RESOLUTION AUTHORIZING FREDERICK WATER TO PROVIDE WATER AND
SEWER SERVICE OUTSIDE OF THE URBAN DEVELOPMENT AREA
WHEREAS, Frederick County has received a request from Robert and Julie Owens to authorize
Frederick Water to serve two parcels with public water and sewer. The properties are located
along the south side of Brucetown Road and are identified by Property Identification Numbers
(PIN) 33-A-160 & 33-A-161, in the Stonewall Magisterial District; and
WHEREAS,this extension of water and sewer service would only serve PINs 33-A-160 & 33-A-
161 while it is zoned Rural Areas (RA).
NOW, THEREFORE, BE IT RESOLVED, that the Frederick County Board of Supervisors
approves the extension of water and sewer service outside of the Urban Development Area for
Robert and Julie Owens, PINs 33-A-160 & 33-A-161 and does hereby authorize Frederick Water
to serve this property while it is zoned RA.

SUBJECT: Request to Serve Residential Land Uses With Public Water& Sewer
Outside The Urban Development Area— 1164-1176 Brucetown Road
DATE: May 18th, 2023
Frederick County has received a request from Robert and Julie Owens to authorize
Frederick Water to serve 1164 & 1176 Brucetown Road (parcels 33 A 160 & 33 A 161)
with public sewer. 1164 Brucetown is currently operated as the Clearbrook Post Office,
and 1176 is a Single-Family Residential home.
The Northeast Land Use Plan (NELUP) depicts these properties with a Sensitive Natural
Areas future land use designation, and as a part of the Clearbrook-Brucetown Rural
Community Center. The Rural Areas section of the Comprehensive Plan does call for
support of the Rural Community Centers and to position them to accommodate future
residential growth. The property is located within the County's Sewer and Water Service
Area (SWSA) but not the Urban Development Area (UDA). Board policy requires that
residential land uses be located within both the SWSA and the UDA to enable
connections to Frederick Water services. Frederick Water is willing and able to serve the
properties if authorized by the Board.
The applicant sites the age of the existing drainfields for both properties as the primary
driver for this request. As of right now the applicant has not expressed any intention to
conduct a different use for the property other than that occurring now (single family
home and post office). Other potential reuse of the property would be limited by the RA
zoning designation.
The Planning Commission recommended approval of this request at their May
17th meeting. General discussion occured regarding the granting of UDA exceptions.

To whom it may concern,
We recently acquired two properties on Brucetown Road and are requesting approval to hook up to the
county water and sewer.
We would need an easement of 2 to 4 feet across the fence at the Clear Brook Park, maintenance shop
area to hook up to the water and septic to the two properties we acquired. The first one is 1176
Brucetown Rd., and the next one is 1164 Brucetown Rd., which is now a post office. Due to the age of
the drainfield that already exist at the properties and the blasting from the nearby quarry, I feel it's just
a matter of time before both systems fail. We contacted Earl Wiley, Engineer, at Frederick County water
and septic, extension 115, and he came down to the properties and said they have an easement that is 2
to 4 feet on the other side of the park maintenance shop fence and that I would need to get an
easement to connect to their easement.The easement we need would be put in the county water and
septic name and they would do all the excavating work needed and would put the property involved
back to or better than before with new gravel, etc.
