board of Supervisors.
CALL TO ORDER
Chairman Ludwig called the meeting to order at 5:00 p.m.
ZONING ORDINANCE DIAGNOSTIC
Mr. Pearson introduced Caroline Vanterve of the Berkley Group who offered a presentation on a
Zoning Ordinance Diagnostic performed by the Berkley Group. She said the Zoning Ordinance was assessed
for compliance with the Code of Virginia and analyzed for potential improvements to structure and content.
Following discussion by the Board and the Planning Commission, Mr. Pearson said that Planning
and Development staff will prioritize future ordinance amendments for inclusion in the department's work
program and will utilize consultants on the project.

WESTERN FREDERICK LAND USE PLAN— SENT FORWARD TO PUBLIC HEARING BY
CONSENSUS
Senior Planner Tyler Klein reviewed the Western Frederick Land Use Plan study area of the County
saying it is envisioned to provide "a planned transition from the urban and suburban nature of the City of
Winchester and the rural areas west of Route 37." He reviewed the community engagement process used to
determine proposed changes in the Plan.
Following discussion by the Board and Planning Commission, the Board members agreed by
consensus to send the draft Western Frederick Land Use Plan forward to public hearing.
PLANNING COMMISSION ADJOURNMENT
The Planning Commission adjourned at 6:39 p.m.
CLOSED SESSION
At 6:39 p.m., Vice Chairman Slaughter moved that the Board of Supervisors of Frederick County
enter a closed session pursuant to Virginia Code Section 2.2-3711 (A)(5) for discussion concerning a
prospective business or industry where no previous announcement has been made of the business' or
industry's interest in locating its facilities in the community. Supervisor Lockridge seconded the motion which
carried on a voice vote.
At 7:06 p.m., the Board members being assembled within the designated meeting place in the
presence of members of the public and the media desiring to attend, the meeting was reconvened on motion
of Vice Chairman Slaughter, seconded by Supervisor Lockridge, and carrying on a voice vote.Vice Chairman
Slaughter moved that the Board of Supervisors of Frederick County certify that, to the best of each member's
knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia
law were discussed in the closed meeting to which this certification applies, and (ii) only such public business
matters as were identified in the motion convening the closed meeting were heard, discussed, or considered by
the Board. Supervisor Wells seconded the motion which carried as follows on a recorded vote:
