Ms. McCann-Slaughter stated she felt the Intrafi Insured Cash Sweep with Bank of Clarke was the best option and saw no reason not to make the change. Mr. Till stated, for clarification purposes, that consideration was being given to moving the entire amount now invested with Scott & Stringfellow to another account. On motion of Ms. McCann-Slaughter, seconded by Mr. Crockett, the Board voted to move the investment account to the Intrafi Insured Cash Sweep with the Bank of Clarke by the following recorded vote: J. Page 3 of 4 Frederick County EDA Meeting Minutes | May 8, 2023 RETURN TO OPEN MEETING At the conclusion of the closed meeting concerning the discussion concerning the acquisition of real property for a public purpose, or of the disposition of publicly held real property, where discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the Authority, and the discussion concerning a prospective business or industry where no previous announcement has been made of the business or industry’s interest in locating its facilities in the community, the following Resolution was unanimously adopted upon roll call vote as set forth below: WHEREAS, the Economic Development Authority of the County of Frederick, Virginia has concluded its “closed meeting” at a meeting held on May 8, 2023, and desires return to an “open meeting”; and WHEREAS, the adoption of this Resolution is intended to serve as the “Certificate” described in Section 2.2-3712(D) of the Code of Virginia (1950, as amended). Jenkins, Co-Executor, and Teresa L. McFarland, Co-Executrix of the Estate of Oscar Junior Jenkins, Deceased, for the sale and purchase of that certain parcel of land containing 6.85 acres, more or less, situate on the North side of Route 37 in Stonewall Magisterial District, Frederick County, Virginia, designated as 425 Lenoir Drive, Winchester, Virginia 22603, Frederick County Tax Map No. 43-A-23. ADJOURN There being no further business to come before this Authority, the meeting was adjourned at 8:25 a.m. ________________________________ ____________________________ Richard Till Jay Tibbs Chairman Secretary DATE: June 30, 2023 TO: Board of Directors, Frederick County Economic Development Authority FROM: Patrick Barker, CEcD Executive Director CC: Jay Tibbs Deputy County Administrator RE: Conversion of the M1 & M2 Zoning districts from SIC to NAIC Frederick County’s Planning and Development Department is proposing to amend the County’s industrial zoning districts, M1 (Light Industrial), M2 (Industrial General), and TM (Technology- Manufacturing Park), to update and convert to the North American Industry Classification System (NAICS). The NAICS is an alternative system that is maintained and updated on a regular basis. The 2022 edition of the NAICS classification system was reviewed by Planning staff and used in making the transition from SIC to NAICS. As amended, the “Allowed Uses” list for each district was updated to reflect NAICS terminology. Numeric SIC coding was removed. Further, a statement was added to the “Intent” section specifying how the Zoning Administrator may interpret use definitions, using those definitions provided through NAICS resources. Given the broad impact this change will have on the Zoning Ordinance, the information contained herein is limited only to the use tables impacted. Other sections of the ordinance that reference SIC will also be amended to ensure consistency. Current Zoning Ordinance Standard: The ordinance currently classifies industries using the Standard Industrial Classification System (SIC), which was last updated in 1987. The SIC includes many uses that have outdated terminology and definitions. Use of SIC presents a challenge to Planning staff in making interpretations and determinations regarding uses. Staff is seeking EDA Board direction regarding the need or desire to provide a formal comment regarding the proposed ordinance amendments. The EDA Strategy, under the goal of fostering and maintaining a pro-business climate by enhancing critical assets and employing business friendly policies and procedures, supports such activity by the EDA Board and would be consistent with past actions with the OM to TM zoning district and the Northeast Land Use Plan update. Proposed Changes – M1 (Light Industrial) District Revised June 14, 2023 Part 606 M1 Light Industrial District [Amended 6-14-2023] § 165-606.01 Intent. The intent of this district is to provide for a variety of light manufacturing, commercial office and heavy commercial uses in well-planned industrial settings. Uses are allowed which do not create noise, smoke, dust or other hazards. Uses are allowed which do not adversely affect nearby residential or business areas. Such industrial areas shall be provided with safe and sufficient access. The North American Industry Classification System (NAICS) shall be used to assist the Zoning Administrator in classifying the permitted uses. § 165-606.02 Allowed uses. This meeting will focus on the current direction and activities of the EDA, as well as provide an opportunity for the EDA Board and Board of Supervisors to discuss expectations for economic development. As discussed, the agenda is structured around the recently revised EDA Strategy. Each one of the four major goals will be defined and then a few activities from each goal will be highlighted along with measurements. The discussion concludes by highlighting a few of the planned activities under each goal. Enclosed is a draft presentation for consideration and review. This budget aims to further elevate the EDA’s efforts of attracting and retaining workforce talent, retaining and expanding existing businesses, recruiting targeted businesses, and employing policies that keep Frederick County a competitive business location. The request is consistent with past budget appropriations with additional investment sought to enhance the EDA’s capacity to respond to the top locally influenced factors used by corporate decision makers and site consultants, talent. A summary of the EDA’s request by program area follows. Funding for bilingual services by the Small Business Development Center was partially funded with an additional $10,000. In September of 2021, the EDA Board appropriated $15,000 to the Laurel Ridge Small Business Development Center (SBDC) to offer bilingual counseling services in Spanish. Through the bilingual counseling services funding, SBDC has assisted 82 Hispanic/Latino clients. These clients previously would not have been able to have been served appropriately due to a language barrier. At its 2022 September meeting this year, the EDA Board once again appropriated $15,000 for this service. Given the on-going nature of this appropriation, the EDA Board sought funding for this service in the EDA’s FY24 budget request to Frederick County. The proposal to convert the part time Project Specialist position to full time was not funded. The full-time position would have chiefly been responsible for implementing the Talent Solutions Strategy. This position was recommended in the Talent Solutions Strategy and aligned with the Target Industry Study’s short-term needs. Funding for the part time position remains. Staff will consider options for the position, but the implementation of the Talent Solutions Strategy will continue regardless.
