HomeMy WebLinkAboutBOEminutes2023april28 Minutes BOARD OF EQUALIZATION Friday, April 28, 2023 10:00 AM 107 NORTH KENT STREET, WINCHESTER, VIRGINIA ATTENDEES: Board Members Present: Theo Theologis, Jake Carpenter, Betsy Brumback, Scott Strosnider, Bradley Comstock Board Members Absent: Staff present: Kelly Fultz Call to order: The meeting was called to order at 10:10 AM Motion made by Theo Theologis and seconded by Jake Carpenter to approve the minutes from 4/62023. The Board voted unanimously in favor of approving those minutes. Online: 145 Emperor Dr (Map #87B-5-2-133) - Online appeal, the board reviewed the materials presented, including comparable sales. In evaluating, the price per square foot and other features are being equitably assessed to this home when compared to neighboring homes and the comps provided. No change was applied. Phone: 10:45 AM - 110 Country Club Dr - Map #18A0710-498 - Marcelle Frank - understands the 7,000 increase by adding the value of the water/sewer, but understand how the value would have increased by over 40,000. The board compared this property to neighboring similar properties and determined that it is being equitably assessed, no change was made. The Board did encourage Ms. Frank to reach out to the office to learn about available tax relief programs to see if she qualifies. In-Person: 11:00 AM - 214 Flanagan Dr (Map #64G-2-2-106) - Mr. Campos had appealed by mail and did not understand he would not be scheduled for a time to present his appeal. The Board met with Mr. Campos to explain the process and reasoning for the decision they rendered, and to inform him of next steps should he decide to appeal. Mr. Campos expressed concerns that assessments are not being applied equitably, and that there are differences in homes based on quality, age, condition, etc., that are not being looked at. The board showed examples and explained how each home is given a factor and depreciation is applied, and the items he referenced are a part of the calculations on how the price per square foot is determined. Mr. Campos was not satisfied with the response; however, his concerns were heard and the board determined that his property has been equitably assessed with surrounding similar homes. 11:15 AM - 9413 N Frederick Pike (Map #06-A-74) - Mr. Kozicki has a life estate to the property. He shared concerns for the property including surrounding orchards that spray pesticides, proximity to the road which would prevent him from having a dog, and fire department adjacent causing lots of noice. Concerns regarding the quality of the home, floor settling, etc., also two of the sheds are falling down, and the garage doors are broken and roof rusted, discussed the overall poor condition of the home. Mr. Kozicki shared photos of the property including falling down sheds, metal garage issues, etc., so the Board determined that adjusting to account for the condition of those items would be appropriate, reducing the assessed value from 178,900 down to 172,900. Phone: 12:00 PM - Metromont Corporation (Map #54-A-17, 54-A-15A, 54-A-15, 54-A-14, 54-A-13, 54- A-12, 54-A-11) - Wayne Tannenbaum with Pivotal Tax Solutions by phone representing Metromont Corporation, explaining this property and that it is an inferior industrial property. Shell style property, metal siding, poorly maintained grounds and buildings plus inferior quality buildings. This property was built over time since 1977 up through 2004. Mr. Tannenbaum shared a presentation including several recent sales (larger buildings on much smaller lots), and made a point that he was not questioning the land value. In evaluating and comparing to other properties, the board determined that the land is being assessed at a similar or lower rate than other M2 zoned land in the County, and that the buildings and improvements are being assessed equitably to other M2 type improvements, so they decided no change was warranted for these parcels.
