He listed those agencies receiving the amount of funds they requested during the budget process as follows: the Health Department, Our Health, Inc., NSV Substance Abuse Coalition, Northwestern Community Services, Access Independence, Shenandoah Area Agency on Aging, NSV Regional Commission, and the Frederick-Winchester Tourism Program. Supervisor Wells seconded the motion. Supervisor Graber said he would not support Mr. Oates because of a possible conflict of interest stemming from Mr. Oates's employment. Supervisor Wells noted the positive changes he has seen during Mr. Oates's tenure on the Frederick Water Board. Supervisor Ludwig said he did not want to have the appearance of a conflict of interest should an appointed member bring business before the Board of Supervisors. He noted the next agenda item was related to this request. Chairman DeHaven opened the public hearing. No one wished to address the Board. Chairman DeHaven closed the public hearing. He said 1164 Brucetown is currently operated as the Clearbrook Post Office, and 1176 is a Single-Family Residential home. He said that the property is located within the County's Sewer and Water Service Area (SWSA) but not the Urban Development Area (UDA) and Board policy requires that residential land uses be located within both the SWSA and the UDA to enable connections to Frederick Water services. He concluded by saying that Frederick Water is willing and able to serve the properties if authorized by the Board. DeHaven, Jr. Aye Judith McCann-Slaughter Aye RESOLUTION AUTHORIZING FREDERICK WATER TO PROVIDE WATER AND SEWER SERVICE OUTSIDE OF THE URBAN DEVELOPMENT AREA WHEREAS, Frederick County has received a request from Robert and Julie Owens to authorize Frederick Water to serve two parcels with public water and sewer. The properties are located along the south side of Brucetown Road and are identified by Property Identification Numbers (PIN) 33-A-160 & 33-A-161, in the Stonewall Magisterial District; and WHEREAS,this extension of water and sewer service would only serve PINS 33-A-160&33-A-161 while it is zoned Rural Areas(RA). NOW,THEREFORE,BE IT RESOLVED,that the Frederick County Board of Supervisors approves the extension of water and sewer service outside of the Urban Development Area for Robert and Julie Owens, PINS 33-A-160 & 33- A-161 and does hereby authorize Frederick Water to serve this property while it is zoned RA. + + + + + + + + + + + + + + Minute Book 48 Board of Supervisors Regular Meeting of May 24, 2023 County of Frederick, Virginia 333 NORTHEAST LAND USE PLAN—SENT FORWARD TO PUBLIC HEARING Director of Planning and Development Wyatt Pearson reviewed the process used to prepare the draft Northeast Land Use Plan. He said Staff was seeking direction from the Board of Supervisors as to whether the Planning Commission's draft version of the NELUP is ready for agency comment (VDOT) and to be scheduled for public hearings. The Board and Mr. Pearson discussed the process used to draft the updated plan and the future plans for Carmeuse to expand extractive mining operations at either of its two locations in the County. Supervisor Graber discussed transportation concerns that could result from increased mining operations at Carmeuse's Middletown site should the expansion of mining not be permitted in the Stonewall area through the land use plan update. Supervisor Ludwig said he wanted to learn more about the number of residents who could be affected by the land use plan as it relates to extractive mining. He noted that Carmeuse has stated that truck traffic will increase by 200 trips per day if mining operations are expanded in Middletown. Supervisor Graber discussed possible funding for road improvements at Exit 317 and stated it makes more sense to keep the truck traffic in the Stonewall area. Mr. Pearson noted that while funding for Exit 317 is likely to be awarded through VDOT, the timing is still several years away. At Supervisor Slaughter's request, Mr. Pearson explained the difference between the land use plan and rezoning. Supervisor Ludwig noted the benefits to the County from the Carmeuse mining projects. Supervisor Slaughter said that she was supportive of some of the citizen work groups' recommendations and recommendations made by staff. She moved that the Board authorize staff to schedule a public hearing on the draft Northeast Land Use Plan as presented to the Planning Commission on December 7th, 2022, with modification as to the properties in the vicinity of Branson Springs Road, Woodbine Road, and Grace Church Road to be represented as Industrial and Mixed Use Industrial Office rather than Extractive Mining, and keeping the properties southwest of Rest Church Road and Zachary Ann Lane as they are currently designated on the adopted Northeast Land Use Plan (Mixed Use Industrial Office) rather than change them to industrial. Paula Tingle, Opequon District, said that her complaints had been addressed by Glo Fiber, but that she continues to have no response from Verizon about similar property damage complaints. BOARD OF SUPERVISORS COMMENTS Supervisor Graber discussed the recently adopted budget and warned of possible future tax increases. Vice Chairman Dunn reviewed the discussion regarding the real estate rate saying he had voted for the adopted rate of$0.51 per$100 of assessed value which is a reduction from the previous $0.61 rate.
