CALL TO ORDER
Chairman DeHaven called the meeting to order at 7:00 p.m.
INVOCATION
The Reverend Dennis Smith of Valley Bible Church delivered the invocation.
PLEDGE OF ALLEGIANCE
Vice Chairman Dunn led the Pledge of Allegiance.
ADOPTION OF AGENDA-APPROVED
The proposed agenda was adopted, with the addition of a discussion item regarding the public safety
radios system tower planned for installation on Poorhouse Road, on a motion by Supervisor Graber and
seconded by Supervisor Lockridge.

RESOLUTION RELATING TO THE SUPPORT OF
THE VIRGINIAAMERICA 250 COMMISSION RECITALS:
A. The Board of Supervisors of the County of Frederick, VA is dedicated to the furtherance of economic
development and tourism in Frederick County and the surrounding region.
B. The Virginia America 250 Commission(VA250)was created in 2020 by the General Assembly for the purpose of
preparing for and commemorating the 250th anniversary of Virginia's participation in American independence.
C. VA250 has requested that each locality form a committee to aid in planning for the commemoration period.

WHEREAS, the Winchester-Frederick County Convention and Visitors Bureau will form a local VA250 committee
on behalf of the County of Frederick; and
WHEREAS, the committee will plan and coordinate programs occurring within the locality and communicate
regularly with VA250; and
WHEREAS, the Board of Supervisors wishes to undertake this endeavor with VA250 to promote and commemorate
this important historic milestone.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF
FREDERICK:
1. The Board of Supervisors hereby desires to support the Virginia America 250 Commission and its efforts to
commemorate the 250th anniversary of Virginia's participation in American independence.
2. The Winchester-Frederick County Convention and Visitors Bureau will form a committee on behalf of the
County of Frederick to aid in the planning for the commemoration period.

Vice Chairman Dunn noted the response to a lightning strike and subsequent fire concerns at his
home and thanked the Greenwood Fire and Rescue personnel who assisted him.

REQUEST FOR BOARD ACTION REGARDING RESTRICTION OF LEASING OF TOWER SPACE AT
THE PUBLIC SAFETY COMMUNICATIONS TOWER PLANNED FOR POORHOUSE ROAD -
APPROVED
Supervisor Lockridge moved that the Board direct staff to add an item to the September 13 Board
agenda for Board action to prohibit the leasing of tower space on the public safety communications tower
slated for installation on Poorhouse Road. Supervisor Graber seconded the motion which carried on a

On motion of Vice Chairman Dunn, seconded by Supervisor Wells, Philip Haines, Diane Kearns,
and Judith McCann-Slaughter were each reappointed on a voice vote to the Conservation Easement
Authority for a 3-year term ending August 24, 2026.
GARY BAILEY APPOINTED TO SHAWNEELAND SANITARY DISTRICT ADVISORY COMMITTEE
-APPROVED
On motion of Supervisor Graber, seconded by Supervisor Lockridge, Gary Bailey was appointed
on a voice vote to the Shawneeland Sanitary District Advisory Committee for a 2-year term ending August
9, 2025.

Vice Chairman Dunn moved that the Board accept the bid offered by RCS Investments for the
purchase of 901 Aylor Road. Supervisor Graber seconded the motion.
Vice Chairman Dunn reviewed the bid process and explained his support for accepting the bid.

Supervisor Graber cited his support for accepting the bid and said there was no conflict of interest
with Supervisor Lockridge voting on the issue since there will be no financial gain realized in the
transaction.
Supervisor Lockridge said she supports the bid and does not have a conflict of interest regarding
the sale of the property.
Supervisor Ludwig cited his support for accepting the bid and said there was no conflict of interest
with Supervisor Lockridge voting on the issue. He expressed an interest in having verification that the buyer
will convey the property to Eukarya Christian Academy within a specific time frame.
Supervisor Graber moved to amend his motion to include a direction that the property be conveyed
to the Academy within 18 months of the purchase. Supervisor Ludwig seconded the motion to amend which
carried on a recorded vote as follows:

