WHEREAS, WAIVER APPLICATION #02-24 was submitted by O-N Minerals (Chemstone) Company d/b/a/ Carmeuse Lime & Stone, Inc. on behalf of Bluegrass Material Company to request a waiver of the structure height limitation for the EM (Extractive Manufacturing) Zoning District of 45' in height as specified in §165-608.06 to allow for equipment up to 90' in height. The property is located at 351 McCune Road, Middletown, Virginia, and is identified with Property Identification Number 90-A-2 in the Back Creek Magisterial District; and WHEREAS,the Frederick County Planning Commission held a public hearing on this height waiver application on May 15, 2024, and recommended approval; and WHEREAS, the Frederick County Board of Supervisors held a public hearing on this height waiver application on June 12, 2024; and WHEREAS, the Frederick County Board of Supervisors finds the approval of this height waiver to be in the best interest of the public health, safety, and welfare, and in good zoning practice; and NOW, THEREFORE, BE IT RESOLVED by the Frederick County Board of Supervisors, that a structure height waiver as allowed in §165-608.06 of the Frederick County Zoning Ordinance is approved to allow for the specified equipment to exceed the 45' height limitation up to but not to exceed 90' in height. The waiver request includes a proposed silo of 72', a proposed conveyor height to feed the silo of 85', a proposed bucket elevator height of 87', and a proposed screen tower height of 90'. The height waiver for 90' provides a maximum for all proposed equipment. Zoning Ordinance Requirements: §165-608.06 Extractive Manufacturing District Height Limitations: The maximum structure height shall be 45 feet. The Board of Supervisors may waive the forty-five-foot height limitation, provided that it will not negatively impact adjacent uses. In order to consider the waiver, the applicant must submit all information and adhere to requirements specified by § 165-204.28. In no case shall any structure exceed 200 feet in height. §165-204.28. Height waivers in EM (Extractive Manufacturing), M1 (Light Industrial) and M2 (Industrial General) Districts: Waiver requests for height increases in the EM, M 1 and M2 Zoning Districts shall adhere to the following requirements: A. Architectural renderings of the proposed structure shall be submitted for review by the Planning Commission and the Board of Supervisors. B. The Board of Supervisors may require buffer and screening elements and/or additional distance when deemed necessary to protect existing adjacent uses. C. The Board of Supervisors may require additional conditions as deemed necessary. D. This waiver shall not be permitted to increase the height of any signage regulated by §165-201.06. Carmeuse Middletown Height Waiver Page 2 E. The Planning Commission and the Board of Supervisors shall hold a public hearing for any height waiver request. Planning Commission Summary and Action of the May 15,2024 Meeting: The Planning Commission asked about the height of existing equipment at this quarry and staff noted there is existing equipment at 90' in height. Planning Commissioners though that restricting the height to a specific figure for each piece of equipment would be too burdensome and staff noted that this information was included as it was proposed by the applicant and the waiver would be considered to limit the maximum height overall to 90'. Logan Thompson shared photo renderings of the proposed equipment and said that the new equipment will be nestled amongst existing equipment that is already 90' in height. The 90' waiver would establish a height "ceiling" for new equipment and the heights of the proposed new equipment that exceeds the 45' height limit were listed in the application for transparency. Logan Thompson said the renderings have been presented to the Cedar Creek Battlefield Foundation, Belle Grove, and the National Park Service (NPS). The NPS provided a neutral color palette for the equipment and Logan Tompson stated that Carmeuse will adhere to the neutral colors to minimize any visual impact. Logan Thompson stated there will be no additional noise with the proposed equipment and any lights would be installed to meet the Mine Safety and Health Administration (MHSA) regulations and the Frederick County Zoning Ordinance for lighting standards. More details will be provided through the site plan process. One public comment was made by the owner of an adjoining farm, who spoke in support of the application. The Planning Commission recommended approval of the height waiver for 90' overall. Conclusion: Following a public hearing, a decision regarding this waiver application by the Board of Supervisors would be appropriate.
