008-23 (ProhibitLeasingOnPublicSafetyRadioTowerOnPoorhouseRd) RESOLUTION PROHIBITING LEASING OF SPACE ON FREDERICK
COUNTY PUBLIC SAFETY RADIO TOWER LOCATED ON
POORHOUSE ROAD
WHEREAS, Frederick County has entered a contract with E.F. Johnson to construct a P25
Public Safety Radio System; and
WHEREAS, E. F. Johnson's proposed system design utilized 10 towers, nine Iocated within
Frederick County and one shared site in Shenandoah County; and
WHEREAS, it was the desire of the Board of Supervisors to control cost and third-party access
by owning the towers located within Frederick County versus leasing space on existing towers;
and
WHEREAS, Frederick County has been approached by neighboring property owners on
Poorhouse Road requesting the County not lease space on this proposed tower; and
WHEREAS, Frederick County has several local, state, regional, and federal public safety
partners who might desire to locate equipment on this tower to further the protection of the
public safety, health, and welfare of the citizens of Frederick County, the Northern Shenandoah
Valley, the Commonwealth of Virginia, and the United States of America.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE
COUNTY OF FREDERICK, VIRGINIA, that the leasing of space to a third-party commercial
telecommunications provider on the proposed tower to be located at 509 Poorhouse Road shall
be prohibited; and
BE IT FURTHER RESOLVED that this prohibition shall not affect the County's ability to
lease or provide space on this tower to accommodate any local, state, or federal agencies to
further the protection of the public safety, health, and welfare of the citizens of Frederick County,
the Northern Shenandoah Valley, the Commonwealth of Virginia, or the United States of
America.