PLANNING COMMISSION BUSINESS—PUBLIC HEARINGS
CONDITIONAL USE PERMIT #03-23 FOR CANDACE LUNDIN DVM & FRANK ZUREICK (EVAN
LUNDIN)— DENIED
Planner Amy Feltner reviewed the request for a Conditional Use Permit (CUP) for Candace
Lundin and Frank Zureick for a dog kennel and breeding facility and listed the conditions to be attached to
the CUP if the Board of Supervisors should find the application to be appropriate.
The Applicant, Candice Lundin, DVM, and the Board discussed the breeding operation and
specifics about the kennel activities.
Chairman DeHaven opened the public hearing. The speakers were as follows:

Senior Planner Tyler Klein presented the following two proposals to the Board:
Proposal A: Conversion of Allowed Uses Terminolocl
The first proposal is to amend"Allowed Uses" tables contained in the planned development(Article V), and business
and industrial districts (Article VI)to update and convert the permitted uses terminology to the North American
Industry Classification System (NAICS) and remove reference to the Standard Industrial Classification (SIC) in other
sections the Zoning Ordinance.

scheduled meeting on July 5,2023 and agreed with the proposed changes;
WHEREAS,the Frederick County Board of Supervisors discussed the proposed changes at their regularly scheduled
meeting on August 9,2023;
NOW,THEREFORE,BE IT REQUESTED by the Frederick County Board of Supervisors,that in the interest of
public health,safety,general welfare,and good zoning practice,the Frederick County Planning Commission shall
hold a public hearing to consider changes to address Chapter 165-Zoning Ordinance to amend the"Allowed Uses"
tables for multiple zoning districts,and related changes.

CITIZEN COMMENTS
Daryl Bell, Opequon District, discussed the need for a new high school and more space in the
elementary schools.
Debra Snider, Gainesboro District, discussed the County's public safety radio communications tower
project including the tower site next to her property on Poorhouse Road.
Seth Haines, Gainesboro District, discussed the County's public safety radio communications tower
project.
Joseph Brand, Stonewall District, discussed mining regulations that could be added to the zoning
ordinance to help the residents.
BOARD OF SUPERVISORS COMMENTS
Vice Chairman Dunn thanked the staff for their efforts in light of the long meeting.
Supervisor Graber requested that the Board have a closed session to discuss the performance and
implementation of the public safety radio system project.
Vice Chairman Dunn said he was agreeable to a closed session.
Supervisor Lockridge said she was agreeable to a closed session.

Subject: Parks and Recreation Commission Action
The Parks and Recreation Commission met on July 18, 2023. Members present were Natalie
Gerometta, Gary Longerbeam, Randy Carter, Ronald Madagan, Dennis Grubbs, and Jenny
Myers. Non-voting Board Liaison, Mr. Charles Dehaven
Members Absent: Guss Morrison and Zac Franz
ITEMS REQUIRING ACTION BY BOARD OF SUPERVISORS:

ITEMS SUBMITTED FOR INFORMATION ONLY
1. The Commission recommended requesting a supplemental appropriation in the amount of
$2,524 which represents donations received to the PLAY Fund during FY 23 and dispersed to
the appropriate revenue lines. These funds represent financial assistance provided to County
youth to participate in a variety of programs and activities.
2. Mr. Madagan made a motion to accept the Air Quality Policy (500.25) as presented by staff,
seconded by Mr. Grubbs, carried unanimously(6-0).

PUBLIC SAFETY COMMITTEE REPORT to the BOARD OF SUPERVISORS
Thursday July 20, 2023

ITEMS REQUIRING ACTION BY BOARD OF SUPERVISORS:

