RESOLUTION
TO INITIATE A ZONING MAP AMENDMENT TO REZONE
PROPERTY IDENTIFICATION NUMBER 44-A-17 FROM RESn>ENTlAL
PERFORMANCE (RP) TO RURAL AREAS (RA).
WHEREAS, in the 1980 comprehensive rezoning of the County it was
proposed to rezone Property Identification Number (PIN) 44-A-17 from R-3 to A-2,
but the comprehensive rezoning resolution adopted by the Board of Supervisors on
October 8, 1980, failed to include the parcel in the list of parcels rezoned; and
WHEREAS, that parcel contains approximately ten acres; and
WHEREAS, the current Zoning Map designates the zoning on the parcel as
Residential Performance (R P); and
WHEREAS, RP zoning on the parcel is inconsistent with the Comprehensive

Plan- and

WHEREAS, all of the property adJoming PIN 44-A-17 is zoned Rural Areas
(RA) or arc lots containing one single family residence; and
WHEREAS, the use or the ten acre parcel at HP permitted density would not
be compatible with the rural community in which the property is located; and
WHEREAS, the public necessity, convenience, general welfare, and good
zoning practice requires that PIN 44-A-17 be rezoned rrom RP to RA.

NOW, THEREFORE, be it RESOLVED that, pursuant to * 15.2-2286(A)(7) of
the Code of Virginia and S 165-8 of the Frederick County Zoning Ordinance, the
Board of Supervisors hereby initiates an amendment to the Zoning Ordinance to
change the zoning district designation of Property Identi fication Number 44-A-17
from Residential Performance (RP) to Rural Areas (RA).
And be it further RESOL VED that this proposed amendment be hereby referred
to the Planning Commission for its recommendation.
And be it further RESOL VED that this proposed amendment be scheduled for
ajoint public hearing wi th the Planning Commission, and that staff schedule and give
the required public notice ror the joint public hearing.