ITEMS FOR INFORMATION ONLY:
1. Update on proposed Fire Station 22:
Chief Majchrzak provided an update to the proposed Fire Station 22 proposed to be
located in the southern end of the county. Currently the closest station- Stephens
City Company 11- is approximately 12 miles away from communities like Lake
Frederick. Fire& Rescue staff are working on vehicle solicitations, equipment
needs and staffing scenarios for the proposed station and are projecting a possible
completion date in 2025. Chairman Wells requested that Chief Majchrzak and
County Administrator Bollhoefer meet to narrow down 3 general locations for the
proposed station adding that Frederick Water owns land in the area which could be
utilized at no cost. An update on the proposed sites is requested in 90 days.
2. Report on the Dowell J. Howard program:
Deputy Caden Thurgood from the School Resource Officer division and Ben
Thompson, Principal at Dowell J. Howard presented information on the newly
adopted vocational studies program Criminal Justice 1 scheduled to begin in the
2023-2024 school year. This program would allow career exploration in law
enforcement and corrections. Students overwhelmingly voted to adapt this program
and interest is high for enrollment. Lt. Cornwell noted that Frederick County is the
only county in the State to provide this program with a certified deputy as instructor.

Director Perez added that in the 2024-2025 school year, there will also be a
Communications class offered as well for students interested in a career in public
safety communications/dispatch.
3. Blue Line Solutions-school zone speeding enforcement(see attached):
Lt. Gosnell discussed a proposed new speed enforcement project for school zones.
There are currently 12 active school zones in the county that are active in the
morning and afternoon. He noted limited manpower makes it difficult to monitor
the speed of motorists in these zones. This proposed program would be at zero cost
to the County. Blue Line would install and maintain all cameras. Lt. Gosnell briefly
discussed how the program would work to include fines and summonses.
4. 522/Lake Frederick intersection:
Chairman Wells requested input on the intersection at 522 and Lake Frederick citing
the numerous accidents and close calls. Sheriff Millholland advised that he had
made a request to VDOT to do a site survey to see what could be done about the
stoplights/notifications. Major Hawkins mentioned doing away with the yellow
flashing left turn arrow to avoid creating blind spots.
5. Other business (see attached):
Helen Lake mentioned that she will be presenting a 2-hour in person workshop
titled "Communicating using Cross Cultural Awareness" on August 7th geared
towards School Resource Officers. The intent is to provide School Resource
Officers information that will help them to communicate and interact with students
and parents who are of varied cultural ethnicities and for the SRO's to understand

6. Closed session called at 9:26 a.m.:
All Public Safety Committee members were present except Denny Linaburg. Ms.
Lake moved that the Frederick County Public Safety Committee enter a closed
session pursuant to Virginia Code Section 2.2-3711(A)(1) for personnel
matters, specifically discussion of public safety communications staff.
Chairman Wells seconded the motion which carried on a voice vote.
Ms. Lake moved that the Frederick County Public Safety Committee come out
of closed session and reconvene in regular session. The motion was seconded
by Chairman Wells and carried on a voice vote.
At 10:02, Ms. Lake moved that the Frederick County Public Safety Committee
certifies that,to the best of each member's knowledge, (i) only public business
matters lawfully exempted from open meeting requirements by Virginia law
and (ii) only such public business matters as were identified in the motion

TRANSPORTATION COMMITTEE REPORT to the BOARD OF SUPERVISORS

ITEMS FOR INFORMATION ONLY:
1-Transportation Impact Fee Presentation: Julie Herlands, Vice President of TischlerBise a
Fiscal, Economic and Planning Consultants group gave a presentation on Road Impact Fees and
Cash Proffers for Transportation with study options and analyses available to the County.
TischlerBise is the County's consultant on the Development Impact Model. After, discussion
consensus was reached to support using the firm to study Road Impact Fees and Cash Proffers
for Transportation.
2-County Project Updates: Renaissance Drive: Land disturbance is underway on the primary
road corridor. Staff is awaiting final execution of the signed agreements sent to CSX.
Gainesboro Road/Route 522 Intersection Project: Staff is currently waiting on VDOT's review.
Route 37 Study: The consultant will soon begin interviews with the stakeholders as well as
issuing a survey to the Public. Staff met with the consultants on June 14, to review survey
materials and stakeholder's list as well as discuss overall project approach.
3-Other:The Committee directed Staff to draft a letterto the 1-81 Advisory Committee members
with the endorsement to accelerate the importance of the Diverging Diamond Interstate at 1-81
exit 317, 1-81 widening project scope, and the Redbud Road realignment projects with the
reference to the impact of the June 23, 2023, incident that backed traffic up to the West Virginia
line.
